The detection of hate speech and fake news in political discourse is at the same time a crucial necessity for democratic societies and a challenge for several areas of study. However, most of the studies have focused on what is explicitly stated: false article information, language that expresses hatred, derogatory expressions. This paper argues that the explicit dimension of manipulation is only one – and the least problematic – of the risks of political discourse. The language of the unsaid is (...) much more dangerous and incomparably more difficult to detect, hidden in different types of fallacies and inappropriate uses of emotive language. Through a threefold coding scheme based on the instruments of argumentation theory and pragmatics, a corpus of argumentative tweets published by 4 politicians (Matteo Salvini, Donald Trump, Jair Bolsonaro, and Joseph Biden) within 6 months from their taking office (corresponding to the official end of their election campaign) is analyzed, detecting the types of argument, the fallacies, and the uses and misuses of “emotive words.” This coding results in the argumentation profiles of the speakers, which are compared statistically to show their different implicit strategies and deceptive tactics. The authors of 200 arguments for questions posed 19 types of questions, justified them in 62 different ways, offered a justification of the question for 50 different types of purposes, and posed the question for 49 different types of purposes. Further consolidation of the categories used in the analysis is desirable and possible. Of the six most commonly posed types of questions, only three (yes-no questions, select questions, and either-or questions) are at first glance capable of formal representation in an (...) erotetic language of the sort described by Wiśniewski (1995, 1996, 2013), but all six (including also requests to explain, identify and find a means) can be represented formally using the interrogative operators devised by Kubiński (1980). As for the types of justification, four passages argued against posing a question by denying one of its presuppositions, a strategy that implies that a question without a true answer is not worth posing. Only 20 passages, however, argued for a question by asserting a presupposition – typically in cases where their addressees might think that the premissed presupposition is false. Close analysis of five passages randomly selected from the 200 turned up four distinct conditions assumed to be necessary for a question to be worth posing: absence of a false presupposition, a way of working out a correct answer, an unbiased answerer, and a need to answer the question. The first three of these conditions can generally be presumed to be satisfied, and would need to be mentioned in justifying a question only if there was a suspicion that they were not. The fourth condition, a need to answer the question, typically does need to be established, and was the genus of the types of justification identified in half of the passages arguing for a non-rhetorical question. The dominant purpose for justifying a question, found in 111 of the passages, was to establish a need to answer the question; given that justifying a question typically amounts to establishing a need to answer it, this purpose is internal to the practice. The most common generic purposes for posing the question for which an author argued were to provoke thought, to introduce subsequent discussion of the question, to indirectly claim something (in the case of rhetorical questions), to issue a challenge, and to seek enlightenment. Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal interpretative canons (...) into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. These visuals help make the structures, strategies, and vulnerabilities of legal reasoning accessible to both legal professionals and laypeople. (shrink)

According to the argument scheme approach, to evaluate a given scheme-saturating instance completely does entail asking all critical questions relevant to it. Although this is a central task for argumentation theorists, the field currently lacks a method for providing a complete argument evaluation. Approaching this task at the meta-level, we combine a logical with a substantive approach to the argument schemes by starting from Toulmin’s schema: ‘data, warrant, so claim’. For the yet more general schema: ‘premise; if premise, then conclusion; (...) so conclusion’, we forward a meta-level CQ-list that is arguably both complete and applicable. This list should inform ongoing theoretical efforts at generating appropriate object-level CQs for specific argument schemes. (shrink)

