ABSTRACT:Partnerships between companies and NGOs have received considerable attention in CSR in the past years. However, the role of NGO legitimacy in such partnerships has thus far been neglected. We argue that NGOs assume a status as special stakeholders of corporations which act on behalf of the common good. This role requires a particular focus on their moral legitimacy. We introduce a conceptual framework for analysing the moral legitimacy of NGOs along three dimensions, building on the theory of deliberative democracy. (...) The deliberative turn in political philosophy sees theorists attempting to ground democratic legitimacy in free, rational, and public deliberation among citizens. However, feminist theorists have criticized prominent accounts of deliberative democracy, and of the public sphere that is its site, for being too exclusionary. Iris Marion Young, Nancy Fraser, and Seyla Benhabib show that deliberative democrats generally fail to attend to substantive inclusion in their conceptions of deliberative space, even though they endorse formal inclusion. If we take these criticisms seriously, (...) we are tasked with articulating a substantively inclusive account of deliberation. I argue in this article that enriching existing theories of deliberative democracy with Fricker's conception of epistemic in/justice yields two specific benefits. First, it enables us to detect instances of epistemic injustice, and therefore failures of inclusion, within deliberative spaces. Second, it can act as a model for constructing deliberative spaces that are more inclusive and therefore better able to ground democratic legitimacy. (shrink)

Corporate engagements with pressing environmental challenges focus on expanding the role of the market, seeking opportunities for growth and developing technologies to manage better environmental resources. Such approaches have proved ineffective. I suggest that a lack of meaningful response to ecological degradation and climate change is inevitable within a capitalist system underpinned by a logics of appropriation and an instrumental rationality that views the planet as a means to achieve economic ends. For ecofeminism, these logics are promulgated through sets of (...) hierarchical and interrelated dualisms which define the human in opposition to the realm of “nature”. This has led to the resilience of ecosystems, social reciprocity and care being unvalued or undervalued. An ecofeminist, care-sensitive ethics is proposed that focuses on the interconnections between human and nonhuman nature and on affective engagements with the living world. A practical morality is developed that sees the self not as atomized nor as self-optimizing, but as a self in relationship. Such an ethics is necessary to motivate action to contest capitalism’s binary thinking, evident within corporate environmentalism, which has re-made the web of life in ways that are not conducive to planetary flourishing. Deliberative democracy harbors a recurrent tension between full inclusion and intelligible speech. People with profound cognitive disabilities often signify this tension. While liberal deliberative theorists sacrifice inclusion for intelligibility, this exclusion is unnecessary. Instead, by analyzing deliberative locations that already include people with disabilities, I offer two ways to revise deliberative norms. First, the physical presence of disabled bodies expands the value of publicity in deliberative democracy, demonstrating that the publicity of bodies provokes new conversations similar to rational speech acts. (...) Second, the inclusion of people with profound disabilities necessitates a form of collaborative speech in which individuals make claims collaboratively. Habermas offers an ideal site to pursue this analysis because he recognizes the theoretical tension between inclusion and intelligibility and because his personal testimony reveals important insight into the lived experience of disability. Many philosophers endorse the ideal of justice yet disagree radically over what that ideal requires. One persistent problem for thinking about justice is that the unjust social arrangements that originally motivated our questions may also distort our thinking about possible answers. This paper suggests some strategies for improving our thinking about justice in the unjust meantime. As our world becomes more just, we may expect our thinking about justice to improve.

The nurturing that produces love, care, and solidarity constitutes a discrete social system of affective relations. Affective relations are not social derivatives, subordinate to economic, political, or cultural relations in matters of social justice. Rather, they are productive, materialist human relations that constitute people mentally, emotionally, physically, and socially. As love laboring is highly gendered, and is a form of work that is both inalienable and noncommodifiable, affective relations are therefore sites of political import for social justice. We argue that (...) it is impossible to have gender justice without relational justice in loving and caring. Moreover, if love is to thrive as a valued social practice, public policies need to be directed by norms of love, care, and solidarity rather than norms of capital accumulation. To promote equality in the affective domains of loving and caring, we argue for a four-dimensional rather than a three-dimensional model of social justice as proposed by Nancy Fraser. Such a model would align relational justice, especially in love laboring, with the equalization of resources, respect, and representation. (shrink)

