This paper discusses the inefficacy problem that arises in contexts of “collective harm.‘ These are contexts in which by acting in a certain sort of way, people collectively cause harm, or fail to prevent it, but no individual act of the relevant sort seems to itself make a difference. The inefficacy problem is that if acting in the relevant way won’t make a difference, it’s unclear why it would be wrong. Each individual can argue, “things will be just as bad (...) whether or not I act in this way, so there’s no point in doing otherwise.‘ The goal of this paper is to give an overview of some of the main responses available to the problem and to highlight central issues that arise for each type of response. In the final section, I explain what I take to be the most promising strategy and discuss the form that this strategy should take. (shrink)

Recent political developments cast doubt on the wisdom of democratic decision-making. Brexit, the Colombian people's (initial) rejection of peace with the FARC, and the election of Donald Trump suggest that the time is right to explore alternatives to democracy. In this essay, I describe and defend the epistocratic system of government which is, given current theoretical and empirical knowledge, most likely to produce optimal political outcomes—or at least better outcomes than democracy produces. To wit, we should expand the suffrage as (...) wide as possible and weight citizens’ votes in accordance with their competence. As it turns out, the optimal system is closely related to J. S. Mill's plural voting proposal. I also explain how voters’ competences can be precisely determined, without reference to an objective standard of correctness and without generating invidious comparisons between voters. (shrink)

Politics abounds with bad language: lying and bullshitting, grandstanding and virtue signaling, code words and dogwhistles, and more. But why is there so much bad language in politics? And what, if anything, can we do about it? In this paper I show how these two questions are connected. Politics is full of bad language because existing social and political institutions are structured in such a way that the production of bad language becomes rational. In principle, by modifying these institutions we (...) can reduce the prevalence of bad language. However, as I show, such practical efforts are fraught with difficulties. After first outlining an account of bad language (Section 1), I examine the rationality of three different types of bad language: inaccurate language, insincere language, and unclear language (Section 2). Next, I discuss the possibility of implementing institutional reforms to improve the quality of political discourse (Section 3). However, I then outline and discuss two serious complications for institutional reforms—namely, they create risk of abuse, and they could preclude instances of seemingly bad language that, in fact, are socially beneficial (Section 4). I conclude with some thoughts about how to pursue institutional reform in an appropriately circumspect manner (Section 5). (shrink)

This chapter concerns the nature of our obligations as individuals when it comes to our emissions-producing activities and climate change. The first half of the chapter argues that the popular ‘expected utility’ approach to this question faces a problematic dilemma: either it gives skeptical verdicts, saying that there are no such obligations, or it yields implausibly strong verdicts. The second half of the chapter diagnoses the problem. It is argued that the dilemma arises from a very general feature of the (...) view, and thus is shared by other views as well. The chapter then discusses what an account of our individual obligations needs to look like if it is to avoid the dilemma. Finally, the discussion is extended beyond climate change to other collective impact contexts. (shrink)

The animal agriculture industry causes animals a tremendous amount of pain and suffering. Many ethical vegans argue that we therefore have an obligation to abstain from animal products in order to reduce this suffering. But this argument faces a challenge: thanks to the size and structure of the animal agriculture industry, any individual’s dietary choices are overwhelmingly unlikely to make a difference. In this paper, we criticize common replies to this challenge and develop an alternative argument for ethical veganism. Specifically, (...) we argue that individuals should abstain from animal products because vegans, as a group, successfully reduce animal suffering, and individuals are obligated to participate in, rather than free ride on, this collective endeavor. Or, at the very least, individuals have strong reasons to purchase fewer inhumanely raised animal products—even if they are not obligated to go vegan per se. (shrink)

On most accounts, beliefs are supposed to fit the world rather than change it. But believing can have social consequences, since the beliefs we form underwrite our actions and impact our character. Because our beliefs affect how we live our lives and how we treat other people, it is surprising how little attention is usually given to the moral status of believing apart from its epistemic justification. In what follows, I develop a version of the harm principle that applies to (...) beliefs as well as actions. In doing so, I challenge the often exaggerated distinction between forming beliefs and acting on them.1 After developing this view, I consider what it might imply about controversial research the goal of which is to yield true beliefs but the outcome of which might include negative social consequences. In particular, I focus on the implications of research into biological differences between racial groups. (shrink)

