This article examines how one of the most striking differences between the central doctrines of the Catholic Church and the secular context of Swedish society, attitudes to abortion, is managed by the Swedish church hierarchy and commentators in the official newsletter of the Catholic Church of Sweden. Using Foucauldian concepts of power, the article concludes that in its marginal position, the Catholic Church in Sweden mixes the traditional pastoral and sovereign power of the church with the way pastoral power is (...) exerted in modern society, in its efforts to continue asserting its influence over the possible courses of action for pregnant women. While traditionally abortion has been a woman’s crime, in the Swedish Catholic context it becomes rather the crime of the secular society. This means also that the image of woman as being responsible for her decisions and in need of forgiveness gives way to an image of woman as a victim in need of understanding. (shrink)

Neoliberalism, in various ways, is radically new. It is nevertheless constructed from the conditions of liberal modernity, the inadequacies of which are crucial to neoliberal success. Liberalism in practice restricts moral agency through an impoverished, structurally-reinforced conception of practical reasoning, as Alasdair MacIntyre argues, and this is important to understanding neoliberal durability. This article argues that a bureaucratic culture that fails to evaluate or critically question the ends it pursues is both symptomatic of liberal inadequacies and a key factor in (...) neoliberal success. Beyond its purely explanatory power, there is a political relevance to MacIntyre’s Aristotelian-inspired politics of local community. It is from those practices and communal movements that embody alternative conceptions of the good, that those interested in resisting neoliberalism can learn how it becomes possible to successfully challenge aspects of the contemporary social order. This paper outlines an account of political realism as a form of ideology critique. Our focus is a defence of the normative edge of this critical-theoretic project against the common charge that there is a problematic trade-off between a theory’s groundedness in facts about the political status quo and its ability to consistently envisage radical departures from the status quo. To overcome that problem we combine insights from three distant corners of the philosophical landscape: theories of legitimacy by Bernard Williams (...) and other realists, Frankfurt School-inspired Critical Theory, and recent analytic epistemological and metaphysical theories of cognitive bias, ideology, and social construction. The upshot is a novel account of realism as empirically-informed diagnosis- critique of social and political phenomena. This view rejects a sharp divide between descriptive and normative theory, and so is an alternative to the anti- empiricism of some approaches to Critical Theory as well as to the complacency towards existing power structures found within liberal realism, let alone mainstream normative political philosophy, liberal or otherwise. This article takes as its starting point the observation that neoliberalism is a concept that is ‘oft-invoked but ill-defined’. It provides a taxonomy of uses of the term neoliberalism to include: (1) an all-purpose denunciatory category; (2) ‘the way things are’; (3) an institutional framework characterizing particular forms of national capitalism, most notably the Anglo-American ones; (4) a dominant ideology of global capitalism; (5) a form of governmentality and hegemony; and (6) a variant within the broad framework of liberalism as (...) both theory and policy discourse. It is argued that this sprawling set of definitions are not mutually compatible, and that uses of the term need to be dramatically narrowed from its current association with anything and everything that a particular author may find objectionable. In particular, it is argued that the uses of the term by Michel Foucault in his 1978–9 lectures, found in The Birth of Biopolitics, are not particularly compatible with its more recent status as a variant of dominant ideology or hegemony theories. It instead proposes understanding neoliberalism in terms of historical institutionalism, with Foucault’s account of historical change complementing Max Weber’s work identifying the distinctive economic sociology of national capitalisms. The social production of an enterprise clinic: nurses, clinical pathway guidelines and contemporary healthcare practicesIn this paper I critically engage with the forming of contemporary nursing practice with/in an ‘enterprise clinic’ in order to discuss the practical potential of developing a mode of reflective practice that is a critical ontology of self. Critical engagement in the paper is secured through a ‘troubling’ of the relationship between the contemporary practices of both the self and governance, without the reduction of one to (...) the other. The paper draws on my doctoral study in which I combined the techniques of ethnography and discourse analysis in order to critically examine registered nurses’ employment of clinical pathway guidelines through an analysis of the political technologies through which that engagement was constituted. This critical purchase was applied because of the influence of the contemporary ‘problematisation’ of healthcare provision in western society on the formation and deployment of the professional identities of nurses. The paradigm case of power as ?power over? (not ?power to') betrays a concern (1) more with the capacity to dominate others than with the unqualified capacity to act as such; (2) more with the fact, than with the morality, of dominance ? underscoring the key analytical distinction between ?power? and ?authority'; and (3) more with compulsion than co?operation. The three moves to combine (1) ?power over? with ?power to?, (2) ?power? with ?authority?, and (3) ?power? with ?co?operation?, are all (...) seen as inflationary, diminishing the value of the paradigm case, and assisting in rendering power, in its actual operations, both more obscure and insidious. Tumbling down this slope, there is a further argument, to the same effect, but secured by deflating, rather than inflating, the paradigm case. This deflationary argument (4) views luck as an alternative to power. In a world of dizzying technological innovation, marked by a deepening gap between rich and poor in the cities, between advanced and dependent states, we confront an inclination in many quarters both to expand and to contract power, so that it is everything and everywhere, thus nothing and nowhere. In attempts to substitute luck for power, it becomes difficult to assign to power responsibility, as heretofore. This paper is the first of two parts, taking a critical look at the overwhelming of power by inflation. Power consists in the capacity of A to command B, even against B's wishes, whether directly or indirectly. Questions to do with who possesses it and in what degree are obscured by inflationary shifts of definition (as where power encompasses action as such, or right action, or co?operation). These misjudged moves are generally marked by the assumption that democracy displaces power. But if democracy ultimately persists as a voting procedure, its object is to create power?holders. Democracy may endorse three electoral (...) principles: (a) majority rule, or (b) enhanced majority rule, or (c) unanimity. Its commonest electoral device is (a), but its strongest moral defence for (a) implicitly is (c), which legitimates forms of (d) veto and forms of minority rule. If (d) is fair, this need not follow from (a). Nor is (a) right in virtue of superior power. Democracy is commonly a combination of (a) plus (e) defence of individual and corporate rights. But this combination, while apt and convenient, is not incontestably coherent. Despite growing support for deliberation over election, if democracy must be impelled by (a), thus far does it sustain, not topple, power. If power persists more stably under democracies than elsewhere, sustained caution in regard to its supposed ?circularization? is fully warranted. (shrink)

