This paper examines the proposition advanced by Sunstein and other scholars that political online forums tend to be characterized by in-group homogeneity and group polarization. The paper adopts a process view of online forums and examines discussions within a time perspective. Five discussion lines on Climategate.nl are investigated. The research focuses on how participants react to the participation of dissidents and on the resulting processes of inclusion and exclusion. Climategate.nl moved in the direction of an ‘echo chamber’ gradually over time. (...) Nevertheless, the forum was never completely homogeneous. The editors played an active role in the inclusion and exclusion of dissidents. A counter-steering moderation policy is needed to keep group polarization and homogenization within certain limits. The normative and metanormative pluralism that figures among core self-descriptions of democratic theory, which seems incompatible with democratic theorists’ practical ambitions, may stem from the internal logic of research traditions in the social sciences and humanities and in the conceptual structure of political theory itself. One way to deal productively with intradisciplinary diversity is to appeal to the idea of a meta-consensus; another is to appeal to the argument from cognitive diversity that fuels recent debates on epistemic democracy. Some critics raise moral objections against corporate social responsibility on account of its supposedly undemocratic nature. Theyargue that it is hard to reconcile democracy with the private discretion that always accompanies the discharge of responsibilities that are not judicially enforceable. There are two ways of constructing this argument: the “perfect-market argument” and the “social-power argument.” This paper demonstrates that the perfect-market argument is untenable and that the social-power argument is sometimes valid. It also asserts that the proponents of the perfect-market (...) argument are mistaken in their assumption that perfect markets are conducive to democracy. There are strong reasons to hold that perfect markets are undesirable from a democratic point of view. A proper conceptualization and differentiation of the relation between “the private and the public” can make this clear. The proponents of the social-power argument sometimes maintain that the democratic deficit can be compensated for by consulting the stakeholdersaffected. Against this, I will argue that the social power argument has nothing to offer affected parties. Still, it will be shown that moderntheory on corporate social responsibility is not well accommodated to the democratic deficit as revealed by the social power argument. (shrink)

This dissertation addresses a debate about the proper relationship between democratic theory and institutions. The debate has been waged between two rival approaches: on the one side is an aggregative and economic theory of democracy, known as constitutional economics, and on the other side is deliberative democracy. The two sides endorse starkly different positions on the issue of what makes a democracy legitimate and stable within an institutional setting. Constitutional economists model political agents in the same way that neoclassical economists (...) model economic agents, that is, as self-regarding, rational maximizers; so that evaluations of democratic legitimacy and stability depend on the extent to which the design of institutional rules and practices maximize individual utility by promoting efficient schemes of collective choice. Deliberative democrats, on the other hand, understand political agents as communicative reason-giving subjects who justify their preferences and positions on issues that jointly affect them in a process of consensus-directed discourse, or deliberation; so that evaluations of democratic legitimacy and order depend on the degree to which institutional norms and practices promote deliberation and draw upon deliberated public judgment. I argue that despite the numerous incompatibilities between constitutional economics and deliberative democracy—which amount to a 'deep divide'—an opportunity to produce a genuine synthesis of the two approaches arises inasmuch as it is possible to overcome several points of opposition in their separate research programmes. The central thesis of the dissertation is that it is possible to construct a bridge spanning the divide between constitutional economists and deliberative democrats, and that Dewey and Bentley's transactional view can facilitate this bridge-building project. Pursuant to this end, the points of opposition between the v research programmes are mediated by way of five concepts which, on balance, favor deliberative democracy and its feasible institutionalization. Food-related non-communicable diseases such as obesity, type 2 diabetes and cardiovascular diseases are key threats to public health. Yet, the responsibility for food-related health harms is contested. While traditionally viewed as mainly an individual responsibility or a governmental responsibility, fingers are nowadays also pointed at the food and beverage industry, as many firms are producing and marketing unhealthy products that contribute to the rise of obesity and other food-related NCDs. Yet, does the behaviour of the industry and the impact its (...) products have on public health also give reason for moral concern? Are these firms doing anything wrong? Are there normative considerations on the basis of which it can be argued that food and