Until relatively recently, few democrats had much to say about the constitution of the ‘demos' that ought to rule. A number of recent writers have, however, argued that all those whose interests are affected must be enfranchised if decision-making is to be fully democratic. This article criticizes this approach, arguing that it misunderstands democracy. Democratic procedures are about the agency of the people so only agents can be enfranchised, yet not all bearers of interests are also agents. If we focus (...) on agency, rather than who is affected, then this leads us to focus on the permissible limits of action, rather than who makes the decision. Just as individual sovereignty is ordinarily limited by the requirement not to injure others, we may apply similar restrictions to what a demos can permissibly do. Thus, any collection of individuals may choose to regulate their affairs collectively for mutual benefit, but should be prohibited from imposing negative externalities on outsiders. On this view, the constitution or definition of the demos is arbitrary, from the democratic point of view. Moreover, democracy does not require the expansion of the franchise, unless injuries cannot be avoided. (shrink)

Many philosophers have claimed that relying on the testimony of others in normative questions is in some way problematic. In this paper, I consider whether we should be troubled by deference in democratic politics. I argue that deference is less problematic in impure cases of political deference, and most non-ideal cases of political deference are impure. To establish the second point, I rely on empirical research from political psychology. I also outline two principled reasons why we should expect political deference (...) to be untroubling: political problems are difficult and require a division of epistemic labour; furthermore, there is value in exercising epistemic solidarity with those one shares an identity or interests with. I defend the view that individual agents have instrumental moral reasons for and against contributing to collective actions. I distinguish three versions of this view found in the literature and argue that only one withstands scrutiny: the version on which each individual contribution to a collective action is a cause of the latter’s large-scale outcomes. The central difficulty with this view is its apparent incompatibility with leading theories of causation. Against these theories I motivate a general structural principle about causation (...) which enables instrumentalism to deliver the intuitively correct verdicts about individual agents’ moral reasons in cases of collective action. Following Anthony Downs’s classic economic analysis of democracy, it has been widely noted that most voters lack the incentive to be well-informed. Recent empirical work, however, suggests further that political partisans can display selectively lazy or biased reasoning. Unfortunately, political knowledge seems to exacerbate, rather than mitigate, these tendencies. In this paper, I build on these observations to construct a more general skeptical challenge which affects what I call creedal beliefs. Such beliefs share three features: (i) the costs to the (...) individual of being wrong are negligible, (ii) the beliefs are subject to social scrutiny, and (iii) the evidential landscape relevant to the beliefs is sufficiently complex so as to make easy verification difficult. Some philosophers and social scientists have recently argued that under such conditions, beliefs are likely to play a signaling, as opposed to a navigational role, and that our ability to hold beliefs in this way is adaptive. However, if this is right, I argue there is at least a partial debunker for such beliefs. Moreover, this offers, I suggest, one way to develop the skeptical challenge based on etiological explanation that John Stuart Mill presents in On Liberty when he claims that the same causes which lead someone to be a devout Christian in London would have made them a Confucian in Peking. Finally, I contend that this skeptical challenge is appropriately circumscribed so that it does not over-extend in an implausible way. (shrink)

In this article I aim to provide the first normative discussion of barter voting markets, namely markets which allow the trading of votes on issues/elections for votes on other issues/elections. The article is framed within the wider literature on the legal permissibility of vote buying, with a particular focus on the recent debate between Christopher Freiman and James Stacey Taylor. I argue that while Taylor's objections successfully defeat Freiman's case in favour of standard voting markets, they are unable to also (...) defeat the type of voting markets outlined here. Furthermore, I argue that there are at least two plausible prima facie reasons in favour of barter voting markets, grounded in their capacity to contribute to the alleviation of injustice for systematically disadvantaged socio‐economic groups and to their capacity to reduce one form of bad voting, i.e. voting from ignorance. This article investigates reasons to participate in non-deterministic elections, where the outcomes incorporate elements of chance beyond mere tie-breaking. The background context situates this inquiry within democratic theory, specifically non-deterministic voting systems, which promise to re-evaluate fairness and power distribution among voting blocs. This study aims to explore the normative implications of such electoral systems and their impact on our moral duty to vote. We analyze instrumental reasons for voting, including prudential and act-consequentialist arguments, alongside non-instrumental reasons, assessing their validity (...) in the context of non-deterministic systems. The results indicate that non-deterministic elections could strengthen the case for voting based on prudential and act-consequentialist grounds due to their proportional nature and the increased influence of each vote. We conclude that, while non-deterministic elections strengthen our duty to vote overall, they do not strengthen it for all the arguments in the literature. This paper contributes to the discourse on electoral systems by critically evaluating the moral obligation to vote in non-deterministic elections. (shrink)

