Most theories of promising are insufficiently broad, for they ground promissory obligation in some external or contingent feature of the promise. In this paper, I introduce a new kind of theory. The Mental States First (MSF) theory grounds promissory obligation in something internal and essential: the mental state expressed by promising, or the state that promisors purport to be in. My defense of MSF relies on three claims. First, promising to Φ expresses that you have resolved to Φ. Second, resolving (...) to Φ commits you to Φing, all else being equal. Third, the norms on speech acts are determined by the norms on the mental states they express, such that publicly expressing that you are in a state subjects you to whatever commitments are normally incurred by being in that state, regardless of whether you really are in it. I suggest that this general approach might also explain how the norms on other sorts of speech acts work. (shrink)

It appears at least intuitively appropriate to claim that we owe it to victims to punish those who have wronged them. It also seems plausible to state that we owe it to society to punish those who have violated its norms. However, do we also owe punishment to perpetrators themselves? In other words, do those who commit crimes have a moral right to be punished? This work examines the sustainability of the right to be punished from the standpoint of the (...) two main theories of rights—the will and the interest conceptions. The right to be punished is shown to be largely indefensible on both accounts: on the will theory, the right to be punished conflicts with autonomy, and it can neither be claimed nor waived by a perpetrator; on the interest theory, a perpetrator’s interest in punishment, inasmuch as it exists, is not sufficient to ground a duty on the part of the state. I Can we make promises to ourselves? This is a question that has not received much consideration in the large body of philosophical work on promising. And in what commentary there is, the answer is uniformly negative. I think this negativity is a mistake, and that the conventional view that we can't make reflexive promises is wrong. I also think that this has some important implications for promissory theory in general. Em Uma Teoria da Justiça, John Rawls explicou o intuicionismo como a doutrina que professa o pluralismo irredutível de princípios morais, princípios estes cujos conflitos não poderiam ser resolvidos de maneira principiológica. Segundo Rawls, não se pode oferecer um argumento abstrato que prove que o pluralismo moral é falso. Mas seria possível mostrarmos aquilo que o intuicionista nega existir: o princípio moral mais fundamental, que sistematiza nossas obrigações morais. Este princípio, de acordo com Rawls, seria o princípio da equidade. Neste (...) artigo, eu argumento que Rawls fracassa diante dos intuicionistas. Meus argumentos se valem de uma análise da aplicabilidade do princípio da equidade ao caso das promessas. Primeiro, eu defendo que o princípio da equidade só poderia explicar obrigações morais em geral se ele pudesse conter em sua fórmula um caso paradigmático das obrigações que ele pretende explicar: justamente as obrigações promissórias. Depois, eu procuro mostrar que as mesmas obrigações promissórias contêm um traço essencial que o princípio da equidade não seria capaz de explicar, mesmo que pudesse explicar obrigações morais em geral: o caráter especial das obrigações para com os destinatários das promessas. No primeiro ponto, a minha investigação expande as críticas de Robert Nozick a uma versão do princípio da equidade apresentada por H.L.A. Hart. No segundo, eu desenvolvo objeções feitas por Stephen Darwall contra a teoria prática das promessas, incluindo a teoria de John Rawls. (shrink)

Promising ourselves is familiar, yet some find it philosophically troubling. Though most of us take the promises we make ourselves seriously, it can seem mysterious how a promise made only to oneself could genuinely bind. Moreover, the desire to be bound by a promise to oneself may seem to expose an unflattering lack of trust in oneself. In this paper I aim to vindicate self-promising from these broadly skeptical concerns. Borrowing Nietzsche’s idea of a memory of the will, I suggest (...) that self-promising involves an activity of the will, aimed at the preservation and protection of one’s values. I explain how, understood in this way, these promises can indeed bind, and show that the motivation for making them need not involve mistrust or other alienated attitudes. I then turn to interpersonal promising, arguing that this same activity of the will is required for sincerely promising others: in effect, making a sincere promise to another requires making a promise to oneself. Attention to this under-appreciated aspect of interpersonal promising enriches our understanding of all promises, and helps to correct a narrow and distorted picture of what it means to be bound. This paper argues for two models of agreement which develop the idea that there is an agreement where one party gives a conditional undertaking and the other responds with an unconditional undertaking. The models accommodate plausible justifications for making and complying with agreements.
