Although convinced by Frankfurt-style cases that moral responsibility does not require the ability to do otherwise, semicompatibilists have not wanted to accept a parallel claim about moral responsibility for omissions, and so they have accepted asymmetrical requirements on moral responsibility for actions and omissions. In previous work, I have presented a challenge to various attempts at defending this asymmetry. My view is that semicompatibilists should give up these defenses and instead adopt symmetrical requirements on moral responsibility for actions and omissions, (...) and in this paper I highlight three advantages of doing so: first, it avoids a strange implication of the truth of determinism; second, it allows for a principled reply to Philip Swenson’s recent ‘No Principled Difference Argument’; third, it provides a reason to reject a crucial inference rule invoked by Peter van Inwagen’s ‘Direct Argument’ for the incompatibility of moral responsibility and determinism. This paper presents a new challenge to the thesis that moral responsibility for an omission requires the ability to do the omitted action, whereas moral responsibility for an action does not require the ability to do otherwise than that action. Call this the asymmetry thesis. The challenge arises from the possibility of cases in which an omission is identical to an action. In certain of such cases, the asymmetry thesis leads to a contradiction. The challenge is then extended to recent (...) variations of the asymmetry thesis defended by John Martin Fischer and Carolina Sartorio. Finally, a possible objection to the challenge is addressed. The principle of alternative possibilities tells us that an agent is morally responsible for an action only if he could have done otherwise. Frankfurt-style cases provide an extremely influential challenge to the PAP . And Frankfurt-style compatibilists are motivated to accept compatibilism about responsibility and determinism in part due to FSCs. But there is a significant tension between our judgments about responsibility in FSCs and our judgments about responsibility in certain omissions cases. This tension has thus far largely been treated (...) as an internal puzzle for defenders of FSCs to solve. My goal here is to regiment this tension into a clear argument which undermines the FSC based critique of PAP. I will also argue that there is an in principle reason to doubt that Frankfurt-Style Compatibilists will be able to successfully respond to my argument. (shrink)

It is widely held that one can be responsible for doing something that one was unable to avoid doing. This paper focuses primarily on the question of whether one can be responsible for not doing something that one was unable to do. The paper begins with an examination of the account of responsibility for omissions offered by John Martin Fischer and Mark Ravizza, arguing that in many cases it yields mistaken verdicts. In 1969 Harry Frankfurt published his hugely influential paper 'Alternate Possibilities and Moral Responsibility' in which he claimed to present a counterexample to the so-called 'Principle of Alternate Possibilities' ('a person is morally responsible for what he has done only if he could have done otherwise'). The success of Frankfurt-style cases as counterexamples to the Principle has been much debated since. I present an objection to these cases that, in questioning their conceptual cogency, undercuts many of those debates. Such cases (...) all require a counterfactual mechanism that could cause an agent to perform an action that he cannot avoid performing. I argue that, given our concept of what it is for someone to act, this requirement is inconsistent. Frankfurt-style alleged counterexamples are cases where an agent is morally responsible for an action he performs even though, the claim goes, he could not have avoided performing that action. However, it has recently been argued, e.g. by John Fischer, that a counterexample to the Principle could be a 'Fischer-style case', i.e. a case where the agent can either perform the action or do nothing else. I argue that, although Fischer-style cases do not share the conceptual flaw common to all Frankfurt-style cases, they also fail as counterexamples to the Principle. In this paper I asses Davidson’s analysis of action sentences stressing its quantificational structure and its views on prepositions and adverbial modification. Three arguments inspired by Grice’s ideas are deployed against it. First, I point to weird consequences of taking prepositions as defining predicates; second, I show some obstacles for Davidson’s view on adverbs; finally, I raise some doubts about his putative analysis of “negative actions”. Some philosophers have argued that refraining from performing an action consists in actively keeping oneself from performing that action or preventing one’s performing it. Since activities must be held to be positive actions, this implies that negative actions are a species of positive actions which is to say that all actions are positive actions. I defend the following claims: (i) Positive actions necessarily include activity or effort, negative actions may require activity or effort, but never include the activity or effort (...) which may be required. (ii) Unless it is, or was, at some time in P’s power to Q, P does not refrain from Q-ing. (iii) Negative actions are actions , they are causings of negative facts. (shrink)

Frankfurt‐style action cases have been immensely influential in the free will and moral responsibility literatures because they arguably show that an agent can be morally responsible for a behavior despite lacking the ability to do otherwise. However, even among the philosophers who accept Frankfurt‐style action cases, there remains significant disagreement about whether also to accept Frankfurt‐style omission cases – cases in which an agent omits to do something, is unable to do otherwise, and is allegedly morally responsible for that omission. Settling this debate about Frankfurt‐style omission cases is significant because the resolution entails an important fact about moral responsibility: whether there is there a moral asymmetry between actions and omissions with respect to the ability to do otherwise. My proposal is that both Frankfurt‐style action cases and omission cases involve the same type of causal structure: causal preemption. However, the preemptor and the preemptee differ. In action cases, the Frankfurted agent preempts the neuroscientist and is causally and morally responsibility for the effect. In omission cases, Frankfurted agent is neither causally nor morally responsible for the effect. Instead, the neuroscientist preempts the Frankfurted agent. Thus, there are no Frankfurt‐style omission cases. (shrink)

