  1. The Embedded Epistemologist: Dispatches from the Legal Front.Susan Haack - 2012 - Ratio Juris 25 (2):206-235.
In ordinary circumstances, we can assess the worth of evidence well enough without benefit of any theory; but when evidence is especially complex, ambiguous, or emotionally disturbing—as it often is in legal contexts—epistemological theory may be helpful. A legal fact-finder is asked to determine whether the proposition that the defendant is guilty, or is liable, is established to the required degree of proof by the [admissible] evidence presented; i.e., to make an epistemological appraisal. The foundherentist theory developed in Evidence and (...)

  • Concerning the Epistemology of Design: The Role of the Eco-Cognitive Model of Abduction in Pragmatism.Alger Sans Pinillos & Anna Estany - 2023 - Philosophies 8 (2):33.
Design has usually been linked to art and applied in scenarios related to everyday life. Even when design has, on occasion, made its way into the world of academia, it has always been closely linked to art and scenarios related everyday life. At last, however, the idea of design has reached the field of epistemology: an area within the very heart of philosophy that has always focused, in theory, on the foundations of knowledge. Consequently, design is being studied from different (...)

  • Doubt: Affective States and the Regulation of Inquiry.Christopher Hookway - 1998 - Canadian Journal of Philosophy, Supplementary Volume 24 (sup1):203-225.
Pragmatists challenge a sharp separation of issues of theoretical and practical rationality. This can encourage a sort of anti-realism: our classifications and theories are shaped by our interests and practical concerns. However, it need not do this. A more fundamental theme is that cognition is itself an activity, the attempt to solve problems and discover truths effectively and responsibly. Evidence has to be collected, experiments have to be devised and carried out, dialogues must be engaged in with fellow inquirers, decisions (...)

Evolutionary theory is becoming an all-encompassing form of explanation in many branches of philosophy. However, emergence theory uses the concept of self-organization to support yet alter traditional evolutionary explanation. Biologist Stuart Kauffman suggests that the new science will need to tell stories, not simply as a heuristic device but as part of its fundamental task. This claim is reminiscent of C. S. Peirce’s criticism of the doctrine of necessity. Peirce’s suggestions reference Hegel, and this essay draws out this Hegelian background. (...)

  • On Logic in the Law: "Something, but not All".Susan Haack - 2007 - Ratio Juris 20 (1):1-31.
In 1880, when Oliver Wendell Holmes (later to be a Justice of the U.S. Supreme Court) criticized the logical theology of law articulated by Christopher Columbus Langdell (the first Dean of Harvard Law School), neither Holmes nor Langdell was aware of the revolution in logic that had begun, the year before, with Frege's Begriffsschrift. But there is an important element of truth in Holmes's insistence that a legal system cannot be adequately understood as a system of axioms and corollaries; and (...)

  • Stances and Skills to in-Habit the World: Pragmatic Agnosticisms and Religion.Ulf Zackariasson - 2024 - Philosophies 9 (3):57.
This paper explores two routes along which a pragmatic philosophical approach can contribute to reflections on agnosticism. The first of these approaches is developed in dialogue with William James, and it is oriented towards the needs and obligations of individuals and the extent to which agnosticism affects our abilities to lead strenuous lives. The second is developed in dialogue with Richard Rorty. It is oriented towards how agnosticisms can be adopted within particular vocabularies vis-a-vis other vocabularies as a pragmatically helpful (...)

I am honoured and pleased to address you this evening on the life and work of an extraordinary American thinker, Charles Sanders Peirce. Although Peirce is perhaps most often remembered as the father of the philosophical movement known as pragmatism, I would like to impress upon you that he was also, and perhaps, especially, a logician, a working scientist and a mathematician. During his life time Peirce most often referred to himself, and was referred to by his colleagues, as a (...)

This paper explores the intertwinement of ontology and history that happened after the idealist turn of Kantian transcendentalism, particularly in classic German idealism and later in American pragmatism. The paper focuses on the less remarked-upon consequence of this intertwinement, namely the possibility of a new reading of history based on changes in concepts and habitual mentality. The paper proposes a new take on historiography that vindicates Hegel’s insight but changes his approach to a pragmatist one, more apt to face historical (...)

Depictive expressions of thought predate written language by thousands of years. They have evolved in communities through a kind of informal user testing that has refined them. Analyzing common visual communications reveals consistencies that illuminate how people think as well as guide design; the process can be brought into the laboratory and accelerated. Like language, visual communications abstract and schematize; unlike language, they use properties of the page (e.g., proximity and place: center, horizontal/up–down, vertical/left–right) and the marks on it (e.g., (...)

Ontology is a part of metaphysics; it concerns what there is. Is it possible to consider being and reality not in a traditional metaphysical way—that is, not as a ground, an origin, a cause, but as a movement, a flux, a dynamogenic principle? I will set out from a seminal aphorism by Nietzsche, occurring in Human, all too Human (§2): “A lack of the historical sense is the hereditary fault of all philosophers. But everything has evolved; there are no eternal (...)

We argue that no attempt of reducing meaning to a systematic set of rules, according to which the role of linguistic expressions is to be normatively defined, can be abstracted from an irreducibly decisional compound. By comparing Lorenzen’s project of building an Ortho-languageand Brandom’s inferentialist take on meaning, we distinguish two ways of acknowledging this fact, while claiming that Lorenzen’s take is more genuinely constructive, insofar as choices be thought of as genuine features of constructions. It brings into a new (...)

  • The pluralistic universe of law: Towards a neo-classical legal pragmatism.Susan Haack - 2008 - Ratio Juris 21 (4):453-480.
After a brief sketch of the history of philosophical pragmatism generally, and of legal pragmatism specifically (section 1), this paper develops a new, neo-classical legal pragmatism: a theory of law drawing in part on Holmes, but also on ideas from the classical pragmatist tradition in philosophy. Main themes are the "pluralistic universe" of law (section 2); the evolution of legal systems (section 3); the place of logic in the law (section 4); and the relation of law and morality (section 5).