While most other works focus on conspiracy theories, this book examines conspiracy panics, or the anxiety over the phenomenon of conspiracy theories. Jack Z. Bratich argues that conspiracy theories are portals into the major social issues defining U.S. and global political culture. These issues include the rise of new technologies, the social function of journalism, U.S. race relations, citizenship and dissent, globalization, biowarfare and biomedicine, and the shifting positions within the Left. Using a Foucauldian governmentality analysis, Bratich maintains that conspiracy (...) panics contribute to a broader political rationality, a (neo)liberal strategy of governing at a distance through the use of reason. He also explores the growing popularity of 9/11 conspiracy research in terms of what he calls the "sphere of legitimate dissensus." Conspiracy Panics concludes that we are witnessing a new fusion of culture and rationality, one that is increasingly shared across the political spectrum. (shrink)

In this article it is argued that social power can be created based upon either the reproduction of social order or coercively but that in complex societies the former is the more important. Building upon the ideas of a number of authors - including Arendt, Parsons, Barnes, Bachrach and Baratz, Lukes, Giddens, Foucault and Clegg - a typology of seven forms of power creation is developed in a manner which allows for diverse phenomena from previously divergent perspectives to be woven (...) together into a theoretical whole which renders them commensurable. At the foundational level, social order presupposes the recreation of shared meanings which enable actors to act in collaboration in a way which they could not otherwise do. This observation is used as the basic premise from which to re-examine the reproduction of social order and the relationship between power, structure and knowledge. Among other things, this allows the author to render Lukes' `false consciousness' argument commensurable with Foucault's power/knowledge hypothesis. (shrink)

