This article argues that the standard model of political representation mischaracterises the structure of representation. After surveying the classical types of representation and their application to non-humans, the basic nature of representation is shown to have been unduly centred on interests, responsiveness and unidirectional protocols. It proposes a different structure by drawing inspiration from recent scholarship and developments in political philosophy, as well as the representation of non-human actors. It proposes an ontological grounding of representation in ‘irreducible multiplicity’, and a (...) structural analysis based on the concepts of claim and relation. This abstract form of representation can take into account both human and non-human cases, and works to ground different typologies. The relational structure of representation creates interests and preferences, subjects and actors, power dynamics and seemingly immutable identities. (shrink)

In this paper I defend a theory of welfare rights for nonhuman animals. I do this by demonstrating that a well-established framework for protecting the interests of farm animals, the ‘Five Freedoms of Animal Welfare’, is already functioning just as a set of rights. To support this claim I adopt a common approach to detecting evidence for deontological reasoning and look at the structural features of rights. I first consider Hohfeld’s system of legal rights and consider whether the Five Freedoms (...) may be understood as liberties or claim rights, before making a more successful comparison with side constraints and an interest theory of rights as understood by Nozick and Raz. I also respond to a likely objection that it is not possible to have some welfare rights without a right to freedom from exploitation. The argument therefore contributes to breaking down the stubborn division between ‘animal welfare’ and ‘animal rights’. (shrink)

Nonhuman animal studies scholars have extensively investigated attitudes on animal welfare in general and farm animal welfare in particular. Thus far, this research has focused mainly on public opinion, but there has been minimal research seeking to explain the influences on actual policymakers when they vote on farm animal welfare legislation. This paper contributes to this literature by quantitatively analyzing 216 state legislators’ votes on two farm animal welfare bills. It hypothesizes that the representatives’ personal and representational connections with agriculture (...) best explain their votes on these farm animal protection bills. This research also includes three control variables: each legislator’s gender, race/ethnicity, and political party. Logistic regression revealed that the legislators’ personal and representational connections with agriculture are significant, but political party is the strongest independent variable explaining state legislators’ farm animal welfare votes. An interaction model revealed mixed evidence that political party moderates the influence of agriculture. (shrink)

Since the 1970s, animal advocacy groups have attempted to improve the treatment of non-human animals by influencing public opinion and lobbying for legislation that protects animals. Empirical assessments of these efforts have reported mixed results. Animal advocacy groups also use litigation as a means of improving the treatment of nonhuman animals, but there has been limited empirical testing of the effectiveness of animal advocacy litigation. To fill this gap in the literature, this study examines the 188 animal law cases decided (...) in state supreme courts from 1973 through 2005. It looks specifically at whether the participation of an animal advocacy organization increases the chance of a favorable decision, while controlling for legal and political influences on case outcomes. Logistic regression reveals that the presence of animal advocacy groups does not exert a statistically significant impact on case outcomes. Further analysis demonstrates, however, that animal advocacy groups are significantly more likely than nongroup litigators to pursue cases that are difficult to win. (shrink)

This article seeks to provide a research agenda for the study of animal protection politics. It looks firstly at the animal protection movement's organization and maintenance in the context of Olson's theory of collective action. While existing research suggests that activists tend to be recruited because of the purposive and expressive benefits they offer rather than the material ones emphasized by Olson, these alternative forms of selective incentives can hinder the achievement of the movement's goals. Secondly, the article outlines alternative (...) models of policy-making and shows how they might be operationalized to explain the development of animal welfare policy-making in Britain and the United States. Preliminary observations suggest thatBritain's animal welfare record is more substantial because policy communities have been able to manage and limit change through concessions and cooptation. No such mechanism is available in the American political system where the greater openness and fragmentation often results in severe confrontation and ultimately, stalemate. (shrink)

Media and nonhuman animal liberation is an under-researched area in the United Kingdom. If the most appropriate metaphor describing the media/social movement relationship is "dance," then largely the media and animal liberation are dancing in the dark of neglect. Drawing upon different approaches to media and offering some notes toward animal liberation media studies, this article explores how, by engaging with the "established terms of the problematic at play," animal liberationists and their claims are appropriated by speciesist ideology through exclusion (...) and confusing and redefining maneuvers. A contextual analysis of its typical texts raises questions of the public interest role, due impartiality of media and, implicitly, of movement strategy. (shrink)

