The problem of political action has its roots, arguably, in the sixth book of the Nicomachean Ethics, where Aristotle seeks to describe an intellectual virtue – phronêsis – that is different from the faculty of theoretical reason but that is nonetheless capable of producing genuinely objective, rational knowledge, i.e., knowledge of what is true. The problem, specifically, is to understand how such a thing is possible, and much of the recent literature appears to suggest that perhaps it’s not. Since rhetoric, (...) persuasion, interest and emotion are obviously central features of political life, it may seem that some kind of non-intellectualist and non-rationalist perspective must be the way to go. I argue, nonetheless, that any such account is, and cannot but be, deeply problematic; and I defend, by way of contrast, a decidedly intellectualistic understanding of political enterprise. (shrink)

In this article I argue that Jürgen Habermas’ notion of morality (moral norms) has more in common with Hegel’s notion of ‘ethical life’ as a ‘ sittlich ’ relation – understood as a socially integrative force – rather than Kant’s supreme principle of personal morality. I show that Habermas and Hegel, each in his own way, make a distinction between morality and ethics. However, I make the case that Habermas’ conception of ‘morality’ incorporates aspects of Hegel’s notion of ‘ethical life’, (...) while Habermas’ conception of ‘ethical’ – referring to individual and group conceptions of the good life – is a remedy to the shortcomings in Hegel’s overly unified ethical life. I offer an alternative reading of Habermas’ principle of morality, which I suggest should be read as his attempt to provide a binding process to set up the norms that ought to condition a modern political community understood as a civil association. Conceptul de dreptate socială este unul dintre cele mai controversate concepte ale filosofiei politice. Foarte puține aspecte legate de acest concept nu sunt înconjurate de controverse și dezbateri argumentative. Unele dintre cele mai importante astfel de controverse sunt cele legate de definirea, de specificarea și de legitimitatea lui. Prima este, în esență, o controversă în privința răspunsului la următoarea întrebare: care este conceptul care surprinde cel mai bine trăsătura fundamentală a dreptății și nedreptății sociale? A doua este o controversă în (...) privința exigențelor sau a principiilor „corecte” ale dreptății sociale. În sfărșit, a treia este o controversă pe marginea acceptabilității conceptului de dreptate socială. În studiul de față prezint pe scurt principalele idei, poziții și argumente invocate de filosofii politici recenți în cadrul fiecăreia dintre aceste controverse. (shrink)

This article addresses the issue of future cosmopolitanism, building on a minimal reconstruction of what cosmopolitanism has been in the past. It will elucidate the notion of ‘political’ cosmopolitanism in its relation to a certain methodological option which is designated by the shorthand term ‘judgment’. Cosmopolitanism is not a new idea but a new version of it is constituted by ‘political’ cosmopolitanism, bound up with a judgmentbased, as opposed to principle-based, understanding of normativity.

El paradigma del Juicio constituye un modelo de racionalidad que pretende elevarse como alternativa positiva ante los retos coyunturales introducidos por el giro lingüístico de la filosofía en el pensamiento contemporáneo. Frente a la difícil tarea de defender principios universalistas en la cultura actual, este modelo aspira a pronunciarse positivamente sobre cuestiones tales como la de la validez normativa que pueda afectar las relaciones entre acción humana y deliberación. Para alcanzar su objetivo, el paradigma del Juicio patrocina una forma de (...) la normatividad sin principios (validez ejemplar), enraizada en el juicio reflexionante kantiano y en el sensus communis (sentido común) de la tradición retórico-humanista. El objetivo de este artículo es la presentación de dicho modelo de racionalidad dentro de la filosofía kantiana y, por medio de la exploración de sus antecedentes histórico-filosóficos (Gadamer), y gracias a un rodeo por la tradición retórico-humanista (Aristóteles y Vico), se busca soslayar el énfasis estético que la fundamentación de Kant acentuó. Finalmente, se pondera el alcance y pertinencia que posee dicho paradigma en la reapropiación de dos de sus intérpretes en la filosofía contemporánea: Alessandro Ferrara y Hannah Arendt. (shrink)

The renewed interest on political realism can offer a new reading of the traditional dichotomy between normative and realist conception of constitutionalism. The purpose of this article is to analyse this renewed discussion, especially by focusing on the relationship between “political realism” and “political constitutionalism,” in the light of some theorists and authors—such as Richard Bellamy and Jeremy Waldron. After a brief introduction in which political realism will be discussed, especially through Bernard Williams’ reinterpretation, the article proposes a rereading of (...) democratic constitutionalism from the classical dichotomy between normativism and realism in political theory. The focus will be set on three key issues: 1. Richard Bellamy’s constitutional theory in a realist perspective; 2. An insight of legal constitutionalism under a normative banner; 3. A brief conclusion in which the risks of a majoritarian and populist constitutionalism will be discussed. (shrink)

Kant proposes a unique and necessary presupposition of our faculty of judgment. Empirical nature, together with its diverse laws, must be judged as if it were a coherent unity. In a teleological judgment, we add that nature must be judged as if it were purposively designed for our faculty of judgment. In this article, I argue that Kant's insights on reflective teleological judgment - the least commentedupon element of the Critical philosophy - are adopted by Dworkin towards a philosophy of (...) law and adjudication. I claim Dworkin's concept of ‘integrity’ strictly, but tacitly, partakes of the structure of Kant's teleological judgment in its presumption of systematicity in juridical laws and unity of community which designs and abides its own principles. Throughout, I draw on Gilles Deleuze - a philosopher who complains of being ‘against judgment’ and wishes ‘to have done with judgment’ - to critique both the presuppositions and effects of such teleological judgment and the image of law it proposes. Using Deleuze I hope to characterize and criticize the teleological theory of judgment and also fruitfully engage Deleuze with problems of law scarcely addressed either by himself or by commentary.
