La narración poética-teológica de Avito de Vienne y el conjunto de relatos hagiográficos de Gregorio Magno dan cuenta de la continuidad del ideal clásico de uirtus y de su adopción por parte del cristianismo. La tipología bíblica basada en personajes del Antiguo Testamento, así como las vidas de santos occidentales contemporáneos a los autores, recrean un universo social y religioso propio del siglo VI. Asimismo, ponen de manifiesto el lugar de la historia como historia salutis y de la actuación de (...) los hombres justos -los santos- en el devenir humano a través de su testimonio y de los milagros. This article focuses on the use of one verse from the Biblical Songs of Songs in central passages of Giordano Bruno's first published book on the art of memory. De umbris idearum [On the Shadows of Ideas] not solely aims at improving mnemonic capacities, it also envisages the preconditions and limits of cognition in Bruno's new inifitist cosmology. Taking relevant scholarly literature on the topic as a point of departure, this contribution presents De umbris in the context of Bruno's philosophy (...) in general; it focuses on Bruno's evocation of Origen's commentary on that passage in the Song of Songs. The article analyzes in detail the reasons for Bruno's subversion of the traditional exegetic tradition that was massively influenced by Origen's spiritualized reading of the Song of Songs. Bruno's misappropriation of the Origen's commentary turns out to be a mise en abyme, a mannerist strategy of representation. It not only reflects the very method that underlies Bruno's art of memory, but is also to be understood as a conscious subversion of exegetic traditions in general. (shrink)

Erik Olof Burman (1845–1929) was professor of practical philosophy at the University of Uppsala, Sweden, between 1896 and 1910. In 1879 he published a long essay entitled ”Om den nyare italienska filosofien” (”On recent Italian philosophy”). About half the essay is devoted to the philosophical system of Antonio Rosmini (1797–1855), the second half to that of Vincenzo Gioberti (1801–1852). The text is mainly descriptive, apparently aiming at informing Swedish colleagues about the situation in Italy. However, there are also passages revealing (...) the rationalist-idealist subjectivism of Burman himself as well as his considering Rosmini’s ontology too objectivistic and Gioberti’s idealism insufficiently coherent. A preliminary translation of Burman’s essay into Italian is presented. -/- Erik Olof Burman (1845–1929) fu professore di Filosofia Pratica all’Università di Uppsala negli anni 1896–1910. New 1879 publicò un saggio intitolato ”Om den nyare italienska filosofien” (“Sulla filosofia italiana recente”). Quasi metà di questo lavoro si concentra sul sistema di Antonio Rosmini (1797–1855); la seconda parte verte anzitutto invece su quello di Vincenzo Gioberti (1801–1852). Il testo è principalmente descrittivo, ovviamente mirante a informare filosofi svedesi sulle posizioni attuali in Italia. Vi si trovano anche però commenti sparsi indicanti il razialismo-idealismo soggetivo di Burman stesso e considerazioni riguardo a come egli consideri l’ontologia di Rosmini troppo oggettiva e l’idealismo di Gioberti insufficientemente coerente. Riflettendo l’immagine della filosofia italiana del IX secolo in uno specchio straniero, il lavoro potrebbe essere di un certo valore informativo per moderni filosofi e storici italiani. Studying early modern medico-legal testimonies can enrich our understanding of witnessing, the focus of much research in the history of science. Expert testimonies were well established in the Roman Canon law, but the sphere of competence of expert witnesses—one of the grounds on which seventeenth-century physicians claimed social and intellectual authority—troubled contemporary jurists. By reconstructing these debates in Counter Reformation Rome, and by placing in them the testimonies given by Paolo Zacchia, one of the founding fathers of legal medicine, this (...) article discusses the epistemological and social issues surrounding the definition of expertise about the body in court. It shows how a high-ranking expert witness would define his competence versus the legal authority on the one hand, and versus lay and lower-status expert witnesses on the other. But it also explores the interactions between specific legal constraints, for example about eye witnessing, and the ways in which different kinds of witnesses would use the body as a source of evidence for testimony. While engaging with medico-legal issues including the ambiguous signs of childbirth and the visibility of pain, the article examines their meanings within Counter Reformation social controversies, including control over sexuality, imposition of discipline and the social status of physicians.Author Keywords: Legal medicine; Seventeenth-century Rome; Expert witnesses; Testimony; Body; Zacchia. This article constructs a critical historical, political and theoretical analysis of the essence of Fascist criminal law discourse in terms of the violence that shaped and characterised it. The article examines the significance of violence in key declarations about the role and purpose of criminal law by Alfredo Rocco, Fascist Minister of Justice and leading ideologue, in his principal speech on the final draft of the 1930 Italian Penal Code. It is grounded on the premise that criminal law is particularly (...) significant for understanding the relationship between State power and individuals, and so what was distinctive about Fascist thinking in this regard. The article analyses Rocco’s declarations as a discourse in order to highlight their contextual foundations, construction and ideological connections. It argues that the core theme of that discourse is violence, which has three principal dimensions: a close historical and rhetorical connection with war, a focus on repressive and intimidatory force, and a paramount concern with subordinating individuals to State interests. The article then uses this analysis to develop a theoretical reading of the nexus between criminal law and violence in Fascism, in terms of its foundations and reversal of ends and means. The article thus provides an original perspective on Fascism and criminal law, which it argues is important for critical engagement with criminal law discourse in our democracies today. (shrink)

