This article focuses on the interrelationship of law and life in human rights. It does this in order to theorize the normative status of contemporary biopower. To do this, the case law of Article 2 on the right to life of the European Convention on Human Rights is analysed. It argues that the juridical interpretation and application of the right to life produces a differentiated governmental management of life. It is established that: 1) Article 2 orients governmental techniques to lives (...) in order to ensure that both deprivation and protection of lives is lawful; 2) A proper application of Article 2 grounds itself on a proper discrimination of lives which causes Article 2 to be applied universally but not uniformly to all juridical subjects; 3) The jurisprudence of Article 2 is theoretically appreciable only in a ‘politics of life’. Finally, the article ends with a plea to analyse other fundamental human rights in the context of ‘biopolitical governmentality’. (shrink)

„Kann das Anthropozän gelingen?" Der Begriff „Anthropozän" fungiert in aktuellen Debatten als Chiffre für eine mehrfache Krise. Empirisch wird der Begriff verwendet, um den von Menschen verursachten Bruch mit dem stabilen Zeitalter des Holozäns zu bezeichnen. Normativ wird er gebraucht, um zu Neuanfängen aufzufordern: beim Verständnis und bei der praktischen Ausgestaltung menschlicher Verhältnisse zur Natur. Zugleich gerät der Begriff zunehmend selbst in die Kritik: dass er mit seinem Bezug auf ‚den Menschen‘ die tatsächlichen Verantwortlichkeiten für die aktuellen Natur- und Klima-Katastrophen (...) verdecke. Der Band macht sich das Schillern des Anthropozän-Begriffs zunutze. In interdisziplinärer Perspektive – aus der Philosophie, Theologie, Geographie, sowie den Literatur-, Politik-, Sozial- und Klimawissenschaften – verbindet er kritische und affirmativ-konstruktive Debatten: Welche Menschenbilder, Motive, Macht- und Gewaltstrukturen bestimmen die gesellschaftlich vorherrschenden Naturverhältnisse? Was wären alternative Vorstellungen des menschlichen Lebens mit der Natur als Teil der Natur? Wie sind die Praktiken der Nachhaltigkeit zu beurteilen, die von den Regierungen, auf dem kapitalistischen Markt und in der Zivilgesellschaft gebahnt werden? (shrink)

It is well-known that as a term, Nietzsche’sÜbermenschderives from Lucian of Samosata’shyperanthropos. I argue that Zarathustra’s teaching of the overman acquires new resonances by reflecting on the context of that origination from Lucian’sKataplous– literally, “sailing into port” – referring to the soul’s journey (ferried by Charon, guided by Hermes) into the afterlife. TheKataplous he tyrannos, usually translatedDownward Journey or The Tyrant, is a Menippean satire of the “overman” who is imagined to be superior to others of “lesser” station in this-worldly (...) life and the same tyrant after his (comically unwilling) transport into the underworld. As a reflection on the life and the death of Zarathustra, this essay also explores the politics of kingship for Empedocles as reformer in terms of Hölderlin’s Death of Empedocles and Nietzsche’s unpublished drafts on the same topic. InThus Spoke Zarathustra, Nietzsche points to a perspective beyond the here and now, including the “values” of our all-too-worldly and all-too-human concerns, no matter whether in terms of perceived political/economic advantage, or indeed in the pursuit of more trivial satisfactions. The paper presents a comparative analysis of the evolution of the legislative process concerning ART in the specific cultural, societal and political contexts of two countries- Slovakia and Germany. Our analysis is based on 1. mapping the variety of discourses on ART in order to gain an understanding of the perspectives of the main actors and their arguments; and on 2. exploring the reasons for the differences in the current regulation of ART among European Union member states. In both Slovakia (...) and Germany we found there was a deficit of democratic legitimacy, because the arguments and experiences of those primarily affected by the restrictive measures on the use of ART in medical care-infertile women and men-are not taken into consideration with any seriousness. On the contrary, government and legislators pay too much attention to the ethical opinions of the Catholic Church. Government intervention in Germany is highly problematic because there is no sufficient justification of the reasons behind restrictions on parental autonomy and the procreative freedom of women and men. Moreover, the restrictions are not consistent across an array of similar cases and are not applied equally to all. Instead of an interventionist approach which protects the embryo against its own potential mother, it would be more sensible to adopt the “women-centered” approach already suggested by several authors. It holds that both the mother and embryo have to be at the centre of bioethical and legal considerations, instead of there being an exclusive reliance on ethical principles and expert opinions with regard to the embryo alone. Contemporary capitalism is in effect, if not in intent, Deleuzian. As a network of networks, it is rhizomatic, flexible, chaosmotic, evolving, expanding. In the negativist spirit that characterizes the work of the Frankfurt School, this article shows via an analysis of the goverment of the self, the commodification of culture and the modification of nature, how contemporary capitalism does colonize not only the life-world but also life itself.