This paper addresses Foucauldian theory and its usefulness to nursing research. It is written in the form of a discussion between the authors on the merits and liabilities of Foucauldian theory as applied to analyses of nursing. As such, it focuses upon some of the more pertinent critiques of both Foucauldian and postmodern theory. By addressing Foucault from two different positions, the discussion seeks to demonstrate the complexity of Foucauldian theory and warns against oversimplification in its application to nursing research. From the state to the family: reconfiguring the responsibility for long‐term nursing care at homeThis paper discusses the implications of the shift in the location of the provision of healthcare services from healthcare institutions to the home, which has occurred or is projected to occur in coming years. It is argued that the responsibility for the provision of care and assistance needed by the elderly living at home and people with long‐term conditions living at home has shifted from public services (...) to the family. Studies of care‐givers have shown that in many situations they experience tremendous burdens, financial difficulties and health problems. Their social lives have been confined to the home, and contacts with friends and neighbors have been significantly reduced. This situation needs to be addressed by nurses, who in many cases serve as the bridge between the home and the official healthcare system. Using Foucault’s exploration of power, particularly his idea of governmentality, a genealogy of care‐giving in the home in Iceland’s health‐care has been constructed. The main findings were that, although this is occurring somewhat later than in many other countries, the state is withdrawing from its previously defined responsibility for the health and well‐being of the nation. At the same time the citizen’s responsibility for maintaining health is emphasized. Based on these findings, the argument is made that nurses in Iceland can have a profound influence on policy‐making in relation to the organization of services provided in those homes. Suggestions are made as to how this can be done, which may be of interest to nurses in other countries. (shrink)

Peer review of manuscripts has recently become a subject of academic research and ethical debate. Critics of the review process argue that it is a means by which powerful members of the scientific community maintain their power, and achieve their personal and communal aspirations, often at others' expense. This qualitative study aimed to generate a rich, empirically‐grounded understanding of the process of manuscript review, with a view to informing strategies to improve the review process. Open‐ended interviews were carried out with (...) 35 journal editors and peer reviewers in the United Kingdom, the USA and Australia. It is clear from this research that relations of power and epistemic authority in manuscript review are complex and dynamic, and may have positive and negative features, and that even where power is experienced as controlling, restrictive and illegitimate, it can also be resisted. In conclusion, the manuscript review process is best thought of not in terms of simple dominance of reviewers and editors over authors, but rather as a shifting “net” of power relations. These complex power relations need to be understood if reviewers are to be encouraged to participate in the process and to do so in the the most ethical and effective manner. (shrink)

This article seeks to contribute to a critical understanding of the multifaceted nature of power, emphasizing its capacity to shape the development of society by permeating constitutive aspects of human reality. To this end, the article proposes an outline of a multidimensional approach to power. It does so by identifying and examining several - arguably universal - features and functions of power. On the basis of 15 theses, it is argued that, within the social world, the power of power derives (...) from the fact that it is ubiquitous, productive, relational, intangible, habitual, discursive, corporeal, polycentric, performative, normative, spatial, temporal, disciplinary, circular, and transcendental. Foucault’s critique of early modern political theory aimed at displacing sovereignty as the principle of intelligibility of power. In the genealogical literature since Foucault, sovereignty has become a residual category lacking analytic specificity, largely displaced by governance, in turn equated with politics. We argue that Foucault and the Foucauldians have not understood that the flourishing of governance has presupposed a symbolic regime with a division of knowledge-power-law characteristic of the democratic sovereign. The conflation of governance with politics, together with the (...) sliding of sovereignty under governance, has left Foucauldians unable to diagnose the dangers present in varying possible sovereignty-governance configurations. This thesis examines some of the contested meanings of what it is to be a self, person and individual. The law of obligations sets the context for this examination. One of the important aspects of contemporary feminist philosophy has been its move beyond highlighting inconsistencies in political and legal theory, in which theoretical frameworks can be shown to rely upon an ambiguous treatment of women. The feminist theorists whose work is considered use these theoretical weaknesses as a point of departure (...) to propose different conceptual frameworks. I start by analysing contemporary work on the self from within both philosophy of science and feminist metaphysics to draw out common approaches from these diverse positions. These themes are then discussed in the context of the law. I then critically examine the concept of legal personhood in the work of Drucilla Cornell and her proposals for the amendment of tort law. This is juxtaposed with an analysis of the practical operation of tort law by adapting François Ewald's work on risk and insurance to English law. I concentrate on women's ambiguous position with regard to both risk and to the image of the individual that is the subject of Ewald's critique. This is followed by an examination of the changing position of women with regard to 'possessive individualism', 'self-ownership' or 'property in the person' in relation to contract law and social contract theory. There are a number of different social contracts discussed in the thesis: Cornell's reworking of John Rawls and the stories of Thomas Hobbes and of Carole Pateman. The final 'social contract' to be discussed is that of 'new contractualism', the employment of contract as a technique of government. I argue that Pateman's critique of possessive individualism continues to be relevant at a time when the breadwinner/housewife model has broken down. (shrink)

