The modern state is often taken as the only legitimate claimant to the division of the globe. Political theorists offer many theories of territorial rights but tend to agree that the state remains the proper institutional bearer of such rights. This article examines how states became the exclusive bearers of territorial rights by returning to the international theory of the eighteenth-century Prussian jurist Christian Wolff (1679–1754), who wrote in a moment when sovereign states were not the heirs apparent to the (...) globe but competed with other claimants to territorial rights. Despite proposing a radically pluralistic and anti-imperial account of land ownership, Wolff nonetheless paved the way for the state to become the sole bearer of territorial rights. Wolff’s international thought is an illustration of how building a state-centric international order was a double-edged sword: it criticized imperial overreach while also closing the international arena to nonstate forms of collective life. In this process, he offered two distinct ideas of political space: the territorial space of states, and the land ownership tracts of nonstate peoples, including pastoralists and nomads. To Wolff, only states were entitled to full and permanent territorial rights, while nonstate peoples were shut out of the international system, made both de facto and de jure stateless. (shrink)

Kant deploys analogies from private law in describing relations between states. I explore the relation between these analogies and the broader Kantian idea of the distinctively public nature of a rightful condition, in order to explain why states, understood as public things, stand in horizontal, private legal relations without themselves being private. I use this analysis to explore the international law analogues of the three titles of private right, explaining how territory differs from property, treaty from contract and the specific (...) form of status relations between nations. An influential interpretation of Kant’s Doctrine of Right suggests that the relationship between public right and freedom is constitutive rather than instrumental. The focus has been on domestic right and members’ relations to their own state. This has resulted in a statist bias which has not adequately dealt with the fact that Kant regards public right as a system composed of three levels – domestic, international and cosmopolitan right. This article suggests that the constitutive relationship is between all levels of (...) right, on the one hand, and ‘freedom in the external relation’ of all human beings, on the other hand. However, while the systematic nature of Kant's tripartite ‘doctrine of right' is well recognised, this debate has been conducted with all but exclusive focus on ‘international right' in particular. This article, by contrast, brings ‘cosmopolitan right' firmly into view. It proceeds by way of engagement with the two Kantian (...) arguments made in defence of a ‘league of nations’ in discussion of international right, each of which appeals to aspects of states’ supposed ‘personhood’: the first appeals to states’ distinctive moral personality; the second to states’ physical manifestation. The article considers what happens when we assess these arguments not just in light of the demands of international right, but also in light of cosmopolitan right, and thus in light of public right more comprehensively. The answer is that such arguments cannot succeed as full defences of a league of nations. Indeed, when we assess such arguments with cosmopolitan right in view, they point instead – either tentatively or definitively – in the direction of world government. (shrink)
