    This paper discusses the impact of the so-called war on terrorism on civil liberties. The United States government in Madison’s plan was to be distrusted and hemmed in to protect citizens against it. The terrorist attacks of 2001 have seemingly licensed the US government to violate its Madisonian principles. While the current government asks for citizen trust, its actions justify distrust.     Our attitude to official apologies is paradoxical.     This article explores an alternative to the established dichotomy between philosophical accounts of human rights, characterized by a foundationalist tendency, and political accounts of human rights, which aspire to be non-foundationalist.     Cognitivism about trust says that it requires belief that the trusted is trustworthy; non-cognitivism denies this. At stake is how to make sense of the strong but competing intuitions that trust is an attitude that is evaluable both morally and rationally.