beverage firms have a responsibility for public health? This thesis explores the moral grounds for firms in the food and beverage industry to address food-related public health problems, and simultaneously reflects upon what taking responsibility for these problems could entail in practice. Drawing on debates in business ethics, political philosophy, and public health ethics, it is argued that food and beverage firms have distinct responsibilities for food-related health problems, and that these responsibilities spring from considerations of _non-maleficence_, _respect for autonomy _and _justice_. The thesis makes clear how responsibility for public health can be understood as an essentially shared responsibility, and outlines what taking responsibility could entail for various firms in the food and beverage industry and makes recommendations on what kind of behaviour firms should no longer engage in. The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. This paper provides a critique of one of the more pivotal aspects of Judge Richard Posner’s legal pragmatism: his interpretation of John Dewey’s account of the relationship between democracy and knowledge, what I call the democracy-knowledge relationship. For Dewey, knowledge and action, including political action, are part of the same continuous process. Posner argues Dewey fails to make a convincing argument on this point. According to Posner, Dewey offers an incoherent democratic theory that is fragmented into what he calls “epistemic” (...) and “deliberative” democratic theories. I argue Posner is wrong in at least three ways: first, Posner exaggerates the extent to which Dewey believed his suggested reforms could actually be implemented; second, he misinterprets Dewey’s understanding of knowledge, both its origin and its function; and finally, Posner commits a classic straw man fallacy in that he presents a distorted account of Dewey’s democratic theory that is readily subject to his own criticisms. This study is an intervention in postcolonial theorising through a critique of technologies of representation. It examines the effects of technologically-mediated representation in a postcolonial condition that the Philippines has exemplified. New media technologies are mechanisms of representations that embody the logic of spectrality presented in Jacques Derrida’s later work. Spectrality, which brings doubts, ephemerality, and instability to dominant discourses and modes of representation, provides a chance for change.Spectres are effects of technologically-mediated representation that articulate the infinite demand for justice (...) under conditions of enduring inequality. As quasi-transcendental elements of deconstruction, spectres are not reducible to either human or technical intervention; they express the relation of humans to technologies, in which representation is central to the mediation of political authority. This technological representation is the condition of what Derrida calls “iteration,” or the transformation of hegemonic authority through the very repetition of its fundamental terms of identification. The examination of emancipatory new media technologies in a postcolonial condition is inspired by the work of Jacques Derrida, in his deconstructive reading of Marx’s spectres. However, the writings of Habermas and Adorno have offered an implicit appraisal of the ontology of spectres. Habermas’s theory of the public sphere and Adorno’s negative dialectics are discourses that unwittingly solicit spectres. The account of the postcolonial condition in the Philippines works through the questions of universality, subalternity, and the right to theory that are raised by the project of Western critical theory. In this article, it is argued that existing democracies might establish popular rule even if Joseph Schumpeter’s notoriously unflattering picture of ordinary citizens is accurate. Some degree of popular rule is in principle compatible with apathetic, ignorant and suggestible citizens, contrary to what Schumpeter and others have maintained. The people may have control over policy, and their control may constitute popular rule, even if citizens lack definite policy opinions and even if their opinions result in part from elites’ efforts to (...) manipulate these opinions. Thus, even a purely descriptive, ‘realist’ account of democracy of the kind that Schumpeter professed to offer may need to concede that there is no democracy without some degree of popular rule. Authority figures permeate our daily lives, particularly, our political lives. What makes authority legitimate? The current debates about the legitimacy of authority are characterised by two opposing strategies. The first establish the legitimacy of authority on the basis of the content of the authority’s command. That is, if the content of the commands meet some independent normative standard then they are legitimate. However, there have been many recent criticisms of this strategy which focus on a particular shortcoming – namely, its (...) seeming inability to account for who can legitimately command whom. This is the basis of the second strategy, which attempts to characterize the normative relationship that underlies and makes possible authoritative commands. The central point of Part I is that these two strategies are, in fact, not opposed and both raise questions which a theory of legitimacy must answer. If this is the case, then we need to ask: how ought we to determine the legitimacy both of the content of commands as well as