This article will present the argument for treating democratic states as moral and not only legal collective entities; that is, it will apply the theory of collective rights of cultural groups in a (closed) domestic political setting to democratic states in international relations. Numerous experiences by self-identifying cultural groups bear witness to the fact that morally important objectives are not always reached by merely treating individuals as the sole bearers of moral status. In order to prevent latent cultural imperialism, many (...) countries around the world have adopted various models of collective rights protection and policies of preferential treatment for these groups. This article will examine whether it is possible to make a parallel between cultural groups and democratic states; in particular, whether it is feasible to think of democratic states as moral entities and what the normative implications of such a view for contemporary international relations and trade would be. The concept of group moral responsibility is apparently problematic, in that it is unobvious in what sense a group, which is evidently not a conscious rational subject like an individual person, can be held morally accountable. It is unclear how a group can be said to have the ability to form beliefs and intentions needed for genuine group actions of moral assessment. Broadly speaking, there are two separate platforms from which one can investigate this problem: individualism and collectivism. Subscribing to (...) the doctrinal position of methodological individualism, individualists suggest that individual members are the only capable entities, who can meaningfully bear the burden of moral responsibility, either individually or in a shared way. Collectivists, on the other hand look for an alternative position wherein they advocate the genuine possibility of attributing moral responsibility to groups qua groups. The collectivist approach has received substantial philosophical attention in recent years. However, most supporters of collectivism search for such possibility without strongly invoking the idea of group moral agency. In this article, I argue for an irreducible moral agential status of groups in terms of the intentional actions of their constituent individual members and their special conglomeration. I suggest that certain collective or group entities are capable of being identified as proper agents of moral assessment analogous to that of individual agents of similar assessment. (shrink)

This paper deals with the relationship between legal responsibility and causation. I argue that legal responsibility is not necessarily rooted in causation. The general claim I aim to disprove is that responsibility is descriptive because it is fundamentally rooted in causality, and causality is metaphysically real and founded. My strategy is twofold. First, I show (in §1) that there are significant and independent non- causal form of responsibility that cannot be reduced to causal responsibility; second, in §2, I show that (...) the very notion of causality is— lato sensu—not plainly descriptive. I will suggest that even causation is tied to evaluative elements, contrary to what is assumed by many theorists and practitioners working in normative domains. (shrink)

BackgroundPublic involvement activities are promoted as measures for ensuring good governance in challenging fields, such as biomedical research and innovation. Proponents of public involvement activities include individual researchers as well as non-governmental and governmental organizations. However, the concept of ‘public’ in public involvement deserves more attention by researchers because it is not purely theoretical: it has important practical functions in the guidance, evaluation and translation of public involvement activities.DiscussionThis article focuses on collective agency as one property a public as a (...) small group of participants in a public involvement activity could exhibit. It introduces a prominent theoretical approach to collective agents as one specific kind of social entities and demonstrates how this approach can be applied to current practice in public involvement activities. A brief discussion of different types of representation as they are used in the existing literature on this topic is also included because representation and collective agency can be closely related to each other. Suggestions and ideas that are derived from this reasoning include the proposal to use a ‘validity check’ for the generation of collective agents as a regular element of certain types of public involvement activities, the consequences of combining collective agency and representativeness as a further property a public could exhibit, and standards for reporting the content of public involvement activities in scientific publications.SummaryThis article discusses the importance of the concept of ‘public’ in public involvement activities, with a focus on biomedical research and innovation.
