    Since the publication of Between Facts and Norms, Habermas’s concept of communicative power has been the topic of significant discussion. This article contributes to this conversation by examining Habermas’s account of what makes communication powerful. I argue that Habermas’s conception of communicative power describes a nonviolent and noninstrumental mode of acting and being with others in language.     In this article I show how the concept of intertextuality as developed by Mikhail Bakhtin, Julia Kristeva and Jacques Derrida can be applied to the political theory of constitutionalism. Such an approach carries with it the valuable democratic idea that all texts in society, including the political constitution, are in a dynamic relationship and reflect social pluralism.     The article shows that Habermas’s modernism and Lyotard’s postmodernism are not as antithetical as they are often taken to be. First, we argue that Habermas is not a strong foundationalist concerned with identifying universal rules for language, as postmodern critiques have often interpreted him.