In the domain of medical science, factual evidence is usually considered as the criterion on which to base decisions and construct hypotheses. Evidence-based medicine is the translation of this approach into the field of patient care, and it means providing only the type of care that is based on evidence that proves its effectiveness and appropriateness. However, while the literature has focused on the types and force of evidence used to establish the recommendation and treatment guidelines, the problem of how (...) evidence is used in doctor–patient interactions to motivate, or refuse, treatment or habit change has been almost completely neglected. In this specific context, characterized by the epistemic unbalance between the interlocutors and a specific conversational goal, the scientific categories of evidence are often irrelevant. The goal of this paper is to address this challenge by analyzing the role evidence plays in doctor–patient interactions in diabetes care. After introducing an analytical distinction between the epistemic and the pragmatic aspect of evidence, we will propose a classification of the types and functions of evidence in chronic care communication, and illustrate its possible uses through its application to our corpus of diabetes-care consultations. From our qualitative analyses, it is possible to observe how in this communicative context a crucial role is played by the conflicts of evidence, in which providers correct patients’ uses of evidence leading them to using less defeasible levels of evidence. The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. This paper advances an approach to relevance grounded on patterns of material inference called argumentation schemes, which can account for the reconstruction and the evaluation of relevance relations. In order to account for relevance in different types of dialogical contexts, pursuing also non-cognitive goals, and measuring the scalar strength of relevance, communicative acts are conceived as dialogue moves, whose coherence with the previous ones or the context is represented as the conclusion of steps of material inferences. Such inferences are described (...) using argumentation schemes and are evaluated by considering 1) their defeasibility, and 2) the acceptability of the implicit premises on which they are based. The assessment of both the relevance of an utterance and the strength thereof depends on the evaluation of three interrelated factors: 1) number of inferential steps required; 2) the types of argumentation schemes involved; and 3) the implicit premises required. This paper compares current ways of modeling the inferential structure of practical reasoning arguments, and proposes a new approach in which it is regarded in a modular way. Practical reasoning is not simply seen as reasoning from a goal and a means to an action using the basic argumentation scheme. Instead, it is conceived as a complex structure of classificatory, evaluative, and practical inferences, which is formalized as a cluster of three types of distinct and interlocked argumentation schemes. Using two (...) real examples, we show how applying the three types of schemes to a cluster of practical argumentation allows an argument analyst to reconstruct the tacit premises presupposed and evaluate the argumentative reasoning steps involved. This approach will be shown to overcome the limitations of the existing models of practical reasoning arguments within the BDI and commitment theoretical frameworks, providing a useful tool for discourse analysis and other disciplines. In particular, applying this method brings to light the crucial role of classification in practical argumentation, showing how the ordering of values and preferences is only one of the possible areas of deep disagreement. This book proposes guidelines for constructing and evaluating definitions of terms, i.e. words or phrases of general application. The guidelines extend to adoption of nomenclature. The book is meant to be a practical guide for people who find themselves in their daily lives or their employment producing or evaluating definitions of terms. It can be consulted rather than being read through. The book’s theoretical framework is a distinction, due to Robert H. Ennis, of three dimensions of definitions: the act of (...) the definer, the content of the definition, and its form. The act of a definer is what the definer does in defining a term; the book distinguishes, following Ennis, three basic acts of defining: reporting, stipulating, and advocating. The content of a definition is in one sense the information that the definition conveys and in another sense the words in its defining part. The form of a definition is the way it is expressed, for example as a definition by genus and differentia. (shrink)

Cogency is the central normative concept of informal logic. But it is a loose evaluative concept and I argue that a generic notion covering all of the qualities of a well-reasoned argument is the most plausible conception. It is best captured by the standard RSA criterion: in a good argument acceptable (A) and relevant (R) premises provide sufficient (S) grounds for the conclusion. Logical qualities in a broad sense are affected by the epistemic qualities of the premises and “consequence” in (...) a broad sense exhibits an interplay of form and content. There are four proposals for the premise—conclusion relation: (i) no strictly logical connection (“non-logical” consequence); (ii) one type of connection only (deductivism); (iii) a few types of connection (deduction, induction, perhaps conduction and analogical reasoning); (iv) many types of connection (argumentation schemes). Deductivism is a serious option but in its strong version, as the discussion about petitio shows, it fails to establish that arguments which are not cogent are thereby invalid. And weak deductivism, very attractive from the pedagogical point of view, has some deficiencies (implausible hidden premises; preservation of truth, not probability). I argue that the idea of a counterexample, when we regard certain components of the argument as fixed and others as variable, is the best approach to the analysis of the illative core of every-day arguments (the approach of David Hitchcock on material consequence). Bad jokes are not simply non-humorous texts. They are texts that are humorous for someone––their author at least––but not for their audience. Bad jokes thus involve a contextual––pragmatic––dimension that is neglected in the semantic theories of humor. In this paper, we propose an approach to humor based on the Aristotelian notion of surprising enthymemes. Jokes are analyzed as kinds of arguments, whose tacit dimension can be retrieved and justified by considering the “logic” on which it is based. However, jokes are (...) based on specific pragmatic conditions: they are regarded as arguments grounded on a generalization that is at the same time uncommon, retrievable, and acceptable or plausible for the audience. This perspective integrates the “local logic” of jokes within a broader rhetorical theory that ultimately rests on the communicative notion of common ground. (shrink)

