Consequentialism is a state of affairs centered moral theory that finds support in state of affairs centered views of value, reason, action, and desire/preference. Together these views form a mutually reinforcing circle. I map an exit route out of this circle by distinguishing between two different senses in which actions can be understood as bringing about states of affairs. All actions, reasons, desires, and values involve bringing about in the first, deflationary sense, but only some appear to involve bringing about (...) in a second, rationalizing sense. I demonstrate that the views making up this circle hold, implausibly, that all reasons, values, desires, and actions involve bringing about in both senses, and that failure to distinguish these senses obscures the implausibility of these views as a set. I demonstrate, in addition, that the distinction blocks two common arguments that otherwise threaten to leverage us back in to the consequentialist circle. (shrink)

I challenge the common picture of the “Standard Story” of Action as a neutral account of action within which debates in normative ethics can take place. I unpack three commitments that are implicit in the Standard Story, and demonstrate that these commitments together entail a teleological conception of reasons, upon which all reasons to act are reasons to bring about states of affairs. Such a conception of reasons, in turn, supports a consequentialist framework for the evaluation of action, upon which (...) the normative status of actions is properly determined through appeal to rankings of states of affairs as better and worse. This covert support for consequentialism from the theory of action, I argue, has had a distorting effect on debates in normative ethics. I then present challenges to each of these three commitments, a challenge to the first commitment by T.M. Scanlon, a challenge to the second by recent interpreters of Anscombe, and a new challenge to the third commitment that requires only minimal and prima facie plausible modifications to the Standard Story. The success of any one of the challenges, I demonstrate, is sufficient to block support from the theory of action for the teleological conception of reasons and the consequentialist evaluative framework. I close by demonstrating the pivotal role that such arguments grounded in the theory of action play in the current debate between evaluator-relative consequentialists and their critics. (shrink)

The perennial appeal of Kantian ethics surely lies in its conception of autonomy. Kantianism tells us that the good life is fundamentally about acting in accordance with an internal rather than an external authority: a good will is simply a will in agreement with its own rational, self-constituting law. In this paper, I argue against Kantian autonomy, on the grounds that it excessively narrows our concept of the good, it confuses the difference between practical and theoretical modes of knowing the (...) good, and it cannot respect the essential efficacy of the principles of practical reason. Intention is at the heart of criminal law. If it is not the mens rea requirement found most often in offences, it is still the standard against which other grades of fault tend relatively to be judged. It has generated much controversy, as the crucial question, “Did the defendant intend X?” is resistant to clear answers. This paper argues that intention-questions are difficult because intention is not the thing law takes it to be: Importantly, contrary to law's assumptions, it is (...) neither a state of mind nor is it connected in an exclusive manner to the reasons for which we act. What a person is doing often depends on that person’s thought about what they are doing, or about the wider circumstances of their action. For example, whether my killing is murder or manslaughter depends, in part, on whether I understand that what I am doing is killing you, and on whether I understand that my killing is unjustified. Similarly, if I know that the backpack I am taking is yours, then my taking it may be an act of theft; but (...) it is not theft if I simply mistook your backpack for my own. And if I don’t know that in signing a document I’m promising to do some thing, then in signing it I’m not promising to do this at all. -/- According to Elizabeth Anscombe, a central task of philosophical psychology is to articulate this dependency of action on thought. And in a range of papers published during the 1960s, Anscombe sought to elucidate various aspects of this dependency. In this paper we give a systematic overview of how Anscombe understands this dependency, and in the process reveal the conceptual framework underlying Anscombe’s thinking about perception, desire, intention, voluntariness, responsibility, guilt, and sin. Anscombe’s published writings, lectures and notes on sensation point toward a sophisticated critique of sense-data, representationalist and direct realist theories of perception (in both their historical and contemporary forms), and a novel analysis of the concept of sensation. Her philosophy of perception begins with the traditional question, ‘What are the objects of sensation?’, but the response is a grammatical rather than ontological enquiry. What, she asks, are the characteristics of the grammatical object of sensation verbs? Anscombe’s answer is: sensation verbs (...) take ‘intentional objects’, where an ‘intentional object’ is a description which has the characteristics of the concept of intention—characteristics elucidated in great detail in her Intention. This simple manoeuvre allows Anscombe to reject two opposing positions in the philosophy of perception - that the objects of sensation are sense-data and that the objects of sensation are tables and chairs (etc). Both views, she argues, fail to recognise the grammatical fact that the verbs of sensation take intentional objects. This chapter outlines the case for a grammatical methodology in philosophy of perception, by framing an analysis of the ways in which the sense-data and direct-realist theories of perception arise out of the theoretical demands that are generated when the grammar of the concept of sensation is left unexplored. Along the way, it will be shown that Anscombe’s philosophy of perception should not be read as fore-running contemporary representationalism, and that reading it as such in fact runs counter not only to the letter but the spirit of Ancombe’s proposal.
