Given the crucial role unauthorized disclosures can play in uncovering grave government wrongdoing, it makes sense to search for a defense of justified cases of what I call “classified public whistleblowing.” The question that concerns me is what form such a defense should take. The main claim will be a negative one, namely, that a defense of whistleblowing cannot be based on individual rights, be they legal or moral, though this is indeed the most commonly proposed defense. I examine the standard view of dignity in Western literature and Metz’s African community view of dignity as a capacity for communal harmonious living. I argue that moral dignity is not just having a capacity for harmonious communal living, but the moral use of such capacity for the promotion of love, friendship, positive identity and active solidarity, which involves normatively prescriptive and evaluative elements. Thus, a plausible African communal conception of moral dignity, which is founded on a moral conception of (...) personhood and community, involves a combination of capacity and agency that is conceptually tied to communal responsibility and respect for self and others. This indicates that human capacities do not have an inherent moral worth. Capacities are instrumentally good and their worth depends on how they are used to promote the moral good of communal well-being, on which individual well-being or dignity depends. This view captures the various use-senses of dignity, addresses many of the problems with many of the analyses of dignity in the literature, and also indicates its relevance. (shrink)

John Rawls's famous difference principle is capable of at least four distinct statements, each of which occurs in A Theory of Justice. According to what I shall term the Crude Principle it is a necessary and sufficient condition for the justice of an institutional scheme which expands social and economic inequality that, subject to the satisfaction of more weighty principles, it increases the level of advantage of the least advantaged. Expressing this principle Rawls writes that,Assuming the framework of institutions required (...) by equal liberty and fair equality of opportunity, the higher expectations of those better situated are just if and only if they work as part of a scheme which improves the expectations of the least advantaged members of society. The intuitive idea is that the social order is not to establish and secure the more attractive prospects of those better off unless doing so is to the advantage of those less fortunate. (shrink)

Just war theory is currently dominated by two positions. According to the orthodox view, provided that jus in bello principles are respected, combatants have an equal right to fight, regardless of the justice of the cause pursued by their state. According to “revisionists” whenever combatants lack reasons to believe that the war they are ordered to fight is just, their duty is to disobey. I argue that when members of a legitimate state acting in good faith are ordered to fight, (...) they acquire a pro-tanto obligation to obey which does not depend for its validity on the justice of the cause being pursued. However, when the war is unjust, this obligation may be overridden, under certain conditions, by the obligation not to contribute to the unjustified killing of innocents. This is because the pro-tanto force of the duty to obey the law is best understood in terms of “presumptive”, rather than “exclusionary” reasons for action. This approach captures the insights of both the orthodox and the revisionist view, while avoiding the problems that afflict each of them. (shrink)

Se analizan diversos aspectos de la ética profesional desde la perspectiva de una ética del agente para la que bienes, normas y virtudes resultan factores complementarios para el cultivo de la inteligencia y el juicio individual. A través de una concepción de la democracia que la vincula con los hábitos y modos (...) de vida, la ética profesional adquiere una renovada significación como elemento central para la autorrealización personal y la emancipación social. En definitiva, bajo el rótulo del profesionalismo democrático, y de la mano de la filosofía moral y política de Dewey, se muestra que la ética profesional es más que un campo de aplicación, un elemento constituyente de una ética cívica en el marco de una sociedad democrática. The tenuous claims of cost-benefit analysis to guide policy so as to promote welfare turn on measuring welfare by preference satisfaction and taking willingness-to-pay to indicate preferences. Yet it is obvious that people's preferences are not always self-interested and that false beliefs may lead people to prefer what is worse for them even when people are self-interested. So welfare is not preference satisfaction, and hence it appears that cost-benefit analysis and welfare economics in general rely on a mistaken theory of (...) well-being. This essay explores the difficulties, criticizes standard defences of welfare economics, and then offers a new partial defence that maintains that welfare economics is independent of any philosophical theory of well-being. Welfare economics requires nothing more than anevidentialconnection between preference and welfare: in circumstances in which people are concerned with their own interests and reasonably good judges of what will serve their interests, their preferences will be reliable indicators of what is good for them. Advocates of epistemic conceptions of democracy sometimes argue that democratic decision-making is a more reliable guide to getting the issues at stake right than the decision-making of individuals. Such arguments give rise to the question of whether those finding themselves in the minority should defer to democratic outcomes. In this article, I discuss the bearing of the normative criterion of reasonable acceptability on this question. I thus ask, can the demand to defer to democratic outcomes be rendered reasonably acceptable to (...) citizens who disagree with them? Using the example of David Estlund’s epistemic proceduralism, I show that the problem of moral deference is inherent to epistemic conceptions of democracy. I then discuss the kind of reasons that would make a demand of deference reasonably acceptable to the minority, arguing that they should be independent from the reasons supporting the majority position. Subsequently, I introduce the conciliatory conception of democracy as an example of what such reasons could be. The conception’s central idea is that disagreement between citizens conceived as equal epistemic authorities carries epistemic significance. This significance makes it rational for citizens so conceived to conciliate their conflicting judgments. Because democratic decision-making has an inbuilt tendency to track such conciliatory positions, the conception offers an independent reason to accept democratic outcomes as the more reliable guide to getting the issues at stake right.