Three Canadian institutional animal care and use committees were observed over a 1-year period to investigate animal ethical evaluation. While each protocol was evaluated, the observer collected information about the final decision, the type of protocol, and the category of invasiveness. The observer also wrote down verbatim all verbal interventions, which were coded according to the following categories: scientific, technical, politics, human analog, reduction, refinement, and replacement. The data revealed that only 16% of the comments were devoted to the 3 (...) explicit ethical categories and that most of the comments were technical. However, the analysis revealed that ethical concerns were implicit in both scientific and technical comments; either ethical norms had been translated into scientific and technical language, or some of the scientific and technical comments had an impact on the ethical treatment of animals. The results are discussed in relation to previous nonobservational research that identified potential pitfalls and bias in animal ethical evaluation. (shrink)

Marxism has defined its key values in opposition to animals other than human in order to promote the interests of the most downtrodden human beings. Although it has characterized itself as a scientific historical and economic theory, sympathy for human suffering has provided its most powerful motivation as a political force. This capacity for sympathy, causing in modern times an extension of Marxist concerns beyond "class" in the original sense, is beginning to accommodate animals as are the theoretical concepts of (...) alienation, surplus value, and historical materialism. Marxism's inconsistencies are being resolved in favor of the side that, for human as well as animal benefit, favors individual sentience and other pro-animal values. So, in a truly dialectical progression, the same quality of sympathy that at first caused Marxism to denigrate animals is now coming out in their support. (shrink)

To date, insufficient work has been carried out on how children view living organisms in the environment. In this study a large number of conversations were audio-taped and transcribed while primary age pupils observed meal worms or brine shrimps (both of which are invertebrates) during science activities. Analysis revealed the ways in which the pupils interpreted what they saw in terms of their prior experience. The post-war Western world has seen a gradual shift from government to governance, a process that also concerned the issues related to agro-food sustainability, such as food quality, environmental impact, social justice, and farm animal welfare. Scholars believe that social media are a new site that reconfigures relations between various actors involved in the governance of these problems. However, empirical research on this matter remains scarce. This paper fills this gap by examining the case of Februdairy, a Twitter hashtag campaign (...) to promote the British dairy industry, hijacked by animal protection activists. For this case, I employ the relational perspective on technology affordances—as operationalised by Faraj and Azad, Materiality and organizing. Social interaction in a technological world, Oxford University Press, Oxford, 2012)—to highlight two distinct strategic modes of embracement of social media functionalities by the opposing groups: hashtag hijacking and crowdsourcing transparency. The analysis reveals also that a pre-existing social structure of the agro-food system conditions reconfiguration of social relations by technology in a way that actually strengthens the tendency to govern the issue of farm animal protection with market mechanisms. Animal agriculture predominantly involves farming social animals. At the same time, the nature of agriculture requires severely disrupting, eliminating, and controlling the relationships that matter to those animals, resulting in harm and unhappiness for them. These disruptions harm animals, both physically and psychologically. Stressed animals are also bad for farmers because stressed animals are less safe to handle, produce less, get sick more, and produce poorer quality meat. As a result, considerable efforts have gone into developing stress-reduction methods. Many of (...) these attempt to replicate behaviours or physiological responses that develop or constitute bonding between animals. In other words, humans try to mitigate or ameliorate the damage done by preventing and undermining intraspecies relationships. In doing so, the wrong of relational harms is compounded by an instrumentalisation of trust and care. The techniques used are emblematic of the welfarist approach to animal ethics. Using the example of gentle touching in the farming of cows for beef and dairy, the paper highlights two types of wrong. First, a wrong done in the form of relational harms, and second, a wrong done by instrumentalising relationships of care and trust. Relational harms are done to nonhuman animals, whilst instrumentalisation of care and trust indicates an insensitivity to morally salient features of the situation and a potential character flaw in the agents that carry it out. Awareness of farm animal welfare issues is growing in Canada, as part of a larger food movement. The baseline Canadian standards for farm animal welfare—the Recommended Codes of Practice for the Care and Handling of Farm Animals—are up for revision. The success of these standards will depend in part on perceived legitimacy, which helps determine whether voluntary code systems are adopted, implemented, and accepted by target audiences. In the context of the Codes, legitimacy will also hinge on whether the standards-developers (...) marshal narratives about farm animals that accord with their audiences’ expectations. The aim of this paper is to catalogue factors that influence legitimacy in farm animal welfare standard-setting, including which narratives of animal welfare are emphasized by standard-setters. Drawing upon the example of the baseline Canadian standards, and the National Farm Animal Care Council, the paper will present a theoretical and methodological framework for analyzing legitimacy in the context of animal welfare standards-development and discuss associated policy considerations.
