Gustav Radbruch is one of the most important German‐speaking philosophers of law of the twentieth century. This paper raises the question of how to classify Radbruch's theories in the international context of legal philosophy and philosophy in general. Radbruch's work was mainly influenced by the southwest German school of Neo‐Kantianism, represented by Windelband, Rickert, and Lask. Their theories of culture and value show an affirmative‐holistic understanding of philosophy as a source of wisdom and meaningfulness. Kant, on the other hand, belongs (...) more to a fundamentally different, critical camp of philosophy. Although Radbruch has incorporated Kantian Elements into his theory, he is rather a member of the affirmative‐holistic camp. In the end the question will be raised as to what ought to be preserved of his philosophy. (shrink)

This paper extends the definition of strong supervenience to cover classes of relations of any adicity, including transworld relations. It motivates that project by showing that not all interesting supervenience claims involving relations are global supervenience claims. The proposed definition has five welcome features: it reduces to the familiar definition in the special case where the classes contain only monadic properties; it equips supervenience with the expected formal properties, such as transitivity and monotonicity; it entails that a relation supervenes on (...) its converse; it classifies certain paradigms correctly; it makes distinctions even in the realm of the non-contingent, as witnessed by the fact that identity does not supervene on any class of relations. Finally, the paper applies the defined concept, and the related concept of orthogonality, to the study of internal and external relations. (shrink)

ABSTRACTAlthough the British Idealists did not provide a systematic account of language as a distinct philosophical phenomenon, language is nonetheless a fundamental element of Idealist social and political philosophy. This is seen mostly in the Idealist treatment of the concept of general will, which resulted in a Hegelian theory of community, constituted by shared understandings and a shared account of the common good and common interest. This article contains analysis of the relations between language and socio-political institutions in British Idealist (...) writings. The narrative focuses on Thomas Hill Green and Bernard Bosanquet – two major political thinkers representing the said philosophical tradition. The argument proceeds as follows: firstly, possible linguistic interpretations of the Idealist philosophical tradition are introduced. The version of the paradox of false judgement examined at Tht. 188c10–189b9 relies on the assumption that to judge falsehoods is to judge the things which are not. The presentation of the argument displays several syntactic ambiguities: at several points it allows the reader to adopt different syntactic connections between the components of sentences. For instance, when Socrates says that in a false judgement the cognizer is “he who judges the things which are not about anything whatsoever” (188d3–4), how should (...) the clause “about anything whatsoever” be construed? In common with “he who judges” and “the things which are not” (in which case the cognizer would be “he who judges about anything whatsoever the things which are not about it”), or exclusively with “he who judges” (in which case the cognizer would be “he who judges about anything whatsoever the things which are not”)? The most plausible answer is that both construals are envisaged. Accordingly, the argument has two branches corresponding to these two alternative construals. In particular, it attempts to show that in both cases the cognizer will address what does not exist – an impossibility. The idea that a false judgement is concerned with what is not about its reference has a clear echo in the Sophist. The way in which the problem is handled in the Theaetetus provides a hint that can help to find a solution for the hotly debated issue of the interpretation of the Sophist’s account of false statement. Mr. Mathien asks for evidence that there is Canadian philosophy in a special sense. He is not concerned with questions about whether people who were Canadians, or lived out much or most of their working lives in Canada, wrote philosophy which deserves to be taken seriously. Rather, he asks whether what has gone on in Canada by way of philosophy can be assembled in such a way as to make a coherent discipline.