This paper warns of two threats to moral responsibility that arise when accounting for omissions, given some plausible assumptions about how abilities are related to responsibility. The first problem threatens the legitimacy of our being responsible by expanding the preexisting tension that luck famously raises for moral responsibility. The second threat to moral responsibility challenges the legitimacy of our practices of holding responsible. Holding others responsible for their omissions requires us to bridge an epistemic gap that does not arise when (...) holding others responsible for their actions—one that we might often fail to cross. This is a work concerned with justification and freedom and the relationship between these. Its summational aim is to defend a transcendental argument for free will – that we could not be epistemically justified in undermining a strong notion of free will, as a strong notion of free will would be required for any such process of undermining to be itself epistemically justified. The book advances two transcendental arguments – for a deontically internalist conception of epistemic justification and the aforementioned (...) argument for a libertarian conception of free will. In defending each of these arguments, the book both defends and relies upon the principle that ‘ought’ implies ‘can’. In articulating the latter transcendental argument – for freedom – heavy reliance is made on the earlier, epistemic, work: especially on the deontological conception of rational justification (on epistemic internalism). In this paper, I explore an alternative to the Principle of Alternate Possibilities for Moral Responsibility—the Ceteris Paribus Principle of Alternative Possibilities for Moral Responsibility. I consider motivations for this principle and answer some objections to it.

Some have argued that our intuitive reactions to a number of cases of moral responsibility can only be preserved at the expense of a unified account of moral responsibility for acts and omissions. I argue against this conclusion, proposing that a plausible condition on responsibility, the Causal Condition can, when properly elaborated, justify the relevant intuitive data.

Frankfurt-type examples seem to show that agents can be morally responsible for their actions and omissions even if they could not have done otherwise. Fischer and Ravizza's influential account of moral responsibility is largely based on such examples. I examine a problem with their account of responsibility in cases where we fail to act. The solution to this problem has a surprising and far reaching implication concerning the construction of successful Frankfurt-type examples. I argue that the role of the counterfactual (...) intervener in such examples can only be filled by a rational agent. (shrink)

Previously, I have argued that moral responsibility for actions is associated with guidance control. This sort of control does not necessarily involve the freedom to do otherwise. In this paper I extend the view to apply to omissions. That is, moral responsibility for an omission is associated with guidance control of that omission. This helps to provide a systematic, unified account of moral responsibility.

Moral responsibility requires that we are in control of what we do. Many contemporary accounts of responsibility cash out this control in terms of abilities and hold that the relevant abilities are strong abilities, like general abilities. This paper raises a problem for strong abilities views: an agent can plausibly be morally responsible for an action or omission, despite lacking any strong abilities to do the relevant thing. It then offers a way forward for ability‐based views, arguing that very weak (...) abilities can form the basis of moral responsibility for both actions and omissions. (shrink)

Many important harms result in large part from our collective omissions, such as harms from our omissions to stop climate change and famines. Accounting for responsibility for collective omissions turns out to be particularly challenging. It is hard to see how an individual contributes anything to a collective omission to prevent harm if she couldn’t have made a difference to that harm on her own. Some groups are able to prevent such harms, but it is highly contentious whether groups can (...) be loci of responsibility. This paper takes an existing and plausible framework of moral responsibility—one based on abilities—and scales it up to accommodate responsibility for collective omissions. This centrally involves identifying what the relevant collective abilities are and how they work. One significant benefit of this approach is that we can do this while remaining neutral on the debates about collective agency and collective responsibility by showing how individualist and collectivist versions of the theory work. Finally, I explore several further upshots of the scaled-up ability-based account, including that degrees of responsibility can be cashed out in terms of strengths of the relevant abilities, which has both theoretical and applied implications. It is commonly held that no one can be morally responsible for a necessary truth. In this paper, I will provide various examples that cast doubt on this idea. I also show that one popular argument for the incompatibility of moral responsibility and determinism (van Inwagen’s Direct Argument) fails given my examples.

À première vue, la responsabilité morale serait incompatible avec le déterminisme causal, le premier requérant un contrôle total sur sa personne et le second soutenant que nos actions sont fortement influencées par celles des autres. Dans cet article, je me positionnerai contre l’incompatibilisme, dont l’erreur résulte de la conception du libre arbitre. Si une personne s’avère jouer un rôle nécessaire dans l’obtention d’une action ou d’une conséquence, elle en est la cause principale bien qu’elle ne détienne pas un contrôle total (...) sur sa personne. Cet article cherchera à établir les conditions permettant d’identifier les personnes jouant un rôle nécessaire dans la séquence causale et celles qui n’en jouent pas. Dans un premier temps, je reprendrai la théorie de John Martin Fisher et de Mark Ravizza : un individu est moralement responsable lorsqu’il détient un contrôle de guidage. Le contrôle de guidage doit être distingué du contrôle régulateur. Sommairement, le contrôle de guidage est détenu par l’individu étant à la source de la séquence causale, et le contrôle régulateur est détenu par l’individu qui peut influencer l’orientation cette séquence causale. Dans un second temps, j’arguerai, contre Fisher et Ravizza cette fois-ci, que la détention du contrôle régulateur permet également d’imputer une responsabilité morale. (shrink)
