This essay proposes a design perspective on argumentation, intended as complementary to empirical and critical scholarship. In any substantive domain, design can provide insights that differ from those provided by scientific or humanistic perspectives. For argumentation, the key advantage of a design perspective is the recognition that humanity’s natural capacity for reason and reasonableness can be extended through inventions that improve on unaided human intellect. Historically, these inventions have fallen into three broad classes: logical systems, scientific methods, and disputation frameworks. (...) Behind each such invention is a specifiable “design hypothesis”: an idea about how to decrease error or how to increase the quality of outcomes from reasoning. As problems in contemporary argumentation practice become more complex, design thinking rises in relevance and importance. A design research agenda in argumentation would focus on theorizing design innovations and on evaluating design hypotheses. (shrink)

This paper argues that one problem that besets black-box AI is that it lacks algorithmic justifiability. We argue that the norm of shared decision making in medical care presupposes that treatment decisions ought to be justifiable to the patient. Medical decisions are justifiable to the patient only if they are compatible with the patient’s values and preferences and the patient is able to see that this is so. Patient-directed justifiability is threatened by black-box AIs because the lack of rationale provided (...) for the decision makes it difficult for patients to ascertain whether there is adequate fit between the decision and the patient’s values. This paper argues that achieving algorithmic transparency does not help patients bridge the gap between their medical decisions and values. We introduce a hypothetical model we call Justifiable AI to illustrate this argument. Justifiable AI aims at modelling normative and evaluative considerations in an explicit way so as to provide a stepping stone for patient and physician to jointly decide on a course of treatment. If our argument succeeds, we should prefer these justifiable models over alternatives if the former are available and aim to develop said models if not. (shrink)

An overview of the epistemological approach to argumentation, explaining what it is, justifying it as better than a rhetorical or a consensual ist approach.systematizing the main directions and theories according to their criteria for good argumentation and presenting their contributions to major topics of argumentation theory. Also. an introduction to the articles of the two special issues of Informal Logic about the epistemological approach to argumentation.

In this article, we argue for the general importance of normative theories of argument strength. We also provide some evidence based on our recent work on the fallacies as to why Bayesian probability might, in fact, be able to supply such an account. In the remainder of the article we discuss the general characteristics that make a specifically Bayesian approach desirable, and critically evaluate putative flaws of Bayesian probability that have been raised in the argumentation literature.

This paper provides a thorough analysis of two often informally stated claims. First, successful argumentation in the sense of persuasive argumentation requires agreement between the interlocutors about the rationality of arguments. Second, a general agreement about rationality of arguments cannot itself be established via argumentation, since such an attempt leads to an infinite meta‐regress. Hence, agreement about the rationality of arguments is a precondition for successful argumentation. As the paper argues, these plausible claims hold under the assumption that interlocutors are (...) subjectively rational and follow their own standards of rationality when engaging in argumentation. In this paper I challenge the currently fashionable view that we should assess the basic premises of an argument for acceptability rather than for truth, and argue in favour of recognizing premise-truth as a criterion of argument goodness in one important sense and premise-acceptability as a criterion of argument goodness in another important sense.

According to Thomas Nagel we have a natural impulse to transcend our personal point of view. However, it appears to be difficult to give this notion of transcendence any real content while maintaining a connection with everyday speech and behaviour. In this essay I show that the description of what happens in a discussion when a speaker convinces a listener suggests an interesting interpretation of transcendence. The notion of 'truth' linked to the listener who is being convinced introduces a normative (...) dimension in argumentation. This inescapable normative stance of the listener saddles her with the obligation to answer all credible objections against all arguments she has accepted. The evaluation of the arguments is not reserved for the participants of a discussion. Nothing more is required. For instance, the notion of a universal consensus has no place in the analysis of argumentation. If there is a universal dimension in argumentation and discussion, it is because there is no way of telling where convincing objections may come from. (shrink)

It is widely believed among philosophers and educated people that it is virtuous to be open-minded. Instead of thinking of open-mindedness as universally or unconditionally epistemically valuable, I argue that it is vital to explicate the conditions that must obtain if open-mindedness is to be epistemically valuable. This paper critically evaluates open-mindedness given certain realistic cognitive limitations. I present and analyse a simple mathematical model of open-minded decision-making that incorporates these limitations. The results are mixed. The bad news is that (...) the circumstances where open-mindedness is epistemically valuable may be more restricted than previously thought especially if individuals are incapable of properly evaluating the trustworthiness of sources or the content of received information. The good news is that, if individuals are mildly competent in evaluating the trustworthiness of sources and the content of received information, then there are many circumstances where open-mindedness is epistemically valuable. It is a virtue of virtue theory approaches to argumentation that they integrate many of the different factors that make arguments good arguments. The insights of virtue argumentation are brought to bear on a variety of versions of the requirement that good arguments must have good premises, concluding that a sincerity condition serves better than truth or assertability conditions, despite apparently counterintuitive consequences for arguments involving heterogeneous coalitions.

