The aim of this master’s thesis is to analyse and highlight the interaction between science, politics and law. More precisely, our research question concerns the use of scientific arguments in social spheres (notably in politics and law) instead of legal or political arguments. In fact, we want to raise the way in which certain actors invoke scientific arguments to impose "objective" elements of fact in debate and, in this way, refrain from politically and "subjectively" discussing these same elements (or, at (...) least, their social consequences). This Master’s thesis will adopt an interdisciplinary theoretical framework (chapter 1) mobilising philosophy of science, philosophy of law, sociology of law, legal technique and analytical theories. Then, we will apply it to a case study: the European regulation of genetically modified organisms (GMOs) after the European Court of Justice (CJEU) ruling of 25 July 2015 (chapter 2). The first chapter will provide theoretical elements to rethink the interaction between science, politics and law. The first section will propose a 'state of the art’ of the philosophical literature on the relationship between science (as a regime of truth) and politics. This master’s thesis will assess a truth under construction rather than a transcendental truth. Section 2 anticipates authoritarian claims based on science by considering the relationship science can have with power (Foucault). A solid review of philosophical, sociological and legal literature highlights the risks of giving decision-making power to an all-powerful science. Notably, the use of science to justify discriminatory policies is emphasised as these policies could not be challenged because, at the time, it was considered an objective scientific truth. Finally, section 3 offers a critique of the narratives of neutral and objective science, through the approach of science in action. This sociological approach presented all the doubts and subjectivity of science in action. The second chapter will propose a case study to illustrate the theoretical framework. We have chosen GMOs because they constitute a hybrid 'event', marked by scientific controversies, and with major socio-economic implications. The legal framework of GMOs in the European Union will be presented in the first section. In addition, the legal status of new breeding techniques (NBTs) will be examined. The second section will analyse the ruling of the European Court of Justice which made NBTs subject to GMO regulation. Finally, the third section will propose a reflection on the philosophy of law on the modes of existence of scientific, legal and political disciplines. (shrink)

While classical neo-positivists reject any role for traditionally understood values in science, Kuhn identifies five specific values as criteria for assessing a scientific theory; this approach has been further developed by several other authors. This paper focuses on Helen Longino, who presents a significant contemporary critique of Kuhn’s concept. The most controversial aspect of Longino’s position is arguably her claim that the criterion of empirical adequacy is the least defensible basis for assessing theories. The de-emphasizing of the importance of external (...) consistency as a value and the introduction of socio-political considerations into the processes of an assessment of scientific theories are also considered problematic issues. I provide arguments against Longino’s conception, identify some of its problems, and argue for refusal of her approach. (shrink)

I examine a problem or dilemma of legitimation faced by the critical theorist who takes as the object of his or her critique a totality of which she or he is a part. The dilemma is that the theorist must either illegitimately exempt her critical theory from the determining influences of the totality or lose normative authority. The critics I examine in detail are: Adorno and Horkheimer; Kant; Hegel; feminist standpoint epistemologists, in particular, Sandra Harding; Irigaray; Foucault; and Arendt. ;I (...) conclude that a purely theoretical or epistemic ground for the legitimacy of totalizing critique is impossible; philosophical critique must involve an extra-rational faith or a political commitment. However, I also argue that the project of theoretical grounding should not be abandoned. I continue this project by drawing out of the critical theorists I examined some preliminary concepts and strategies that may, after further development, serve to provide a theory of the legitimacy of critical philosophy. Biology is instrumental in establishing and perpetuating societal norms of gender and sexuality, owing to its afforded authoritative role in formulating beliefs about what is “natural”. However, philosophers, historians, and sociologists of science have shown how conceptions of gender and sexuality pervade the supposedly objective knowledge produced by the natural sciences. For example, in describing animal relationships, biologists sometimes use the metaphor of marriage, which brings with it conceptions of both cuckoldry and male ownership of female partners. These conceptions have (...) often led researchers to overlook female behavior and adaptations, such as female initiation of mating. Such social norms and ideologies influence both theories and research in biology. Social norms of gender and sexuality also influence school cultures. Although awareness of gender issues has had a major impact in Sweden during recent years, the interventions conducted have been based on a heteronormative understanding of sex; this has rendered sexual norms a non-prioritized issue and thereby rendered non-heterosexuals invisible in teaching and textbooks. Since this research was published in 2007 and 2009, norm critical pedagogics have been included in the Swedish National Agency for Education’s guidelines for teaching. This inclusion represents one way to tackle the recurring problem of heterosexuality being described as a naturalized “normal” behavior and homosexuals, bisexuals and transsexuals being described from a heteronormative perspective. In this paper, I employ gender and queer perspectives to scrutinize how animal sexual behavior is described and explained in Swedish biology textbooks. The analysis is based in gender and queer theory, feminist science studies, and evolutionary biology. The article begins with an outline a discussion of my theoretical framework, relating gender and queer perspectives on evolutionary biology to a discussion of queer methodology. I then scrutinize some empirical examples drawn from five contemporary biology textbooks used in secondary schools (by students aged 16-18 years old). Finally, I discuss the implications of the textbooks’ representations of animal sexual behavior, the problems of and need for a “textbook-version”, and providing examples of what an inclusive approach to biology education might look like. Many think that evolutionary biology has relevance to ethics, but how far that relevance extends is a matter of debate. It is easy to show that pop sociobiological approaches to ethics all commit some type of naturalistic fallacy. More sophisticated attempts, like Donald Campbell's, or, more recently, Robert Richards', are not so easily refuted, but I will show that they too reason fallaciously from facts to values. What remains is the possibility of an evolutionary search for human nature. Unfortunately, evolutionary (...) theory itself seems to imply that the quest for human nature will not be very promising. As far as there is such a thing as human nature, we will have to know it before we can meaningfully talk about its evolution. Anthropological data suggest that we differ widely in our normative judgments. And even where we seem to agree, there is good reason to doubt that we really do so. (shrink)