The relationship between the political theory of Rousseau and modern natural law continues to be the subject of debate, both with regard to Rousseau's faithfulness to the idea of natural law itself and regarding the precise extent of the debt he owed to his predecessors. In this article the author re-examines this relationship by focusing attention on what has been defined as the protestant tradition of natural law. In particular she concentrates on the political and theoretical exercise that Jean Barbeyrac (...) had sought to perform by constructing a particular version of this tradition, namely that of using the science of natural law to promote a policy of tolerance between protestants and to justify the right of citizens to resist catholic sovereigns who denied them religious freedom, as well as the right of protestant countries to come to the aid of persecuted fellow believers. The thesis asserts that Rousseau was fully aware of this exercise, just as he was aware that some of Barbeyrac's ideas had been adopted and reworked by another illustrious Genevan, Jean-Jacques Burlamaqui, a member of the Small Council, to support anti-populist and antidemocratic politics in Geneva. Viewed in this way it is possible to perceive in Rousseau's political thought not so much a “first crisis” of natural law as an intention to reformulate this science from a republican perspective in order to derive rigorous principles of political law from it. And in developing his republican political theory Rousseau took up and overturned the analysis of democratic sovereignty carried out by Pufendorf, who in opposing the “pro-monarchist” excesses of authors such as Hobbes and Horn had unhesitatingly demonstrated the complete validity of democratic sovereignty. ☆ I would like to thank Matthew Armistead for his excellent English translation. The question whether both enemies in a war could claim the same right, was a fundamental topic in the early modern theory of war and Grotius treated it briefly in his On Law of Prize and Booty. The jurisprudence of the seventeenth century developed two explanations: the Scholastic tradition held that only one party could fight with right reason, whereas some authors of the humanistic tradition thought that in some cases it was impossible to solve this question. Grotius took elements (...) from both traditions, applying them to two different levels of his argument. If we namely consider the rulers, we should accept the Scholastic conclusion that only one party can fight with right reason. But the subordinate soldiers do not always have an exhaustive knowledge of the situation and need first of all to acknowledge that their superiors command legitimately. Thus, each level uses a different logical relationship in the Aristotelian square because the enemies follow in the former case the pattern of contrary propositions, but in the latter they obey a pattern of subcontrary propositions. William Gilbert’s work, De magnete (1600), often is referred to as the first monographic study on magnetism in the early-modern period. Recently, however, it has been argued that the Jesuit, Leonardo Garzoni, wrote an experimental study on the subject twenty years earlier and that his research influenced particularly the work of Giambattista Della Porta and Paolo Sarpi,two important protagonists in the history of studies in magnetism. However, to date, Garzoni’s authorship of an anonymous treatise in manuscript, located at the Biblioteca (...) Ambrosiana in Milan, and taken to bear witness to his research, has been based only on circumstantial evidence. This article outlines the identification of two further manuscript copies of this treatise, which have not been studied so far. It shall be argued that the evidence contained in these manuscripts corroborates the assumption that Garzoni indeed is the author of the work that was transmitted anonymously. Moreover, it can be shown that the work was completed and prepared for print later on. These findings also allow us to argue more conclusively that Paolo Sarpi knew Garzoni’s work and passed it to Giambattista Della Porta, who bequethed his copy to the Accademia dei Lincei and thereby made it available to some of the academy’s most important members, Nicolas Claude Fabri de Peiresc and Cassiano Dal Pozzo. Finally, the dynamics of this textual transmission provide insights into how scholars approached the study of ‘magnetism’ in the early-modern period. (shrink)