This is the first of two companion articles drawn from a larger project, provisionally entitled Undisciplining Moral Epistemology. The overall goal is to understand how moral claims may be rationally justified in a world characterized by cultural diversity and social inequality. To show why a new approach to moral justification is needed, it is argued that several currently influential philosophical accounts of moral justification lend themselves to rationalizing the moral claims of those with more social power. The present article explains (...) how discourse ethics is flawed just in this way. The article begins by identifying several conditions of adequacy for assessing reasoning practices designed to achieve moral justification and shows that, when used in contexts of cultural diversity and social inequality, discourse ethics fails these conditions. It goes on to argue that the failure of discourse ethics is rooted in its reliance on a broader conception of moral epistemology that is invidiously idealized. It concludes by pointing to the need to rethink both the mission and the method of moral epistemology. (shrink)

This article argues that people have legitimate interests in privacy that deserve legal protection on democratic principles. It describes the right to privacy as a bundle of rights of personal choice, association and expression and shows that, so described, people have legitimate political interests in privacy. These interests reflect the ways that privacy rights can supplement the protection for people's freedom and equality provided by rights of political choice, association and expression, and can help to make sure that these are, (...) genuinely, democratic. Feminists have often been ambivalent about legal protection for privacy, because privacy rights have, so often, protected the coercion and exploitation of women, and made it difficult to politicise personal forms of injustice. However, attention to the differences between democratic and undemocratic forms of politics can enable us to meet these concerns, and to distinguish a democratic justification of privacy rights from the alternatives. Many commentators have failed to identify the important issues at the heart of the debate between Habermas and Rawls. This is partly because they give undue attention to differences between Rawls’s original position and Habermas’s principle, neither of which is germane to the actual dispute. The dispute is at bottom about how best to conceive of democratic legitimacy. Rawls indicates where the dividing issues lie when he objects that Habermas’s account of democratic legitimacy is comprehensive and his is confined to (...) the political. But his argument is vitiated by a threefold ambiguity in what he means by ‘comprehensive doctrine’. Tidying up this ambiguity helps reveal that the dispute turns on the way in which morality relates to political legitimacy. Although Habermas calls his conception of legitimate law ‘morally freestanding’, and as such distinguishes it from Kantian and natural law accounts of legitimacy, it is not as freestanding from morality as he likes to present it. Habermas’s mature theory contains conflicting claims about the relation between morality and democratic legitimacy. So there is at least one important sense in which Rawls’s charge of comprehensiveness is made to stick against Habermas’s conception of democratic legitimacy, and remains unanswered. The aim of this article is to argue for the need for a context-sensitive approach to the understanding of ethical issues in nursing practice as we face the next millennium. This approach means that the idea of universalism must be questioned because ethics is an interpersonal activity, set in a specific context. This view is based on issues that arise in international collaborative research as well as in research focused on ethical problems in nursing practice. Moral values are indigenous to (...) a particular culture and influence beliefs about health and illness as well as what priorities are to be made in providing health care. Nursing practice must include thoughtful reflection on the meaning of moral concepts and principles in terms of culture. Theoretical developments in nursing ethics must be based on empirical research focusing on contextual aspects of health care. (shrink)

Axel Honneth distinguishes between recognitive practices according to the social domain in which they occur and this allows him to theorise the relationship between power and recognition. 'Love-based recognition', which suggests the centrality of recognition to the relationships that nurture us in the first instance, is located in the family. Honneth argues that relationships encompassed by this category are pre-political, thereby repeating the distinction between the public and the private common to much political theory. This article explores the structure of (...) this delineation in his thinking. I argue that Honneth's analysis marginalises feminist concerns with how power functions through recognition in the private sphere. Honneth also robs himself of a rejoinder to recognition sceptics, who suggest that the desire for recognition is a condition of subordination. : Seyla Benhabib's critique of Jürgen Habermas's moral theory claims that his approach is not adequate for the needs of a feminist moral theory. I argue that her analysis is mistaken. I also show that Habermas's moral theory, properly understood, satisfies many of the conditions identified by feminist moral philosophers as necessary for an adequate moral theory. A discussion of the compatibility between the model of reciprocal perspective taking found in Habermas's moral theory and that found in María Lugones's essay (...) "Playfulness, 'World'-Travelling, and Loving Perception" reinforces the claim that his moral theory holds as yet unrecognized promise for feminist moral philosophy. (shrink)

