  1. (1 other version)Mind-Independent Values Don’t Exist, But Moral Truth Does.Maarten Van Doorn - 2017 - Essays in the Philosophy of Humanism ; Vol 25, No 1 25 (1):5-24.
The falsity of moral claims is commonly deduced from two tenets: that they presuppose the existence of objective values and that these values don’t exist. Hence, the error theory concludes, moral claims are false. In this article, I put pressure on the image of human morality that is presupposed in moving from the non-existence of objective values to the falsity of moral claims. I argue that, while, understood in a certain way, the two premises of the error theory are correct, (...)

  • Stout, Rawls, and the Idea of Public Reason.Phil Ryan - 2014 - Journal of Religious Ethics 42 (3):540-562.
Jeffrey Stout claims that John Rawls's idea of public reason (IPR) has contributed to a Christian backlash against liberalism. This essay argues that those whom Stout calls “antiliberal traditionalists” have misunderstood Rawls in important ways, and goes on to consider Stout's own critiques of the IPR. While Rawls's idea is often interpreted as a blanket prohibition on religious reasoning outside church and home, the essay will show that the very viability of the IPR depends upon a rich culture of deliberation (...)

  • Logic or rhetoric in law?Alain Lempereur - 1991 - Argumentation 5 (3):283-297.
One of the most crucial questions in the philosophy of law deals with the very nature of legal reasoning. Does this reasoning belong to logic or to rhetoric? This debate, increasingly centered on rhetoric, is not merely a question of language use; it covers and indicates a more basic choice between formal legalism — focusing on rational deduction from the law — and pragmatic judiciarism — focusing on reasonable debate in the court.Today, it is necessary to circumscribe the respective fields (...)

This work studies the issue of political representation from the perspective of a specific legal culture, the exercise of political rights in the context of the occidental democratic system, a concept that has undergone a profound evolution to the present day. The essential aspects for an analysis of this progression are voting, decision making, and the relationship between representatives and their constituents. Overall, the phenomena making up the crisis of representation have been explained as a result of changes that have (...)

  • The Closing of the Civic Mind: Marcel Gauchet on the `Society of Individuals'.Antoon Braeckman - 2008 - Thesis Eleven 94 (1):29-48.
According to Gauchet we are living in a `society of individuals'. But a central term is missing from that formula, and not by any accident, for contemporary society has lost it from view: the term of the political. In sum, thus reads Gauchet's diagnosis, society today is haunted by a kind of individualism out of which no society can be conceived, as it obfuscates its political dimension. The aim of this article is to elaborate this diagnosis, and more specifically the (...)
