  1. Herder on esthetic imagination as a source of post-national democratic solidarity: A contribution to Habermas|[rsquo]| constitutional patriotism.Mihaela Czobor-Lupp - 2013 - Contemporary Political Theory 12 (1):46.
Constitutional patriotism has been criticized for providing too thin an identity as the ground for common citizenship. Answering this criticism, Habermas recently stressed the role of affective attachments in creating constitutional patriotic bonds. Still, an account of the type of imagination that could foster such post-national affective attachments is lacking. Drawing on Herder's conception of political culture, I argue that constitutional patriotism requires a modern form of mythology. This would include narratives that shape people's imaginative capacity to see their own (...)

  • Neo-fascist legal theory on trial: An interpretation of Carl Schmitt's defence at nuremberg from the perspective of Franz Neumann's critical theory of law.Michael Salter - 1999 - Res Publica 5 (2):161-193.
This article addresses, from a Frankfurt School perspective on law identified with Franz Neumann and more recently Habermas, the attack upon the principles of war criminality formulated at the Nuremberg trials by the increasingly influential legal and political theory of Carl Schmitt. It also considers the contradictions within certain of the defence arguments that Schmitt himself resorted to when interrogated as a possible war crimes defendant at Nuremberg. The overall argument is that a distinctly internal, or “immanent”, form of critique (...)

  • Did Habermas Cede Nature to the Positivists?Gordon R. Mitchell - 2003 - Philosophy and Rhetoric 36 (1):1-21.
In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Rhetoric 36.1 (2003) 1-21 [Access article in PDF] Did Habermas Cede Nature to the Positivists? Gordon R. Mitchell Jürgen Habermas's "colonization of the lifeworld" thesis (1987, 332-73) posits that many of society's pathologies are due to the tendency of institutions to convert social issues that ought to be sorted out by a debating citizenry into technical problems ripe for resolution by expert bureaucracies, thus pre-empting important public (...)

  • Rawls in Germany.Jan-Werner Müller - 2002 - European Journal of Political Theory 1 (2):163-179.
This article analyses the reception of John Rawls's thought by Otfried Höffe, Jürgen Habermas and other political theorists on the German liberal left. It argues that, ironically, as Rawls's theory has become more historically self-conscious and sociologically oriented since A Theory of Justice, Habermas, while denying any fundamental difference between him and Rawls in this `neo-Kantian family quarrel', has moved in the opposite direction. One might even say that there has been some mid-Atlantic convergence in political theory. Nevertheless, there remain (...)

  • Communication, Context, and Narrative.Navid Hassanzadeh - 2021 - Theoria 68 (166):31-59.
Although often cast by realists as an exemplar of moralist or rationalist thinking, Jürgen Habermas and certain commentators on his work reject this characterisation, highlighting elements of his thought that conflict with it. This article will examine dimensions of Habermas’s work that relate to many realist concerns in political theory. I argue that while he escapes the commonplace caricature of an abstract thinker who is inattentive to real world affairs, Habermas’s claims in relation to communication, historical and empirical context, and (...)