In his Fallacies, Hamblin (1970) castigated what he called the “standard treatment” of fallacies in introductory textbooks of his day as debased, worn-out, dogmatic, and unconnected to anything else in modern logic. A bit more than 50 years later, I investigate the treatment of fallacies in six English-language introductory textbooks with a section on fallacies that have gone into 10 or more editions, to see whether their treatment of fallacies has taken account of the scholarship on fallacies that Hamblin’s book (...) evoked and is better than the treatment that Hamblin described. The answer is: not much. I conclude by setting out criteria for an adequate treatment of fallacies in an introductory textbook. (shrink)

Wellman identified three types of conductive arguments, the third of which contains both pro and counter-considerations in the same piece of reasoning. This paper provides a pragma-dialectical analysis of this type of argumentation, with special focus on argumentation reconstruction. It argues that the account of pro/con argumentation in the framework of argument-as-product has problems solvable by a pragma-dialectical approach. The paper asserts that pro/con argumentation should be analyzed as a dialectical strategy of a protagonist, where acknowledgement of counter-considerations shows that (...) the antagonist’s reasons have been taken into consideration, although the pro-considerations override them. Thus, the pro-considerations of pro/con argumentation should be interpreted as the protagonist’s overriding defeaters of the antagonist’s counter-arguments, the protagonist incorporating the latter as counter-considerations. The paper further argues that the pragma-dialectical framework needs an additional conceptual tool to properly reconstruct complex forms of pro/con argumentation. Finally, the pragma-dialectical approach to reconstruct pro/con argumentation has several advantages, especially to a more logical-structural approach to complex pro/con argumentation. (shrink)

Argumentation schemes are forms of reasoning that are fallible but correctable within a self-correcting framework. Their use provides a basis for taking rational action or for reasonably accepting a conclusion as a tentative hypothesis, but they are not deductively valid. We argue that teleological reasoning can provide the basis for justifying the use of argument schemes both in monological and dialogical reasoning. We consider how such a teleological justification, besides being inspired by the aim of directing a bounded cognizer to (...) true belief and correct choices, needs to take into account the attitudes of dialogue partners as well as normative models of dialogue and communicative activity types, in particular social and cultural settings. Blair articulates a concept of argument that suggests, as he puts it, that argument is a normative concept (Blair, Informal Logic 24:137–151, 2004, p. 190). Put roughly, the idea is that a collection of propositions doesn’t constitute an argument unless some taken together constitute a reason for the remaining proposition and thereby support it enough to provide at least prima facie justification for it (Blair, in: Blair, Johnson, Hansen, Tindale (eds) Informal Logic at 25, Proceedings of the 25th anniversary conference, (...) Ontario Society for the Study of Argumentation, 2003, p.173). My primary task in this paper is to advance an understanding of the illative unit of argument and the reasons associated with it that provides an intuition pump for a normative concept of argument. My aim is to advance a positive consideration in favor of a normative concept of argument that motivates its further development. I take the normative concept of argument I defend here to be in the same ballpark as the one Blair characterizes. (shrink)

Arguments figure prominently in our practices of reason-giving. For example, we use them to advance reasons for their conclusions in order to justify believing something, to explain why we believe something, and to persuade others to believe something. Intuitively, using arguments in these ways requires a certain degree of self-reflection. In this paper, I ask: what cognitive requirements are there for using an argument to advance reasons for its conclusion? Towards a partial response, the paper’s central thesis is that in (...) order to so use an argument one must believe the associated inference claim to the effect that the premises collectively are reasons that support the conclusion. I then argue against making it a further cognitive requirement that one be aware of one’s justification for believing such an inference claim. This thesis provides a rationale for the typical informal-logic textbook characterization of argument and motivates a constraint on adequate accounts of what are referred to as inference claims in the informal logic and argumentation literatures. The aim of this paper is to explore the status of argumentative discourse. We argue that argumentation can contribute to instances of different discourse genres, regardless of whether it is functional to their purposes. By analyzing examples from the daily press in the light of an approach to discourse analysis inspired by pragmatics, we show that also texts that are not expected to be argumentative have underlying argumentative structures and that a text’s being argumentative is a matter of degree: the (...) understanding of underlying argumentative structures contributes to a varying extent to the understanding of what a text as a whole means and of its point in the speech situation. This role of argumentative structures in text understanding suggests considering argumentation as a cognitively-based dimension of discourse, connected to human rationality. (shrink)

