In recent years, children and young people (CYP) have been increasingly included in patient and public involvement (PPI) in health research and innovation. Such initiatives intend to give a voice to CYP in such matters. Given that it is debated whether PPI in health care fosters the values of participation, public discussion and decision making put forward by deliberative democracy, this article examines three sets of challenges concerning the involvement of CYP by focusing on age biases. After describing some existing (...) initiatives, the paper critically examines why CYP are involved, how the CYP group is constituted and then investigates the moral status of CYP in biomedical settings. It shows that the rationale for involving CYP in PPI is mainly top-down and adult-centric, thereby questioning the authentic participation in decision making. It also suggests that to ensure democratic inclusion, the CYP group should be constituted by considering both age and politics. Lastly, the article indicates that, despite the increasing recognition of child-specific rights, the sociocultural norms and power dynamics in pediatrics undermine their moral status and challenge political equality. These three sets of considerations offer a preliminary theoretical contribution toward improving democratic legitimacy and representation of CYP in health research and innovation. (shrink)

ABSTRACT In this article I will be discussing what altruism is, distinguishing altruistic motivations and altruistic behaviour. Pure altruism is when the motivation to benefit another is exclusively to increase the other's welfare, and impure altruism is when the motivation to benefit another is solely to increase your own wellbeing, or includes on some level, increasing your own welfare. Soft altruism is helping behaviour and robust altruism is improving the welfare of another individual at the expense of the altruist. Having (...) made these distinctions I move on to show that altruism is a requirement of morality. I argue that the three main principles of morality are not only compatible with, but also recommend soft altruism. Finally I argue that the probability of people continuing to practise altruistic acts is higher when we are purely motivated, and if that is the case not only classic moral enhancement but also biotechnological moral enhancement can have a role in bringing people over to the altruistic side, stimulating their ‘other regarding ’ motivations, thus contributing to spreading altruistic behaviour and morality throughout the world. RESUMO Neste artigo, discutirei o que é altruísmo, distinguindo motivações altruístas e comportamento altruísta. Puro altruísmo é quando a motivação para beneficiar outra pessoa é exclusivamente aumentar o bem-estar do outro, e altruísmo impuro é quando a motivação para beneficiar outra pessoa é somente aumentar o seu próprio bem-estar, ou inclui este aumento do bem-estar próprio. Soft altruísmo é simplesmente ajudar o outro, enquanto altruísmo robusto épromover a melhoria do bem-estar de outro indivíduo ao custo do seu próprio bem-estar. Tendo feito essas distinções, mostro que o altruísmo é uma exigência da moralidade. Argumento aqui que os três principais princípios da moralidade são não apenas compatíveis com soft altruísmo mas também o recomendam. Finalmente, argumento que a probabilidade de as pessoas continuarem praticando atos altruístas é maior quando somos puramente motivados, e, se este é o caso, não apenas o aprimoramento moral clássico, mas também o aprimoramento moral biotecnológico pode cumprir o papel de trazer pessoas para o lado do altruísmo, estimulando suas motivações “other regarding” e assim contribuindo para difundir o comportamento altruísta e a moralidade pelo mundo. One approach to defining enhancement is in the form of bodily or mental changes that tend to improve a person’s well-being. Such a “welfarist account”, however, seems to conflict with moral enhancement: consider an intervention that improves someone’s moral motives but which ultimately diminishes their well-being. According to the welfarist account, this would not be an instance of enhancement—in fact, as I argue, it would count as a disability. This seems to pose a serious limitation for the account. Here, I (...) elaborate on this limitation and argue that, despite it, there is a crucial role for such a welfarist account to play in our practical deliberations about moral enhancement. I do this by exploring four scenarios where a person’s motives are improved at the cost of their well-being. A framework emerges from these scenarios which can clarify disagreements about moral enhancement and help sharpen arguments for and against it. (shrink)

Recent discussions about moral enhancement presuppose and recommend sets of values that relate to both the Western tradition of moral philosophy and contemporary empirical results of natural and social sciences, including moral psychology. It is argued here that this is a typology of thought that requires a fundamental interrogation. Proponents of moral enhancement do not account for important critical analyses of moral discourse, beginning with that of Friedrich Nietzsche and continuing with more prominent twentieth century thinkers such as the poststructuralist (...) Michel Foucault, the deconstructionist Jacques Derrida, and the moral philosopher Alasdair MacIntyre. In this paper, such analyses are taken into account to highlight the need for more fundamental philosophical interrogation of the project of moral enhancement. (shrink)

El objeto de este análisis es examinar —naturalmente, de un modo introductorio— cuál puede ser la repercusión de los eventuales avances en los objetivos transhumanistas en el terreno de la responsabilidad criminal. A mi juicio, el análisis de las posibles consecuencias del transhumanismo en el dominio del Derecho penal afecta a dos ámbitos distintos: (i) en primer lugar, puede incidir en los factores que, hoy en día, vertebran la imputación de responsabilidad penal; (ii) por otro lado, es preciso abordar la (...) repercusión que el transhumanismo podría tener ya no en el juicio de imputación de responsabilidad penal, sino en la determinación de las consecuencias asignadas a los responsables penales y en su proceso de ejecución. As neuroscience progresses, we will not only gain a better understanding of how our brains work, but also a better understanding of how to modify them, and as a result, our mental states. An important question we are faced with is whether the state could be justified in implementing such methods on criminal offenders, without their consent, for the purposes of rehabilitation and reduction of recidivism; a practice that is already legal in some jurisdictions. By focusing on a prominent type (...) of view of free action, which I call bypassing views, this paper evaluates how such interventions may negatively impact the freedom of their subjects. The paper concludes that there will be a tension between the goals of rehabilitation and reduction of recidivism, on the one hand, and the negative impact such interventions may have on free action, on the other. Other things equal, the better that a particular intervention is at achieving the former, the more likely it is to result in the latter. (shrink)