This paper examines the forms of life established through the visual governance of the Australian social security mobile app —the Express Plus Centrelink app. It is argued that the app exceeds established accounts of juridical and administrative power. The app involves a seeing that is not public, a responding that is not writing and a de-materialisation of an institution and its disciplinary apparatus. It is argued that the app creates proto-literate subjects that are required to respond to a real-time sequence (...) of images in a highly structured and circumscribed manner to become complicit in the digitalisation of their life. The public can influence animal welfare law and regulation. However what constitutes ‘the public’ is not a straightforward matter. A variety of different publics have an interest in animal use and this has implications for the governance of animal welfare. This article presents an ethnographic content analysis of how the concept of a public is mobilized in animal welfare journals from 2003 to 2012. The study was undertaken to explore how experts in the discipline define and regard the role of (...) the public in determining animal welfare standards. Analysis indicates that experts in animal welfare constitute different types of citizen and consumer publics around specific types of animal use, framed by different theories of value. These results suggest a need for greater clarity about the roles and responsibilities of experts and publics in animal welfare reform processes. Clearly citizens and consumers can both contribute to promoting higher welfare standards, but an over-reliance on market mechanisms and consumer behaviour to assign value is beset by moral hazards, foremost being the risk of disarticulating the concept of animal welfare from the public good. This article draws on Foucault's concept of governmentality to explore how recent political moves to legalise ‘flexibility’ mobilises education authorities to make ‘community’ a technical means of achieving the political objective of schooling the child. I argue that ‘flexibility’ in this sense is a neo‐liberal strategy that shifts relations between the governed and the State. In this way, it transforms the idea of schooling from a State run institution for the purpose of ‘community building’ to a community run institution for (...) the purpose of making parents governable by both instrumentalising and institutionalising individualism through the force of community membership. Rather than a form of liberation from bureaucratic rule, the paper exposes how ‘flexibility’ acts as a normalising strategy that works with difference to entangle parents as community members in the process of schooling the child through the moral obligation of the contract. Today, very few would doubt that there are plenty of reasons to liken Weber’s and Foucault’s theories of power. Nevertheless, their respective works have divergent ethical and ontological preoccupations which should be reconsidered. This article explores Foucault’s account of a historical episode in Discipline and Punish and Weber’s theory of life spheres, uncovering evidence that there is a need to reassess the conceptual bridges which have been built so far. The exploration reveals a radical difference between a monological theory of (...) power (Foucault) and a multidimensional approach to power (Weber). Yet by unbridging the two thinkers and focusing on other aspects of their theories along with their ideas about power, we also find that alternative links between the two frameworks may offer a more promising critical theory. Police and pastoral power: governmentality and correctional forensic psychiatric nursing Since 1978, the federal inmates of Canada have had access to a full range of psychiatric care within the penitentiary system. Several psychiatric units are now integrated into the correctional services of Canada. This paper presents the results of a grounded theory doctoral study undertaken in a multilevel secured psychiatric ward within the Canadian federal penitentiary system. The author describes and discusses the results of qualitative data that emerged from his (...) fieldwork. The concept of governmentality, as defined by the late French philosopher Michel Foucault, constitutes one of the major theoretical tools that were helpful in analyzing these data. Police and pastoral power, two dimensions of the security apparatus of governmentality, were found to be useful in understanding and characterizing nursing practice caught between the penal and the psychiatric dispositifs. A Foucauldian perspective allows one to understand the manner in which forensic psychiatric nursing is involved in the governance of mentally ill inmates through three forms of power — sovereign, disciplinary and pastoral — which have posited nursing practice as a strategic tool of the correctional services. This research consists of a study of nursing practice in an extreme setting that deserves a radical analysis. (shrink)

Liberal political thought has traditionally been hostile to the arbitrary power of rulers. It has, however, qualified this hostility through its promotion of what Locke calls ?prerogative?, the need for rulers to act in defence of the public good ? but on occasion outside the constraints of law. Liberal thought has tended to overlook the arbitrary powers of citizens and private organisations. This is due, first, to its commitment to individual liberty. But it is also due ?more substantially ? to (...) the belief that private agents and corporations, even when not constrained by law, are none the less subject to the non?legal sanctions and rewards imposed by the market and other aspects of civil society. Neo?liberalism is not rendered distinctive by its promotion of arbitrary power, since this has always featured in liberal government. Neo?liberalism is distinguished rather by its promotion of arbitrary powers across the full range of organs of governance ? from departments of government, through publicly and privately owned corporations, to ostensibly non?governmental bodies like charities, churches and so on. This advance in liberal promotion of arbitrary power has significant implications for the evolution of contemporary democracy. (shrink)