This essay addresses the collapse/incoherence problem for normative frameworks that contain both fundamental values and rules for promoting those values. The problem is that in some cases, we would bring about more of the fundamental value by violating the framework’s rules than by following them. In such cases, if the framework requires us to follow the rules anyway, then it appears to be incoherent; but if it allows us to make exceptions to the rules, then the framework “collapses” into one (...) that doesn’t make use of rules in the first place. The chapter begins with an examination of happiness and truth as fundamental values in Mill’s work, which lead into parallel versions of the collapse/incoherence problem in ethics and epistemology. It then sets out the collapse problem for rule-consequentialist approaches in ethics, truth-directed accounts of justification in epistemology, and epistemological approaches to argument cogency. The chapter closes with discussion of two potential solutions to the problem. (shrink)

My main concern in this paper is with Trudy Govier’s acceptability criterion for the adequacy of the premises of an argument considered independently of whether they are “properly connected” to the conclusion. I consider arguments she makes against the view that a good argument must have true premises, and I con-tend that a theory of argument could hold both that for an argument to be a good argument its premises must be true and that for it to be a good (...) argument relative to its audience, the audience must be epistemically justified in accepting its premises as true. This paper explores why respondents to a telephone public-opinion survey often give reasons for answering as they do, even though reason-giving is neither required nor encouraged and it is difficult to see the reasons as attempts to deal with disagreement. We find that respondents give reasons for the policy claims they make in their answers three times as frequently as they give reasons for value or factual claims, that their reasons tend to involve appeals to personal experience, and that they (...) often talk about their thought processes, especially when the evidentiary stakes are high. We then explore several ways of explaining these findings. We suggest that one useful approach is to see the reason-giving in the survey interviews as deliberative, reflexive argumentation of the sort described as `critical thinking. We further suggest that the reason such argumentation is often conducted out loud in the interviews, rather than internally, is that it functions in the service of rhetorical ethos, in particular the need to display the fact that one is human, with human autonomy and agency. Doing this may be particularly important in contexts such as anonymous survey interviews in which people are at risk of being treated like machines. (shrink)

This work investigates intuitions' nature, demonstrating how philosophers can best use them in epistemology. First, the author considers several paradigmatic thought experiments in epistemology that depict the appeal to intuition. He then argues that the nature of thought experiment-generated intuitions is not best explained by an a priori Platonism. Second, the book instead develops and argues for a thin conception of epistemic intuitions. The account maintains that intuition is neither a priori nor a posteriori but multi-dimensional. It is an intentional (...) but non-propositional mental state that is also non-conceptual and non-phenomenal in nature. Moreover, this state is individuated by its progenitor, namely, the relevant thought experiment. Third, the author provides an argument for the evidential status of intuitions based on the correct account of the nature of epistemic intuition. The suggestion is the fitting-ness approach: intuition alone has no epistemic status. Rather, intuition has evidentiary value as long as it fits well with other pieces into a whole, namely, the pertinent thought experiment. Finally, the book addresses the key challenges raised by supporters of anti-centrality, according to which philosophers do not regard intuition as central evidence in philosophy. To that end, the author responds to them, showing that they fail to affect the account of intuition developed in this book. This text appeals to students and researchers working in epistemology. On one account, the moral point of view is impartial, hence in this sense objective. On a different account, morality sometimes seems to recommend partiality, hence, in one sense of 'partiality,' bias. Still another view says that in some cases morality is neutral between impartiality and partiality in choosing between alternative actions. My main concern will be with impartiality and partiality in relation to arguments of the kind presented in first-order ethical argumentation. Part of my discussion will focus on one (...) type of theory of practical reasons; theories of this type are objective in as much as they hold that practical reasons are based on values that are objective in the sense of being mind-independent. I will refer to selected philosophers, including Wayne Sumner, Russ Shafer-Landau, Derek Parfit and Peter Singer. (shrink)

Most studies of reason-giving have focussed on formal, planned situations rather than on how reason-giving functions in relatively unplanned discourse. This study looks at reason-giving by respondents to an anonymous telephone public-opinion survey, e xploring the relationship between fact, policy, and value claims and the types of reasons used to support those claims. The results resonate with two important areas in argumentation theory: argument fields and critical thinking. Further, I suggest that reason-giving can serve as a method for individuals to (...) present themselves as human and thoughtfully reasonable. (shrink)

In a 2006 paper I claimed that the virtue arguments or inferences must have is not that they be truth-preserving, but that they be entitlement-preserving. I offered two reasons there why such a conception of argument virtue is needed for a satisfactory treatment of defeasible arguments and inferences. This paper revisits that claim, and assesses the prospects for a more thorough defence than was offered in that paper.