Proponents of the duty to vote (DTV) argue that in normal circumstances, citizens have the moral duty to vote in political elections. Discussions about DTV analyze _what_ the duty is, _who_ has this duty, _when_ they have it, and _why_ they have it. Missing are answers to the Specification Question: to _which_ elections does DTV apply? A dilemma arises for some supporters of DTV—in this paper, I focus on Julia Maskivker’s work—because either answer is problematic. First, I argue that it (...) is implausible that DTV applies to _all_ elections because this makes the duty too costly for the voter. Second, I argue that there are no good reasons why under normal circumstances DTV applies only to _some_ elections. I consider objections but conclude that the dilemma is successful and therefore the case for DTV is incomplete. (shrink)

What is wrong with participating in a democratic decision-making process, and then doing something other than the outcome of the decision? It is often thought that collective decision-making entails being prima facie bound to the outcome of that decision, although little analysis has been done on why that is the case. Conventional perspectives are inadequate to explain its wrongness. I offer a new and more robust analysis on the nature of voting: voting when you will accept the outcome only if (...) the decision goes your way is an act of bad faith: you are not taking part in a ‘process that decides what we will do’. This analysis sheds light on understanding the intrinsic nature of voting and what we are doing when we make decisions collectively. (shrink)

Many of our large-scale problems that arise only recently in human history and in an industrialized global world present us with a unique challenge. Often while people collectively make a difference, individual actions are inconsequential. Consider climate change. We all collectively contribute to its unwanted consequences. But individual actions are inconsequential: One more or one less person taking a joyride in a gas-guzzler on a Sunday afternoon makes no difference regarding these consequences. Donating to charity, voting, buying fair trade products, (...) factory farming, and environmental pollution all present the same challenge. One more or one less vote doesn’t make a difference. But then it’s unclear why individuals should act against climate change or vote. This is the so-called problem of inconsequentialism. In this paper, I present a new solution to this problem by appealing to a type of action that is yet to receive philosophical attention—i.e., taking a stand. ABSTRACTReceived wisdom in most democracies is that voting should be seen as a political freedom that citizens have a right to exercise at their discretion. But I propose that we have a duty to vote, albeit a duty to vote well: with knowledge and a sense of impartiality. Fulfillment of this obligation would contribute to the epistemic advantages of democracy, and would thereby instantiate the duty to promote and support just institutions.

Jason Brennan argues that people are morally obligated not to vote badly, where voting badly is voting “without sufficient reason” for harmful or unjust policies or candidates. His argument is: (1) One has an obligation not to engage in collectively harmful activities when refraining from such activities does not impose significant personal costs. (2) Voting badly is to engage in a collectively harmful activity, while abstaining imposes low personal costs. (3) Therefore, one should not vote badly. This paper shows that (...) Brennan never adequately clarifies (1) and that, on every plausible clarification, (2) is false. (shrink)

Mill advocates plural voting on instrumentalist grounds: the more competent are to have more votes. At the same time, he regards it as a ‘personal injustice’ to withhold from anyone ‘the ordinary privilege of having his voice reckoned in the disposal of affairs in which he has the same interest as other people’ (Mill 1861a, p. 469). But if electoral voice is justified by its contribution to good governance, why would it be an injustice to deny the vote to those (...) whose use of it would disserve this end? I propose the dual justification view to resolve this tension. Mill holds that electoral voice is to be justified in two complementary ways: both as communicating a person’s interests and perspective in order that they be accommodated in policy deliberations, and as advancing a vision of the common good and influencing the policy of the legislature. Opponents of compulsory voting often allege that it violates a ‘right not to vote’. This paper seeks to clarify and defend such a right against its critics. First, I propose that this right must be understood as a Hohfeldian claim against being compelled to vote, rather than as a mere privilege to abstain. So construed, the right not to vote is compatible with a duty to vote, so arguments for a duty to vote do not refute the existence of such (...) a right. The right against compulsion is most easily defended within a liberal framework, hence its critics often appeal instead to a republican conception of freedom. In the latter part of the paper, I argue that even these republican arguments are inconclusive. Even non-dominating interference still conditions freedom, which may require justification. Further, citizens can live up to republican ideals, so long as they are vigilant; they need not actually vote. Thus, republican arguments fail to refute a right not to vote. (shrink)

