The question I raise is whether Mark Balaguer’s event-causal libertarianism can withstand the disappearing agent objection. The concern is that with the causal role of the events antecedent to a decision already given, nothing settles whether the decision occurs, and so the agent does not settle whether the decision occurs. Thus it would seem that in this view the agent will not have the control in making decisions required for moral responsibility. Some scientists have reported what they regard as evidence of indeterministic brain processes that influence behavior (Brembs 2011, Maye et al. 2007). How do these reports bear on the positive side of libertarianism about free will? That is an approximation of my guiding question in this article. I make the question more precise in section 1, in light of some conceptual and scientific background. In the remainder of the article, I seek—and eventually offer—an answer. “Free Will” is a philosophical term of art for a particular sort of capacity of rational agents to choose a course of action from among various alternatives. Which sort is the free will sort is what all the fuss is about. (And what a fuss it has been: philosophers have debated this question for over two millenia, and just about every major philosopher has had something to say about it.) Most philosophers suppose that the concept of free will is very (...) closely connected to the concept of moral responsibility. Acting with free will, on such views, is just to satisfy the metaphysical requirement on being responsible for one's action. (Clearly, there will also be epistemic conditions on responsibility as well, such as being aware—or failing that, being culpably unaware—of relevant alternatives to one's action and of the alternatives' moral significance.) But the significance of free will is not exhausted by its connection to moral responsibility. Free will also appears to be a condition on desert for one's accomplishments (why sustained effort and creative work are praiseworthy); on the autonomy and dignity of persons; and on the value we accord to love and friendship. ABSTRACT The Frankfurt-style Counterexamples to the Principle of Alternative Possibilities have been controversial. I sketch some of the major moves in the debates surrounding the FSCs, and I seek to provide an answer to a big challenge: the indeterministic horn of the ‘dilemma defense’. Given indeterminism, it is unclear how Black can know with certainty what Jones will choose and do in the future; this leaves at least some open alternatives for Jones. I adopt the strategy of positing God in (...) Black’s place. The challenge now is to explain how God can have knowledge with certainty of future free human behavior in an indeterministic context, insofar as there is no entailing evidence in available in advance in such a situation. I present the Bootstrapping View of God’s knowledge to solve this problem. If we replace Black with God, we have an indeterministic case in which an agent acts freely, and yet cannot do otherwise. My account of God’s knowledge provides an interpretation of Luis de Molina’s notoriously obscure notion of Supercomprehension. (shrink)

While philosophers have worried about mental causation for centuries, worries about the causal relevance of conscious phenomena are also increasingly featuring in neuroscientific literature. Neuroscientists have regarded the threat of epiphenomenalism as interesting primarily because they have supposed that it entails free will scepticism. However, the steps that get us from a premise about the causal irrelevance of conscious phenomena to a conclusion about free will are not entirely clear. In fact, if we examine popular philosophical accounts of free will, (...) we find, for the most part, nothing to suggest that free will is inconsistent with the presence of unconscious neural precursors to choices. It is only if we adopt highly non-naturalistic assumptions about the mind (e.g. if we embrace Cartesian dualism and locate free choice in the non-physical realm) that it seems plausible to suppose that the neuroscientific data generates a threat to free will. Elsewhere, I proposed a libertarian-based account of freedom and moral blameworthiness which like Harry Frankfurt's 1969 account rejects the principle of alternative possibilities (which I call, Frankfurt-friendly libertarianism). In this paper I develop this account further (a) by responding to an important objection to it raised by Carlos Moya; (b) by exploring the question why, if unavoidability per se does not exonerate from blame, the Frankfurt-friendly libertarian is justified in exculpating an agent under determinism; (c) by arguing that some main (...) compatibilist alternatives to the account are unsatisfactory; and finally (d) by defending it against a general criticism of certain libertarian theories made by Derk Pereboom. There is an important but unorthodox view within the philosophy of action that when it comes to certain mental actions of a person—her decisions and choices—these actions cannot be caused by her beliefs and desires or by any prior event or state of her at all. The reason for this, it is said, is that there is something in the very nature of a person’s decisions and choices that entails that they cannot be caused in this way. The arguments for (...) this view, however, have largely gone unexamined. This paper, therefore, critically examines the arguments that have been proposed for this view. It concludes, however, that they are unpersuasive. There is, as yet, no good reason offered as to why we should think that decisions and choices must be uncaused by prior events or states of the agent. (shrink)