Applying social construction theory to the study of other animals, this article reports research conducted on ecotourist constructions of orangutans. Two "stories" dominated: Orangutan as Child and Orangutan as Pristine. The cultural and historical specificity of these constructs as well as their implications for conservation are discussed.

What does feminism have to do with nanotechnology? And how do mad scientists demonstrate the connections between the two? To explore this, I examine a case study of mad scientists in film, discussing first why mad scientist images arise and why nanotechnology, or the manipulation of matter on the atomic and molecular scales, may be particularly vulnerable to this kind of representation. National funding agencies are calling for the integration of ethics and societal implications into nanoscience and technology research and (...) the training of future scientists and engineers. This paper builds upon recent work in narrative theory and the philosophy of technology by examining the place of transparency and responsibility in discussions of AI, and what some of the implications of this might be for thinking ethically about AI and especially AI practices, that is, the structured social activities implicating and defining what AI is. In this paper, we aim to show how pursuing a narrative understanding of technology and AI can support knowledge of process and practice through (...) transparency, as well help summon us to responsibility through visions of possibility and of actual harms arising from AI practices. We provide reflections on the relations between narrative, transparency and responsibility, building an argument that narratives (about AI, practices, and those persons implicated in its design, implementation, and deployment) support the kind of knowing and understanding that is the aim of transparency, and, moreover, that such knowledge supports responsibility in informing agents and activating responsibility through creating knowledge about something that can and should be responded to. Furthermore, we argue for considering an expansion of the kinds of practices that we might legitimately consider ‘AI practices’ given the diverse set of (often materially embedded) activities that sustain and are sustained by AI that link directly to its ethical acceptability and which are rendered transparent in the narrative mode. Finally, we argue for an expansion of narratives and narrative sources to be considered in questions of AI, understanding that transparency is multi-faceted and found in stories from diverse sources and people. This article seeks to open up a new avenue for feminist technology studies—gender-aware research on engineers and engineering practice—on the grounds that engineers are powerful symbols of the equation between masculinity and technology and occupy significant roles in shaping new technologies. Drawing on the disparate evidence available, the author explores four themes. The first asks why the equation between masculinity and technology is so durable when there are such huge mismatches between image and practice. The second examines this mismatch in (...) the detail of engineering knowledge and practice to reveal that fractured and contradictory constructions of masculinity frequently coexist. The third theme addresses the suggestion that women and men might bring different styles to engineering. Finally, the author explores subjective experiences of engineering to argue that engineers’ shared pleasures in and identification with technology both define what it means to be an engineer and provide appealing symbols of power that act to compensate for a perceived lack of power or competence in other arenas. Feminist philosophers of biology bring the tools of feminist theory, and in particular the tools of feminist philosophy of science, to investigations of the life sciences. While the critical examination of the categories of sex and gender (which will be explained below) takes a central place, the methods, ontological assumptions, and foundational concepts of biology more generally have also enjoyed considerable feminist scrutiny. Through such investigations, feminist philosophers of biology reveal the extent to which the theory and practice of particular (...) scientific disciplines and research programs (and, indeed, their philosophical study) are intertwined with both value judgments and social hierarchies.