In May 2017, yet another South African university became a site of hate speech. Three students chose to display Nazi-inspired posters, which advertised an ‘Anglo-Afrikaner student’ event, under the motto ‘Fight for Stellenbosch’. That the posters provoked the response which it so obviously sought, was evident in the student outrage, and the swift condemnation from university management. Neither the prevalence of hate speech, nor its predictable responses, is new. The central concern of this article is to consider the extent to (...) which tolerance can offer a plausible response to hate speech. The questions which arise, however, are: Does the right to divergent viewpoints hold the same legitimacy as antagonistic ones? When is the boundary between legitimate and hate speech breached? Does a democracy imply the tolerance of all forms of speech? Or, are there limits to the forms of speech that a democracy ought to tolerate? (shrink)

The religious right often aligns its patriarchal opposition to same-sex marriage with the defence of religious freedom. In this article, I identify resources for confronting such prejudicial religiosity by surveying two predominant feminist approaches to same-sex marriage that are often assumed to be at odds: discourse ethics and queer critical theory. This comparative analysis opens up to view commitments that may not be fully recognizable from within either feminist framework: commitments to ideals of selfhood, to specific conceptions of justice, and (...) to particular definitions of secularism. I conclude by examining the "postsecular" turn in feminism, suggesting that we can see the same-sex marriage debate not in terms of an impasse between differing feminist approaches, but in terms of shared existential and ethical affinities. Postmodernism precludes philosophical justifications for democracy. This undermines the role of philosophy of education and leaves us with weaker reasons for educational democracy than we need. If the ‘postmodern challenge’ is as Wilfred Carr conceives it, Jürgen Habermas meets that challenge. His work rests on neither Enlightenment essentialism nor foundationalism. Habermas can accept and explain that consciousness is historically and socially situated in discourse, yet still argue to the possibility of emancipation. I defend his conception of rationality from charges of (...) essentialism. Rational thinking can critique its own specific forms, so superior forms of rationality remain universalisable by rational means. A historicising account of such critique avoids situationist relativism. These considerations justify educational democracy and preserve a role for philosophy of education. (shrink)

The ‘constructivist turn’ in political representation literature has clarified that representation is crucial in forging identities – through the creation of ideological and symbolic representations that mobilize and coalesce otherwise scattered and undefined social forces – and thus also why it is essentially an interpretative and performative activity. In this article I argue that, as a consequence of this emphasis on interpretation and performativity, this approach makes clear why the ethos of representatives is important in representation. To prove this, I (...) employ some insights from rhetoric. Rhetorical persuasion and democratic representation, indeed, call for a similar kind of judgment, as they both need to mediate between opposing exigencies: rhetoric between attentiveness to the specificity of the audience and the creation of new beliefs, and representation between being responsive to specific interests and giving them a new articulation. Mediating this tension requires an exercise of judgment that, being directed toward the future, inevitably introduces uncertainty into the relation. This is why both in rhetoric and representation the ethos is an essential element. However, as I argue in the conclusion, the personal qualities that should be considered relevant here are above political qualities, rather than technical or moral ones. (shrink)