If we have libertarian free will, then it is plausible to believe that the occurrences of certain physical events have irreducible and ineliminable mental explanations. According to a strong version of naturalism, everything in the physical world is in principle explicable in nonmental terms. Therefore, the truth of naturalism implies that libertarian choices cannot explain the occurrences of any physical events. In this paper, I example a methodological argument for the truth of naturalism and conclude that the argument fails. I (...) then consider additional concerns raised against the reality of libertarian freedom. First, I examine the claim that if a physical event E is not causally determined to occur by another physical event, then there is no way to account for the difference between E’s occurring randomly and E’s being causally determined to occur by a mental event. Second, I consider the assertion that the affirmation of libertarianism is a mind-of-the-gaps version of the God-of-the-gaps objection to a divine explanation of a physical event. Third, I take up the question of whether the inability of libertarians to pinpoint precisely where the initial physical effects of libertarian choices occur is a good reason for rejecting libertarianism. Fourth, I examine the claim that belief in the existence of the soul or immaterial mind is the result of an explanatory hypothesis to account for how libertarian free choices can causally produce physical effects. Fifth, I look at the traditional objection to substance dualism from the impossibility of causal interaction between a soul and its body. (shrink)

Since our moral and legal judgments are focused on our decisions and actions, one would expect information about the neural underpinnings of human decision-making and action-production to have a significant bearing on those judgments. However, despite the wealth of empirical data, and the public attention it has attracted in the past few decades, the results of neuroscientific research have had relatively little influence on legal practice. It is here argued that this is due, at least partly, to the discussion on (...) the relationship of the neurosciences and law mixing up a number of separate issues that have different relevance on our moral and legal judgments. The approach here is hierarchical; more and less feasible ways in which neuroscientific data could inform such judgments are separated from each other. The neurosciences and other physical views on human behavior and decision-making do have the potential to have an impact on our legal reasoning. However, this happens in various different ways, and too often appeal to any neural data is assumed to be automatically relevant to shaping our moral and legal judgments. Our physicalist intuitions easily favor neural-level explanations to mental-level ones. But even if you were to subscribe to some reductionist variant of physicalism, it would not follow that all neural data should be automatically relevant to our moral and legal reasoning. However, the neurosciences can give us indirect evidence for reductive physicalism, which can then lead us to challenge the very idea of free will. Such a development can, ultimately, also have repercussions on law and legal practice. (shrink)

This open access book provides an exploration of the consequences of the ontological differences between natural and social objects (sometimes described as objects of nature and objects of thought) in the workings of causal and agency relationships. One of its important and possibly original conclusions is that causal and agency relationships do not encompass all of the dependent relationships encountered in social life. The idea that social reality is contingent has been known (and largely undisputed) at least since Wittgenstein’s “On (...) Certainty”, but social science, and most notably economics has continued to operate on the basis of causal and agency theories borrowed or adapted from the natural sciences. This volume contains essays that retain and justify the partial or qualified use of this approach and essays that totally reject any use of causal and agency theory built on determined facts (closed systems).The rejection is based on the possibly original claim that, whereas causation in the objects of the natural sciences reside in their properties, human action is a matter of intentionality. It engages with critical realist theory and re-examines the role of free will in theories of human action in general and economic theory in particular. (shrink)

In her recent book Causation and Free Will, Carolina Sartorio develops a distinctive version of an actual-sequence account of free will, according to which, when agents choose and act freely, their freedom is exclusively grounded in, and supervenes on, the actual causal history of such choices or actions. Against this proposal, I argue for an alternative- possibilities account, according to which agents’ freedom is partly grounded in their ability to choose or act otherwise. Actual-sequence accounts of freedom are motivated by (...) a reflection on so-called Frankfurt cases. Instead, other cases, such as two pairs of examples originally designed by van Inwagen, threaten actual-sequence accounts, including Sartorio’s. On the basis of her view of causation, Sartorio contends, however, that the two members of each pair have different causal histories, so that her view is not undermined by those cases after all. I discuss these test cases further and defend my alternative-possibilities account of freedom. (shrink)

The mental realm seems different to the physical realm; the mental is thought to be dependent on, yet distinct from the physical. But how, exactly, are the two realms supposed to be different, and what, exactly, creates the seemingly insurmountable juxtaposition between the mental and the physical? This review identifies and discusses five marks of the mental, features that set characteristically mental phenomena apart from the characteristically physical phenomena. These five marks (intentionality, consciousness, free will, teleology, and normativity) are not (...) presented as a set of features that define mentality. Rather, each of them is something we seem to associate with phenomena we consider mental, and each of them seems to be in tension with the physical view of reality in its own particular way. It is thus suggested how there is no single mind-body problem, but a set of distinct but interconnected problems. Each of these separate problems is analyzed, and their differences, similarities and connections are identified. This provides a useful basis for future theoretical work on psychology and philosophy of mind, that until now has too often suffered from unclarities, inadequacies, and conflations. (shrink)

Non-Causal Libertarianism (NCL) is a libertarian position which aims to provide a non-causal account of action and freedom to do otherwise. NCL has been recently criticized from a number of quarters, notably from proponents of free will skepticism and agent-causation. The main complaint that has been voiced against NCL is that it does not provide a plausible account of an agent’s control over her action, and therefore, the account of free action it offers is inadequate. Some critics (mainly agent-causationists) have (...) even gone so far as to claim that NCL does not offer a plausible account of action. My goal in this paper is to defend NCL against these charges. More specifically, I deal with Derk Pereboom's Disappearing-Agent-Objection, Peter van Inwagen's Mind Argument, and with two objections to NCL by Randolph Clarke. (shrink)

