Many states recognize a legal right to bodily integrity, understood as a right against significant, nonconsensual interference with one’s body. Recently, some have called for the recognition of an analogous legal right to mental integrity: a right against significant, nonconsensual interference with one’s mind. In this chapter, we describe and distinguish three different rationales for recognizing such a right. The first appeals to case-based intuitions to establish a distinctive duty not to interfere with others’ minds; the second holds that, if (...) we accept a legal right to bodily integrity, then we must, on pain of philosophical inconsistency, accept a case for an analogous right over the mind; and the third holds that recent technological developments create a need for a legal right to mental integrity. We propose a novel account of the distinction between innate and acquired biological traits: biological traits are innate to the degree that they are caused by factors intrinsic to the organism at the time of its origin; they are acquired to the degree that they are caused by factors extrinsic to the organism. This account borrows from recent work on causation in order to make rigorous the notion of quantitative contributions to traits by different factors in development. We avoid the (...) pitfalls of previous accounts and argue that the distinction between innate and acquired traits is scientifically useful. We therefore address not only previous accounts of innateness but also skeptics about any account. What role should sentient animals play in the current debate on enhancement? The question covers several different philosophical fronts that demand urgent global ethical analysis. This touches issues that go from prohibition, permissivity or obligation that should characterize the new biotechnologies oriented to the enhancement of individuals, to the debate surrounding the moral rights of animals. Furthermore, the difficulty arises not only from the controversial moral categories involved, but also from the very extent of the objective proposed. However, this also (...) gives rise to the pertinence of the above-mentioned question posed at the outset: on the one hand, the need for consistency in an eminently biased debate, and on the other the need to justify the proposal in which all sentient individuals are legitimate protagonists without this necessarily leading to implausible scenarios. In this essay, we argue against radical ethical views about human enhancement that either dismiss or endorse it tout court. Instead, we advocate the moderate stance that issues of enhancement should be examined with an open mind and on a case-by-case basis. To make this view plausible, we offer three reasons. The first lies in the fact that it is difficult to delineate enhancement conceptually, which makes it hard to argue for general ethical conclusions about it. The second is that (...) an appropriate view of the edifice of moral theory suggests that tenable moral judgements about human enhancement are the result of a careful consideration of the pros and cons that attach to the use of a specific enhancement technology. Lastly, we show that important normative factors in the enhancement debate can be used both in arguments for and in arguments against enhancement. The bottom line of our discussion is that we should treat issues of human enhancement like we do any other ethical issue, viz. by weighing up the reasons pro and con. (shrink)

What people are realistically able to do and be in their lives, their capabilities, are of central moral importance according to the capability approach of Amartya Sen and Martha Nussbaum. Examples are the capabilities to be healthy or to be part of a community. The CA has become an influential normative framework for reflecting on justice, equality, well-being and development. In the past decades it has been successfully applied to areas such as education and health care. Only quite recently have (...) scholars started to use the CA to reflect on technology, for example on the contribution of ICT to development in the Global South. Much of this work is empirical. This dissertation contributes to the theoretical foundations for future empirical and ethical work by providing a philosophical exploration of how the CA can be brought to bear on technology. It discusses the applicability and added value of the CA for the design of technical artifacts, for the evaluation of technological development projects, and for the assessment of technology from the perspective of the good life. One main question addressed in this dissertation is which technology theories and design approaches could fruitfully supplement the CA, in order to ‘operationalize’ it in this new area. For this purpose participatory design, value sensitive design, the use plan account of technical artifacts, inclusive/universal design, actor-network theory, appropriate technology, pluralist theories of technology and the system/network view of technology are discussed. Another guiding question is what the exact nature is of human capabilities as discussed in the CA, and technology in the sense of technical artifacts, and how we can then conceptualize the relation between them. It is argued that we need to regularly move back and forth between ‘zooming in’ and ‘zooming out’. The former allows us to see the details of design of technical artifacts, the latter how exactly technical artifacts are embedded in broader socio-technical networks. Going beyond the biological and physiological limitations imposed on us by the human body is something which the human race has strived to do throughout its history. There is something about our human nature that compels us to strive for improvement and enhancement in our physical and mental performance, and to stretch ever further the boundaries of human accomplishment. Nowhere can a stronger desire for enhanced performance be found than in the realm of competitive sport and, it is certainly arguable (...) that, there are very few sports that can rival the competitiveness, endurance and physical exertion involved in the sport of boxing. Transhumanism is borne of this desire for continuous improvement and the refusal to resign ourselves to the restrictions placed on us by our natural biological constitution and environment, enhancing human capabilities and capacities by way of new and emergent technologies. With regard to sport, transhumanism could provide us with the ability to train longer, run, swim or cycle faster, jump higher, throw further and, in the case of boxing, punch harder. However, it is not restricted or confined to the enhancement of our physical powers, but could equally-well serve to improve our psychological capacities and alter the way in which we perceive and experience the world. In this way transhumanism could be employed to change the content of experience. (shrink)

Enormous resources are being invested in genetics, neuroscience and nanotechnology in search vital processes that might provide effective treatment for genetic and severe degenerative disorders, but these goals are still distant. Institutional and military resources are being poured into biotechnological developments for behavioral intervention and cognitive and moral enhancement for persons with difficulties as well as for healthy individuals. Enhancement will increase health and empowerment inequities to the detriment of the disadvantaged. Marked inequality in Latin America calls for an urgent (...) focus on the compromised values at play in biotechnological interventions that will be unavailable to those in need. (shrink)

Probablemente la mayor responsabilidad actual de la ética aplicada es hacerse cargo de las grandes dificultades teórico-prácticas generadas con el incipiente desarrollo de las nuevas tecnologías de biomejora. Dificultades más allá de las preferencias individuales, viéndose involucradas cuestiones en torno a nuestra comprensión de la justicia distributiva. La identificación de dos hechos importantes nos da la clave para orientar el debate. Por un lado, las situaciones de partida tan arbitrarias que proporciona la lotería natual con relación a las oportunidades de (...) bienestar individual. Por otro, la posibilidad de realizar una mejora cognitiva, de aquellos más desafortunados en su configuración genética, que incidirá en la amplificación de tales oportunidades. (shrink)

En un mundo en el que las guerras provocan éxodos masivos de seres humanos, los cuales huyen de la misera, la pobreza y la muerte encontrando en el camino el rechazo, no solo de los ciudadanos sino también de las instituciones de los países, supuestamente civilizados, a lo que llegan en busca de algún futuro, es (...) necesaria la búsqueda de la compasión, la simpatía y la educación profunda en el respeto hacia la dignidad de las personas.