Building on conceptual insights from the history and sociology of numbers, media and surveillance studies, and theories of governance and risk, this article analyzes the forms of transparency produced by the use of numbers in social life. It examines what it is about numbers that often makes their ‘truth claims’ so powerful, investigates the role that numerical operations play in the production of retrospective, real-time and anticipatory forms of transparency in contemporary politics and economic transactions, and discusses some of the (...) implications resulting from the increasingly abstract and machine-driven use of numbers. It argues that the forms of transparency generated by machine-driven numerical operations open up for individual and collective practices in ways that are intimately linked to precautionary and pre-emptive aspirations and interventions characteristic of contemporary governance. As such, these numerical operations raise important political and ethical questions that deserve further conceptual and empirical scrutiny. (shrink)

The claim may be made that the Foucauldian analytics of power, in its detailed attention to the question of how modern societies are rendered governable, has superseded classical and radical analyses. This paper points to problems occasioned by Foucauldian governmentality's reliance on Foucault's flawed conception of the subject. These problems undermine the ambition of this style of research to outline possibilities for political intervention. It is suggested that educational critique can draw usefully on the scrupulous specificity of Foucauldian governmental analysis (...) but that only a critique firmly based in a normative framework aligned to an idea of democratic sociality can aspire to political effectiveness. The emergence of population as an object of government in the 18th century produced a new problematic of government. The focus of this new problematic was how to ensure that the pursuit of self-interest by individual economic actors was compatible with the reproduction and useful employment of the population. From the 18th century to the present, government in the West has addressed this problem in a number of different ways, each of which represents a 'tricky adjust ment' between a liberal (...) element concerned with commercial freedom and a pastoral element concerned with the welfare of the population. The tension between the liberal and pastoral elements of modern Western governance is explored by examining the place of commercial freedom within a householding concept of rule in which security at the level of the state is dependent upon the sovereign's rational management of the population. The work of Foucault on liberal government, and that of his followers, is subject to two dangers. The first is to regard the critical character of liberalism (as governing through freedom) as providing safeguards against the despotic potentials of biopower and sovereignty. The second is to regard these heterogenous powers of life and death as somehow simply relocated or reinscribed within the field of liberal governmentality. The latter point is a major methodological error; the former closes the gap between the (...) analytics of government and the normativity of liberalism itself. By working through these dangers, our understanding of the ethos of liberal government is transformed. That ethos today requires us to link governing through freedom to the powers of life and death, the exercise of choice to the sovereign decision, the contract to violence, economic citizenship to moral discipline and obligation, and rights and liberties to enforcement. To understand how we have become what we are requires, following Foucault, not a theory but an `analytics' which examines how technologies of power and knowledge have, since antiquity, intertwined and developed in concrete and historical frameworks. Distilling from Foucault's oeuvre as a whole a rough periodization of western political rationalities, this article shows how the processes whereby some people discipline or govern others are frequently closely connected to procedures of identity-constitution and knowledge-production. Platonic, Stoic and Christian pursuits of self-mastery (...) and self-knowledge, often via the intervention of an external master, were initially confined to an elite, but thereafter were amplified and generalized to encompass entire populations in conjunction with the rise of the modern state. Via techniques of confession and ascetic conduct, faith and empiricism, and selfreflection and everyday reality, western political rationalities, in the form of combined totalization and individualization technologies whereby some (struggle to) discipline others even as all (are exhorted to) discipline themselves, have come to dominate the globe. Philosophy and Literature is an internationally renowned refereed journal founded by Denis Dutton at the University of Canterbury, Christchurch. It is now published by the Johns Hopkins University Press. Since its inception in 1976, Philosophy and Literature has been concerned with the relation between literary and philosophical studies, publishing articles on the philosophical interpretation of literature as well as the literary treatment of philosophy. Philosophy and Literature has sometimes been regarded as iconoclastic, in the sense that it repudiates academic pretensions, (...) insidious jargon and institutional vogue. Dutton, who remains the editor, still writes a regular column. A distinctive feature of Philosophy and Literature was the annual Bad Writing Contest, held from 1995–98, which sought to identify (and publish) the ‘most stylistically lamentable passages’ of academic prose, often to great amusement.