who can command whom? Part II will answer this question. Starting with the question of standing, I argue that we ought not to look for normative principles outside of the institutions in which authority is embedded. Rather, one ought to start by elaborating the ontology of institutions in which a sui generis form of normativity arises. A joint commitment account of social ontology provides the tools necessary to see how the direction obligations emerge concurrently with the formation of institutions. Similarly, the question of content can be answered by paying close attention to the social ontology of institutions. We need not look beyond the internal constitutive standards of the institution itself. The constitutive standards provide an internal criterion by which the legitimacy of commands can be established. The article represents a contribution to the discussions about the basis, motives, and goals of European integration, which were stimulated by the recent “normative turn” in EU studies. My aim in this the article is threefold: By addressing the issue of internal legitimacy of EU decision-making, I wish to show that the European Union is in need of a public “story” of European integration; however, a closer analysis suggests that there is much normative disagreement on values and principles that are (...) supposed to define such “Europeanness”. This is also relevant for the role of Europe on the scene of international or global politics, where the EU aspires to become a leading actor, or is supposed to do so by cosmopolitan-minded authors. Lastly, the text defends the usefulness of the traditional conceptual apparatus of political theory, which which has – in relation to the European integration – in recent times come under attack. This paper addresses the problem of the strategies and theories of democratic participation in Nigeria that breeds institutional marginality and bad governance due to shortfalls in pursuing the values of justice and empowerment as core democratic characteristics. The same democratic principles such as voting, parliament, constitution, judiciary, that are suggestive of gains such as responsible use, and peaceful transfer of power may not have translated fully into sociopolitical empowerment for responsibility and representation in the evolving democratic practice in Nigeria due (...) problems of agency and political ideology. Democratic theorizing and participation in Nigeria has defied orthodox presuppositions seen in the disrespect for basic rights and the disregard for the rule of law in democracy that allow for fair play within and among the elites and political grassroots. Thus this study investigates the Nigerian predicament as model or case study, raising questions about the reasons for the systematic disempowerment of groups. (shrink)

What kind of polity is justified by classic Confucian values? Adopting an interpretive approach, this paper explores the idea of leadership democracy being expressive of classic Confucian values by first introducing the models of leadership democracy associated with Weber and Schumpeter and second connecting Confucian elitist values to them. I argue that leadership democracy best realizes the Confucian emphasis on the people as the source of legitimacy and the ruler as the engine of good governance. The Confucian idea of people-rootedness (...) is borne out by citizens behaving as democratic plebeians who are empowered to choose their leader but devoid of moral and intellectual capabilities for collective decision-making. The Confucian idea of rulership is expressed by democratic leaders displaying competent statesmanship and compensating for intra-elite tensions within the Confucian tradition. (shrink)

Se argumenta que no tiene este lugar y que por lo tanto la imposición de tributos no debe respetar esta restricción ya que no existe libertad básica que sea protegida por el principio de "capacidad contributiva". This paper discusses the relevance of the (...) notion of "ability to pay" in an egalitarian conception of justice and particularly whether it could play a role as a guarantee that derives from a requirement of protection of certain basic liberties considered as priorities. This paper examines the impact of democracy and democratization on contemporary Muslim societies. The institutional and philosophical approaches to democracy and democratization are inseparable. The paper investigates the relationship between the philosophical dimension of Western democracy and the Muslim philosophy of life and concludes that the democratization of contemporary Muslim societies leads to serious and destabilizing ideological polarization and division of Muslim societies into supporters of secularism and political Islam. The Islamist-secularists relation radicalizes: when the Islamists are prevented from capturing (...) power through democratic institutions and when the advanced Western democratic states cooperate with non-democratic secular elites of Muslim societies. The destabilizing role of democracy can be moderated if the Islamists are engaged in the democratic process, and the debate between the Islamists, the secularists and the West – based on the view that the West should conceive Islam as an alternative weltanschauung [worldview] – focuses on issues that are human properties, irrespective of religion, ethnicity or language. The institutional approach to democracy provides a common ground for cooperation and dialogue between the Islamists, the secularists and the West. (shrink)
