In this article I present two possible interpretations of Rawls’s assertion in A Theory of Justice that human beings have a desire to express their nature as free and rational. My reading hinges on different accounts of the Kantian conception of the person and of the Aristotelian principle and its companion effect. According to the first interpretation, this desire is a kind of natural predisposition inherent in all persons irrespective of the society in which they live. It has a universal (...) and ahistorical aspect. The second interpretation sees our free and rational nature as an ideal that we strive to fulfill. This ideal appeals only to citizens of modern liberal democracies and entails a more qualified universalism. I argue that there is strong textual support for both interpretations but the second one is more consistent with the methodological framework of justice as fairness. (shrink)

John Rawls was what we might call a “frenemy” to Stanley Cavell. Time and again, Cavell states his admiration for Rawls's political philosophy but criticizes it for two reasons. First, he believes that Rawls too hastily dismisses a perfectionist tradition that is essential for a flourishing liberal democracy. Second, he attacks certain aspects of Rawls's theory of justice as moralistic and legalistic. The first half of this article examines Cavell's critique of Rawls and argues that the two authors are more (...) closely aligned than suspected. It begins by reconstructing Cavell's critique of Rawls, and using archival materials from Harvard University, presents for the first time Rawls's interpretation of this critique. The second half of the article highlights perfectionist themes in Rawls's A Theory of Justice. The contribution of this article is to reevaluate the relationship between two of the most important moral philosophers of the twentieth century and also to provide a more expansive theory of liberalism that incorporates the psychological depth, moral subtlety and political hopefulness of moral perfectionism. John Rawls’ The Law of Peoples has typically been read as an intervention in the field of ‘global justice’. In this paper, I offer a different and widely overlooked interpretation. I argue that The Law of Peoples is a secular theodicy. Rawls wants to show that the 'great evils' of history do not condemn humankind by using a secularised form of moral faith to search for signs that the social world allows for the possibility of perfect justice. There are, I (...) show, striking homologies between this argument and the Christian theodicy that Rawls wrote in 1942, A Brief Inquiry into the Meaning of Sin and Faith. Perhaps more significantly, I draw out how there is, as Rawls himself appears to acknowledge, an intimate relationship between this redemptive project and Rawls' idealistic and moralistic approach to political philosophy. Der neue politische Realismus erkennt in John Rawls einen Erzfeind. In jüngeren Debatten scheint oft evident zu sein, dass gerade Eine Theorie der Gerechtigkeit exemplarisch für einen Moralismus sei, der die politische Wirklichkeit verzerre. Doch die Sache ist kompliziert. In diesem Aufsatz blicke ich zurück auf sein Frühwerk im Lichte dieser Kritik. Dabei geht es mir um vier Einwände: dass Rawls’ Idealtheorie kein Ratgeber für das politische Handeln und ideologisch verblendet sei; Macht und ihre Legitimierbarkeit nicht überzeugend konzipiere; die Bedeutung (...) politischer Konflikte und Uneinigkeit über den Inhalt der Gerechtigkeit unterschätze; und verkenne, dass eine wahrlich politische Theorie auf die Geschichte eingehen müsse. Wie stichhaltig sind diese Vorwürfe und was fördern sie zutage? Der Aufsatz zeigt, dass selbst Rawls’ erstes Hauptwerk nicht so einfach eines Moralismus überführt werden kann, wie es auf den ersten Blick den Anschein hat. Damit meine ich nicht, dass die Einwände allesamt keinen Biss hätten. Doch werden die Rechtfertigungslasten der Rawls’schen Gerechtigkeitstheorie nicht immer gebührend berücksichtigt; und manche Konterpunkte sind gerade bei wichtigen philosophischen Weggabelungen nicht ausreichend mit argumentativer Substanz untermauert. Wer einen Anti-Moralismus verficht, wofür es gute Gründe gibt, sollte weiterhin das konstruktive Gespräch auch mit dem frühen Rawls suchen und auf die internen Spannungen sowie realistischen Konzessionen seines Egalitarismus achten. Social contract theories serve a twofold purpose: by addressing acute crises, they elaborate solutions to long-standing social paradoxes. The article reinterprets the stakes of the Covid pandemic from this perspective. Firstly, the long-lasting structural paradoxes of late modernity are linked to the acute crisis of the pandemic with the help of critical theories of late modernity. It is argued that the pandemic provides opportunity for revaluating those social contracts, which are based on universalist principles of justice. Secondly, two paradigmatic historical (...) examples (Hobbes, Rawls) are overviewed in a meta-theoretical fashion, so that the dimensions of revaluation could be highlighted. Thirdly, the foundations of a post-pandemic social contract are outlined. As the pandemic is inseparable from the structural paradoxes caused by unconstrained systems based on universal principles of justice, the post-pandemic social contract aims at preventing the system paradoxes by revaluating their universal principles in a ‘trial of particularity’ (Derrida, Levinas). В центрі уваги цієї статті праці Ролза, написані в 1940-х — першій половині 1950-х років, до поїздки Ролза в Окс форд, коли завершується його «вітґенштайніанський поворот», а от же, їх виправ- дано можна розглядати як окремий етап розвитку його думки. Тому вони становлять неабиякий інтерес для дослідження. Ана ліз ранніх праць Ролза дав змогу побачити, що ба зові концепти Ролзової теорії справедливості починають формуватися ще до його поїздки в Оксфорд. В цих працях Ролз ще не звертається власне до теми справедливості, про те в них закладаються основи для концептів «добре впорядковане суспільство», «вихідна позиція», то го тлумачення обставин справедливості, що ми його знаходимо в «Теорії справедливості». І хо ча після війни Ролз відмовляється від релігії, наслідком чого став пошук ним базових етичних принципів справедливої кооперації, які можна обґрунтувати раціонально, у своїх подальших працях він зберігає загальну орієнтацію на соціальний ідеал, уявлення про який він формує у 1940-ві роки в межах традиції неоортодоксальної протестантської теології. Ідеї пізнього, а особливо раннього періодів творчості Ролза рідко стають предметом серйозної уваги. На думку автора, ця ситуація усталює стереотипні й однобічні тлумачення. Натомість предметна увага до Ролзових ідей раннього і пізнього етапів дає підстави істотно збагатити поле інтерпретацій в сучасній політичній філософії. Мета цієї статті потрійна: довести, що критика Мартою Нусбаум пізніх ідей Ролза, запропонована в межах підходу спроможностей, не є вичерпною; що ця критика постане більш плідною, якщо спиратиметься на деякі ранні ідеї самого Ролза, які той згодом використовувати (...) перестав; що таке поєднання критичних арґументів створює нову версію політичного лібералізму, послідовнішу за версії як пізнього Ролза, так і Нусбаум. Цю версію автор пропонує називати «експансивним політичним лібералізмом». Важливим компонентами ЕПЛ є ідея Генрі Ричардсона про взаємодоповнюваність «благого» та «правильного», арґумент пайдеї, а також інтерпретації підходу спроможностей в рамках «розумних всеохопних доктрин». Спираючись на ці компоненти, автор описує механізм впливу на «фонову культуру», з якої потім наро- джується «публічний розум», що буде визначати «політичну концепцію» Ролза. Таким чином, у рамках ЕПЛ «політична концепція» може розширюватися. Через взаємодоповнюваність «благого» та «правильного» вона набуває здатності краще реаґувати на політичні виклики, зберігаючи водночас непорушність фундаментальних політичних принципів суспільства.