ABSTRACTThis essay examines two anonymous pamphlets that have sometimes been attributed to John Millar: the ‘Letters of Sidney’, and the ‘Letters of Crito’, both published in 1796 by the Scots Chronicle. It outlines the political context for the pamphlets’ publication and the evidence for and against Millar's authorship, and reassesses their contents' significance for our interpretation of Millar's other writings. While the ‘Letters of Crito’ present a classically Foxite critique of Pitt's ministry and Britain's war against revolutionary France, the ‘Letters (...) of Sidney’ put forth a more theoretical defence of property reform based upon a Smithian theory of justice. Yet taken together, the essay demonstrates the pamphlets offer new insights into the political discussions that were taking place in Scottish Foxite Whig circles in the 1790s. They also provide a snapshot of the various ways in which the theories of the Scottish Enlightenment could be used by Millar and his circle of friends and students to interpret the political context of the mid-1790s, as the French Revolution was transforming the political language of its English and Scottish contemporaries. This article seeks to deepen Giorgio Agamben’s brief investigation of the Foucauldian technical term dispositif, by locating it (and the triple structure which articulates it) in the larger context of his own contribution to the genealogy of “governmentality.” Following Agamben’s reconstruction of the Christian paradigm for the divine government of the world, it explores the singular relation between governmental dispositifs and concurrent modes of subjectivation. It argues that the contingency of human action must first be secured for the governmental machine (...) to be able to operate. (shrink)

O presente artigo aborda a concepção de virtude, vício e pecado nas obras Dialogus inter philosophum, Iudaeum et Christianum ou Collationes e Ethica ou Scito te Ipsum, ambas escritas por Pedro Abelardo, o qual, além de contribuir para o desenvolvimento da lógica medieval, também inovou com sua pesquisa ética à medida que distinguiu o vício do pecado, afirmando ser o primeiro uma enfermidade da alma e o segundo fruto do consentimento no mal o qual reside na intenção do agente.

Muratori has often been portrayed as a moral philosopher who represented the traditional neo-Aristotelian mainstream of Italian intellectual life in the early part of the eighteenth century. His loyalty to Christianity as a basis from which societies ought to be reformed has determined his reputation as a ‘pre-enlightened’ thinker. Yet, it is argued here that not only was Muratori very much in touch with the state of the art of early eighteenth-century moral philosophy, but also that he was really a (...) historian with political interests who came to develop a renewed Christian moral philosophy as a tool to respond to the political challenges of the time. Fallen man's preference for self-preservation to natural freedom prepared him for engaging in increasingly sociable contexts that required further self-disciplining and moral improvement. Thus, man cultivated his fallen condition into prudence and ultimately developed a capacity both for charity and for functioning in modern commercial societies. (shrink)

Il volume raccoglie saggi dedicati alla Fenomenologia dello spirito di G.W.F. Hegel e ad alcune sue principali interpretazioni. A scritti dal taglio più nettamente storiografico che ne ricostruiscono le influenze in autori quali Marx, Gentile, Heidegger, Kojève, Paci, Lacan e Brandom, si affiancano contributi volti a ricostruire alcuni nodi categoriali che, sollecitati dal testo hegeliano, hanno segnato le riflessioni etiche, teoretiche, filosofico-politiche e psicoanalitiche successive: dialettica, cultura, negazione, desiderio, corpo, fenomeno, riconoscimento. Questa raccolta non intende quindi né riproporre la lettera (...) del testo hegeliano, né avanzare una sua specifica interpretazione. Piuttosto, gli autori hanno condiviso lo sforzo di illustrare in actu exercito le possibilità di movimento tra questi due estremi – testo e interpretazione – tra cui la cultura filosofica si muove. Attraverso questo movimento la Fenomenologia dello spirito continua a produrre filosofia, ossia ad essere occasione e strumento per la comprensione del “proprio tempo col pensiero”. (shrink)

This article analyzes the relationship, according to Aegidius Romanus, between spiritual power and temporal power. From the point of view of the Augustinian author, the autonomy of the world or that of second causes, following St. Thomas Aquinas, must be respected, so that the motions of nature are not usually hampered by any extraordinary intervention. However, this intervention will always be possible in the form of a miracle and according to a special law. Similarly, temporal power normally follows its own (...) goals, without interventions ab extra, nevertheless, the Pope’s plenitude of power can suspend, if necessary (in casu), the power of the secular princes.