This article endeavors to draw out and explicate some of the normative tensions that animate the imaginary and practice of solidarity. It begins by examining the account of solidarity set forth in the writings of Jürgen Habermas. It then considers Axel Honneth’s recognition-theoretic conception of the solidaristic attitude. While remaining sympathetic to the left-Hegelian intersubjectivism of Habermas’ discourse-ethic, Honneth seeks to redress the “cognitive-centric” limitations of the latter thinker’s conception of solidarity. In this context, particular emphasis is placed on Honneth’s (...) engagement with the idea of Sittlichkeit, or shared form of ethical life, discussed in Hegel’s early “Jena period” work, as well as in his later Elements of the Philosophy of Right. To Honneth, while these writings can contribute significantly to a recognition-theoretic understanding of solidarity, they must be distinguished from the philosophy of consciousness that circumscribes the famous recognition struggle between master and slave in The Phenomenology of Spirit. In conclusion, the paper questions the capacity of Honneth’s approach to criticize ideological forms of solidaristic recognition, offering a qualified defense of Habermas’ contravening perspective. This dissertation attempts to preserve the central tenets of a global moral theory called “the capabilities approach” as defended by Martha Nussbaum, but to do so in a way that better realizes its own goals of identifying gender injustices and gaining cross-cultural support by providing an alternative defense of it. Capabilities assess an individual’s well-being based on what she is able to do (actions) and who she is able to be (states of existence). Nussbaum grounds her theory in the intuitive (...) idea that each and every person is worthy of equal respect and dignity. The problem with grounding a theory in a version of intuitionism is that it runs the risk of authoritarian moral reasoning. I argue Nussbaum, in fact, is the final arbiter who decides which intuitions are mistaken, which are not, and how to interpret what people say to fit into her own framework. This method of justifying capabilities is most problematic in cases of social inequality whereby dominant group members do not feel they need to check their intuitions against non-dominant group members, and even if they did, they are not forced to take the non-dominant group’s intuitions seriously. I find capabilities as a global moral theory to be very promising, and I agree with Nussbaum that a list of capabilities is beneficial for identifying people who are not able to live a truly dignified human life. However, I am also sympathetic to the criticism of defending capabilities using a version of intuitionism. So, I offer an alternative method of justifying the capabilities rooted in the discourse ethics tradition. This method seeks all persons that are affected by the outcome to freely and equally share their opinion. This avoids the charge of authoritarian moral reasoning, because (1) it seeks perspectives other than simply one’s own, but unlike traditional ethics, it (2) pays special attention to the ways in which power relations shape dialogue. Ultimately, I hope to have preserved the central tenets of the capabilities approach while better realizing Nussbaum’s commitment to defending a theory that is gender sensitive and has gained cross-cultural support. When women become perpetrators of suicide bombing, their agency – their ability to act upon and affect the world – is often denied. There are a number of reasons for this and one this thesis considers is that – as females – they are not expected to be violent. Accordingly, such women are judged to be coerced or incompetent, and so unable to rule themselves sufficiently as agents. Models of autonomy propose various frameworks for assessing whether acts or persons are (...) self-governing, and the relational approach in particular has garnered much support recently. However, some aspects of the relational account remain under-theorised, including how autonomy might be measured. In this thesis, I aim to bring these two elements together by examining whether an extension of the relational model may offer a way in which to estimate the autonomy of the bombers in a more nuanced fashion. I make two claims. First, that the relational conception of the agent and autonomy ‘fits’ the bombers. Second, that my spectrum view, which is rooted in the relational approach, maps the bomber’s autonomy approximately but in detail. As such, my spectrum view is a befitting notion of autonomy and allows a graded and comparative representation of the bomber’s autonomy. (shrink)

Seyla Benhabib has displayed a deeply normative concern for the origin, properties, condition and destiny of the modern world in work running from Critique, Norm, and Utopia (1986), to Situating the Self (1992), The Reluctant Modernism of Hannah Arendt (1996), and Another Cosmopolitanism (2006). I hope to show that Benhabib's view of modernity is ambiguous, and that inconsistencies in her position reach back, through Habermas and Weber, to Kant. I begin with a sketch of Benhabib's sense of what modernity is (...) about, turn then to what I think makes her position ambiguous, and conclude with a discussion of what I think is missing in her treatment of modernity. The gap I identify is strikingly pointed up when she uses the term modernism but does not talk about modernism at all. (shrink)

Este artículo expone la importancia de analizar el concepto de género y el rol de varios actores socioeducativos en la Educación para la Ciudadanía. Tomando como referencia algunas ideas clave de qué se trata cuando se habla de estereotipos, identidad, género y rol de género, para abordar el cómo, el porqué, cuándo y quienes educan en valores y para la ciudadanía. Percibir como se configura el género en la dialéctica Sociedad-Escuela, insta a la consideración de factores históricos, culturales y políticos. (...) Se destacan las políticas transnacionales de Educación, de Igualdad y especialmente de la Educación para la Igualdad, como herramientas válidas para producir cambios sociales en un sentido de mejora continua de la ciudadanía. El enlace entre la Escuela como institución transmisora de contenidos socialmente deseables y necesarios, y los valores explícitos e implícitos que la misma reproduce y produce, se presenta como un tema introductorio a la idea que la Educación se tiñe de una práctica social productora, reproductora y transformadora del sujeto social. Asimismo, las relaciones que se producen en el seno de la familia, dan pistas acerca de la construcción individual y colectiva de un concepto transversal de género. (shrink)