I argue that democratic citizens have a duty to educate themselves politically. My argument proceeds in two stages. First, I establish a case for the moral importance of individual competence for voting, but also maintain that the substantial content of the required competence must remain open. I do this by way of an assessment of Jason Brennan's provocative defense of epistocracy. I try to show that there is no notion of political competence that can meet with reasonable agreement among citizens (...) and that voter qualification exams are therefore illegitimate. Second, I maintain that the basic premise of Brennan's argument, the right to a competent electorate, is valid and that it corresponds to an individual duty to educate oneself politically. This duty is, in Kant's terminology, a wide and imperfect duty that we owe to our fellow democratic citizens. Yet since the content of competence must be left open, this moral duty cannot be transformed into a legal obligation. (shrink)

Kristian Skagen Ekeli has argued that politically ignorant citizens have a duty to abstain from voting. He argues that such a duty fol- lows from Kant’s duty to respect other persons. I analyze Ekeli’s proposed duties by considering how they might fit into Kant’s system of duties. I conclude, contra Ekeli, that the Kantian duty to (...) respect persons does not give rise to a duty for politically ignorant voters to abstain from voting. -/- Denne artikkelen er et bidrag til debatten om velgeres moralske ansvar. In this article Jason Brennan’s arguments about the moral duties relating to our practice of voting are examined. These arguments provide an epistocratic approach of politics and present a conception of abstention at four levels: abstention as a personal choice, as a moral responsibility, as a duty legally enforceable and as an obligation decided by lot. The contrast with John Stuart Mill’s positions helps to highlight the postdemocratic ambivalences and the latent paternalism behind Brennan’s rejection of massive voting and electoral (...) democracy. A deliberative, Millian-inspired understanding of abstention also allows questioning the assumption in Brennan’s successive proposals that there is no significant loss in overlooking the political valence of qualified abstention. In response to widespread voter ignorance, Jason Brennan argues for a voting ethics that can be summarized as one negative duty: do not vote badly. The implication that abstaining is always permissible entails no incentive for citizens to become competent voters or to vote once competent. Following the Condorcet Jury Theorem, this can lead to suboptimal outcomes, suggesting that voter turnout should concern instrumentalist epistemic accounts of democratic legitimacy. This could be addressed by adding two positive voting duties: to make (...) an effort to become a competent voter; and, once competent, to vote. (shrink)

Adam Gibbons (2022) holds, in response to my recent paper on epistocracy (Méndez 2022), that the severity of what I identify as a very relevant epistemic problem for epistocracy is overstated. What I call the Information Gap Problem refers to the gap of information that an elite electorate of well-informed citizens would experience, with regards to what epistocrats call ‘ill-informed’ lay citizens’ preferences. In that paper, I claimed that a group of highly qualified people could be better at determining the (...) content of policies to foster general goals, but that this does not mean they could also be able to identify the best forms for those policies to be implemented. The form is what I connect to the lived experiences of lay citizens, and an epistocratic arrangement— which equals to distribute political power in accordance with political competence—would exclude the preferred forms of implementation of the ill-informed citizens. That information would thus be out of reach for an elite electorate, and persisting socio economic differences would reduce the overlap between the preferences of the elite and the preferences of illinformed citizens. According to Gibbons, it is not clear why such information is so important. Additionally, Gibbons states that the Information Gap Problem would be less of a threat, and even no threat at all, to some types of epistocracy. Finally, from Gibbons’s perspective, there are other more pressing issues for epistocracies that are not properly addressed in my paper, such as the difficulties of assessing political competence, and the risks of abuse in epistocratic arrangements. Here I will argue that the importance of including preferences from lay citizens comes back to the goal of the epistocratic project, namely, to improve the outcomes of our democracies for everyone. As I state in the paper, lay citizen’s lived experiences are crucial to do so. Relatedly, I will show that all forms of epistocracy are in some way exclusionary, since they do involve restricting the electorate, be it directly or indirectly, which means that no matter the type, they would all be susceptible to the Information Gap Problem. As well, I will briefly address the final objection regarding competence by showing that Gibbons’s worries regarding competence are present and developed in my paper. (shrink)