Helen Steward holds that an agent’s settling something does not require a conscious, full-fledged intention. Rather, sub-intentional acts can be instances of settling by the agent if that act is subordinated to the agent’s personal-level conscious systems. I argue that this position is mistaken, and that agential settling does in fact require a conscious intention. I argue for this claim by offering a case which on Steward’s position has counterintuitive implications. I consider a variety of ways in which Steward might (...) respond, and show how each response incurs serious dialectical burdens. I then propose my preferred view of agential settling which does not share the aforementioned counterintuitive claims. (shrink)

The hermeneutical tradition represented by Yorck, Heidegger, and Gadamer has distrusted Dilthey as suffering from the two sins of modernism: scientific “positivism” and individualistic and aesthetic “romanticism.” On the one hand, Dilthey’s epistemology is deemed scientistic in accepting the priority of the empirical, the ontic, and consequently scientific inquiry into the physical, biological, and human worlds; on the other hand, his personalist ethos and Goethean humanism, and his pluralistic life- and worldview philosophy are considered excessively aesthetic, culturally liberal, relativistic, and (...) subjective. This essay involves two tasks in response to this negative evaluation of Dilthey that has shaped our current understanding of his philosophical project; first, an interpretation of the issues at stake in Heidegger’s reception of and struggles with Dilthey. These issues touch upon language, historicity, and the nature of hermeneutics. Second, by pursuing this task in light of Guignon’s interpretation of Dilthey and Heidegger, I hope to question and challenge the “overcoming” of Dilthey’s epistemic and life-philosophical hermeneutics in the “ontological” or “philosophical” hermeneutics of Heidegger. According to the noncausal libertarian view of free will, in order for a person’s action to be free, it must be uncaused. A standard criticism of this view—the control objection—is that a person cannot have control over whether an uncaused action occurs and, so, such an action cannot be free. The background to this criticism is the claim that control over action is plausibly a causal rather than noncausal matter. In this paper, I defend noncausal libertarianism against the control objection (...) by developing a new noncausal theory of control. What emerges is not simply a defense of noncausal libertarianism against the control objection but a new theory of control more generally. (shrink)

This essay examines recent work on abilities to act. Different kinds of ability are distinguished, and a recently proposed conditional analysis of ability ascriptions is evaluated. It is considered whether abilities are causal powers. Finally, several compatibility questions concerning abilities, as well as the relation between free will and abilities of various kinds, are examined.

Proponents of modern Frankfurt-Style Counterexamples generally accept that we cannot construct successful FSCs in which there are no alternative possibilities present. But they maintain that we can construct successful FSCs in which there are no morally significant alternatives present and that such examples succeed in breaking any conceptual link between alternative possibilities and free will. I argue that it is not possible to construct an FSC that succeeds even in this weaker sense. In cases where any alternatives are clearly insignificant, (...) it does not appear at all obvious that the agent can be held responsible. Present popular FSCs include alternatives that are ambiguous in their significance, and when the examples are sharpened to remove this ambiguity, they lose their force. Moreover, the proponent of such examples faces a problem: We can easily construct scenarios in which any alternatives are obviously insignificant, and in such scenarios, we are not intuitively inclined to suppose the agent is responsible. The proponent of new FSCs must therefore distinguish any alternatives she includes from the sorts included in these scenarios. The difference must now be such that this helps to make it seem intuitively likely that the agent is responsible where the agent otherwise would not appear responsible, and these alternatives are irrelevant to any judgment about whether the agent is responsible. I maintain that it is impossible to achieve both of these goals at once. (shrink)

According to the libertarian view of free will, people sometimes act freely, but this freedom is incompatible with causal determinism. Goetz has developed an important and unusual libertarian view of free will. Rather than simply arguing that a person's free actions cannot be causally determined, Goetz argues that they cannot be caused at all. According to Goetz, in order for a person to act freely, her actions must be uncaused.1 My aim in this essay is to evaluate Goetz's “noncausal” libertarian (...) view of free will. In section 1, I outline Goetz's view. In section 2, I develop two criticisms of his view. In section 3, I develop an improved “positive” account of the noncausal view, which takes Goetz's metaphysical framework as its point of departure but is not subject to the criticisms that plague his development of this framework. Finally, in section 4, I respond to some objections to my proposed noncausal view. (shrink)

While William Hasker and I for the most part broadly agree in our opposition to much of the contemporary philosophical community concerning issues in the philosophy of mind that he discusses in his book, there are nevertheless seemingly some domestic disputes between him and me about certain matters concerning the nature of events involving the self. In this paper, I will focus on two of these disagreements. The first disagreement concerns Hasker’s treatment of what is widely known today as the (...) argument from reason and whether the events involved in our reasoning are essentially causal or teleological in nature. The second disagreement is about Hasker’s account of libertarian freedom, and whether agent causation is required to explain our free choices. (shrink)