The aim of this paper is to critically review the traditional typology of argument macrostructures, particularly, the dichotomy between linked and convergent structure. We have found an argument structure that does not fall under one of those five traditional categories: basic, serial, divergent, linked and convergent. We show that the new argument structure, which we call the recursive structure, is not rare-earth, but ubiquitous in real argumentation. Then, we propose and justify a new approach to diagramming arguments of the structure. (...) The new argument structure is really new because arguments of the new structure are analyzed and evaluated differently from those of the other structures, especially from hybrid arguments considered in the literature. In light of the new argument structure, we present a hypothesis why assumptions and exceptions of a defeasible argument play different roles in dialectical settings. (shrink)

The topic of critical thinking has engaged philosophers, psychologists and educators for well over one hundred years. Amid polarized political attacks on the teaching of controversial issues, however, education in critical thinking appears to be nearing a new low, not only in the United States, but also in other countries being torn by partisan politics. This article reviews the ebb and flow of critical thinking efforts, suggests explanations for their discouraging results, and proposes a way forward that treats critical thinking (...) as an integrative process advanced by Mary Parker Follet, and more recently espoused by Bruno Latour and Donna Haraway. In the exploratory spirit of John Dewey and Alfred North Whitehead, I am introducing this essay, not with analysis or theory, but with a narrative of educational events in all their richness of context. These events describe how middle school students addressed the question of whether wolves should be removed from the endangered species list in the Northern Rocky Mountains of the United States. In the course of this discussion, I wish to demonstrate that thinking critically requires moving beyond winning, losing, or compromising to resolution of conflict, and furthermore, understanding that even stable resolutions must be revisited as events change. In this paper we investigate ignorance in relation to our capacity to justify our beliefs. To achieve this aim we specifically address scientific misconceptions, i.e. beliefs that are considered to be false in light of accepted scientific knowledge. The hypothesis we put forward is that misconceptions are not isolated false beliefs, but rather form part of a system of inferences—an explanation—which does not match current scientific theory. We further argue that, because misconceptions are embedded in a system, they cannot be (...) rectified simply by replacing false beliefs with true ones. To address our misconceptions, we must rather act on the system of beliefs that supports them. In the first step of our analysis, we distinguish between misconceptions that are easy to dispel because they represent simple errors that occur against the background of a correct explanatory apparatus and misconceptions that are, on the contrary, very difficult to dispel because they are the product of pseudo explanations. We show that, in the latter case, misconceptions constitute an integral part of an incorrect explanation and the reasons that support such misconceptions are deeply misleading. In the second step, we discuss various approaches that have been adopted to address the problem of misconceptions. Challenging the notion that directly addressing and criticizing specific misconceptions is an effective approach, we propose that critical thinking is the most fruitful means to deal with misconceptions. We define the core competences and knowledge relevant for the practice of critical thinking and discuss how they help us avoid misconceptions that arise from accepting beliefs that form part of a mistaken explanation. The paper relates two different fields of research: the historiography of generative linguistics and argumentation theory, a central topic of which is the investigation of fallacies. Relating the two fields is a challenge: Since fallacies seem to be at the heart of the historiography of generative linguistics, any thorough evaluation of its present state of the art also involves accounting for fallacies. The paper applies Kertész and Rákosi’s p-model of plausible argumentation to a case study on heated discussions in the (...) historiography of generative linguistics. As a result, basic properties of fallacious argumentation are revealed and delimited from plausible argumentation in linguistic historiography. In addition, the paper also draws generalizable conclusions that may affect the historiography of other human sciences as well. (shrink)

The paper presents an analysis of the cultural embeddedness of arguments, raised as a part of the Bulgarian debate about the ratification of the Istanbul convention. The method I employed was the localization procedure of Generalized Argumentation theory. Through a qualitative analysis of empirical argumentation data, I identified arguments in favour of or against the ratification of the Istanbul convention. Information about the cultural background against which these arguments were raised, i.e. about Bulgarian culture, was gathered from the part of (...) the ninth wave of the European Social Survey that used the Portrait Value Questionnaire—an instrument for measuring human values, based on Schwartz’s theory of human values. By establishing a certain relationship between the arguments and the cultural background information, I came to the conclusion that the debate between the proponents and the opponents of the ratification represented a conflict between the basic values of universalism and tradition, and more particularly, between the lower-order values of equality and respect for tradition. Inspired by studies about the history and anthropology of knowledge, this text addresses the question of how places are constitutive of the process of argumentation. The argument from place that is presented in classical rhetoric handbooks, particularly in Quintilian, is used as a model of analysis in order to emphasise the situated character of argumentative processes. Both the attention to the place from which an argument is uttered and to the place to which the argument refers are useful guides that (...) help us understand the phenomenon of relevance and keep expanding the contextual and situated approach to argumentation theory and rhetoric.