This thesis explores the relationship between the capability approach to justice and liberal philosophy. I argue that the most compelling articulation of the capability approach—one given by Martha Nussbaum—suffers from an unattractive kind of inconsistency. On the one hand, Nussbaum is committed to formulating a robust account of a dignified human life which can give rise to a range of individual entitlements which ought to be guaranteed to all individuals. On the other hand, Nussbaum is committed to political liberalism which (...) requires state institutions to uphold strict neutrality between a variety of reasonable conceptions of the good. Nussbaum’s first commitment results in the formulation of a list of ten central human capabilities. However, I argue that the content and justification of this list cannot be successfully established in a way that is consistent with Nussbaum’s second commitment. Therefore, in this thesis, I propose a novel capability approach: a two-step approach which consists of two principles arranged in lexical priority. First, governments have a moral obligation to secure individuals with a meta-capability of autonomy. That is to say, governments must provide the conditions which are conducive to individuals exercising a range of agentic competencies which are constitutive of autonomous judgement. Second, governments have a moral obligation to provide opportunities for individuals to exercise this meta-capability in six domains of well-being: health, politics, knowledge, relationships, self-expression, and work. I argue that exercising autonomous choice in the pursuit of welfare is necessary for a good life, regardless of the specific choices individuals eventually make, and even if they choose to forgo some supposedly valuable choices altogether. My proposal has two striking features which set it apart from other articulations of the capability approach. First, my proposal is comprehensive in that it relies on a particular view about what is a valuable way of life. In my view, a way of life is valuable if it is pursued autonomously, that is to say, if it involves an individual exercising a set of agentic competencies and standing in appropriate relations with other people. And second, by virtue of being based in this particular comprehensive claim, my account of justice is anti-perfectionist. That is to say, my proposal does not aim to compel people to make valuable choices. Rather, it aims to equip people with the means to live the kind of life they find valuable and worth living. I then apply this capability approach to the domain of education, and I argue it can be useful in formulating an ambitious and transformative approach to education. In particular, I develop a program of civic education aimed at responding to the problems associated with disinformation and ‘post-truth’ trends in politics. (shrink)

Being autonomous depends on the kind of relations we enjoy in the different domains of our lives, but the impact of decision-making and the power exercise that takes place in the political sphere, makes political relations crucial to our development and enjoyment of autonomy. This dissertation develops a novel view of political participation by interrogating its connection to our personal autonomy. According to this view, our political relations are partially constitutive of our personal autonomy, which in other words means there (...) is a political aspect of our autonomy. The kind of political relations we should hold to fully enjoy our autonomy is what I call Relations of Mutual Recognition. It is the mutual recognition of each agent’s autonomous standing—translated into a proper distribution of political power— that will face dominating political relations. The basis for that domination comes from our democracies’ power imbalances that condition influence over political decision-making to each individual’s economic, social or cultural standing. Consequently, there are political conditions for our autonomy to thrive. Relations of Mutual Recognition require two main conditions: non-domination and control. I take these two neo-republican ideals and redefine them to shape what a proper distribution of political power amounts to. Political participation comes in precisely to identify a way to challenge power imbalances. Therefore, my definition of political participation, which I call Collective Self-Government, requires a particular sort of implementation. Accordingly, I suggest a deliberative and inclusive arrangement that involves direct and innovative forms of decision-making, and more importantly, grants relevant shares of authority to all actors, i.e., common citizens, legislators, technocrats, etcetera. This project could rightly belong to both a relational approach to autonomy and be labelled as a version of deliberative democracy. However, relational accounts focus on our social relations, whilst I claim that we cannot be “less” or non-autonomous in the political sphere and still enjoy an autonomous life. Likewise, the participatory focus—in the sense of inclusion of all actors—of this proposal more accurately turn it into either a participatory version of deliberative democracy or a deliberative version of participatory democracy.
