In the understanding of Habermas, "right" in the phrase "human rights" is a legal concept, where human rights are legal rights, i.e., legal norms declared in acts of foundations of the State or announced conventions of international law and/or State constitutions. By conceiving of rights in this way and by treating human rights in a threefold approach (placing them between morals, law and politics), he presents different theoretical definitions of human rights. This paper presents a systematic exposition of these definitions, and focuses on the different problems that motivated Habermas to change and expand his conceptions of human rights. (shrink)

Against the background of worldwide, intentional or unintentional everyday violations of human dignity and the epochal need to experience oneself as a human being in one’s specific way of being, this article attempts to pursue the question of human dignity and its concealment. On the one hand, it seeks to ask whether human dignity has become obsolete due to social and epochal developments and preconditions and whether it can only appear and be experienced as antiquated in the context of a (...) technological language or an administered world. On the other hand, it asks whether ethical and anthropological thinking have not sufficiently experienced, thought, and conceptualized man. From the context of these perspectives that determine the question of dignity, Heidegger’s article seeks to take up Heidegger’s repeated search for an original ethics based on Heraclitus’ fragment 119, and from this point of view to ask for a perhaps deeper and more adequate understanding of human dignity. At the centre of this is Heidegger’s thesis that human dignity is based on the protection of the unhidden and, ever before, the hiddenness of all beings. Without wanting to ignore the difficulty and complexity of Heidegger’s thinking, the author seeks to find access to this understanding of our dignity based on the experience of personal encounters. Durch genomweite Analysen werden vielfältige gesundheitsrelevante Informationen über eine Person gewonnen. Solche Informationen können die Behandlung von Krankheiten verbessern. Sie ermöglichen aber auch Vorhersagen, ob eine Person und deren Verwandte in Zukunft möglicherweise erkranken werden. Der neuartige Charakter des Informationseingriffs und sein prädiktive Potential bedürfen der ethischen, juristischen und ökonomischen Reflexion, damit diese Technologie zum Wohl der Patienten, der Familienangehörigen und der Solidargemeinschaft eingesetzt werden kann. Die vorliegende Schrift leistet mit ihren interdisziplinären, vom BMBF finanzierten Analysen dazu einen Beitrag. Grundlagen (...) für einen ethisch und juristisch verantwortbaren Einsatz der Genomsequenzierung zu medizinischen Zwecken werden erörtert und Eckpunkte für Kostenanalysen sowie Elemente einer “Guten klinischen Praxis” präsentiert. Responding to Derrida's Death Penalty Seminar of 1999–2000 and its interpretation by Michael Naas, in this paper I argue that Derrida's deconstruction of the theologico-political concept of the sovereign right over life and death in view of abolishing capital punishment should be understood in terms of the unconditional renunciation of sovereignty that dominates Derrida's later political writings, Rogues (2005) in particular. My reading takes seriously what I call the functional need for a “theological” moment in sovereignty beyond a merely historicist (...) or genealogical interpretation of the European monotheistic heritage. Further, I ask how Derrida can follow through on his goal of developing the allegedly first principled philosophical stance against capital punishment. To this end, I assemble some ingredients of this complex but “unconditional” abolitionism, one that doubts our comprehension of and active relation to death to the point of questioning the commonsense distinctions among murder, suicide, and legal putting to death. I conclude that, for Derrida, letting another die of hunger or AIDS may be understood as a form of a death sentence, so that a deconstructive abolitionism leaves no room for the development of a good conscience. In 2009, with the enactment of the Lisbon Treaty, the Charter of Fundamental Rights of the European Union entered into force. Under Article 8 of the Charter, for the first time, a stand-alone fundamental right to data protection was declared. The creation of this right, standing as a distinct right to the right to privacy, is undoubtedly significant, and it is unique to the European legal order, being absent from other international human rights instruments. This commentary examines the parameters of (...) this new right to data protection, asking what are the principles underpinning the right. It argues that the right reflects some key values inherent in the European legal order, namely: privacy, transparency, autonomy and nondiscrimination. It also analyses some of the challenges in implementing this right in an era of ubiquitous veillance practices and Big Data. (shrink)
