When considering the interactions between rhetoric and argumentation, readers of this journal will no doubt be reminded of the seminal work of Henry W. Johnstone Jr. (1959; 1978) who gathered both concerns together in ways that were designed to engage philosophers and persuade them of the intellectual seriousness of both enterprises. Perelman's work has been very influential in various disciplines, among them philosophy, rhetoric and law. Especially the typology of argumentative schemes which he developed together with L. Olbrechts-Tyteca has been considered as an excellent classification of arguments in natural language. There are, however, some weaknesses of this typology which make its application to empirical research quite difficult, namely, the lack of explicitness and the absence of clear criteria of demarcation. Anyone interested in philosophical argumentation should be prepared to study philosophical debates and controversies because it is an intensely dialogical, and even contentious, genre of argumentation. This paper explores The New Rhetoric’s concept of universal audience in the contexts of philosophical and traditional rhetorical discourse. Philosophy often at least implicitly includes and depends on a logical structure which is also that of jokes. This is the case when philosophy involves questioning or establishing concepts in their own right, and when it involves the kinds of metaphysics which ask about reality and the world as a whole or as such. The paper argues that metaphysical thought, or thought in whose context our general framework of sense is under scrutiny, involves, legitimates, and requires a variety of informal analogues of the ‘true contradictions’ supported in some paraconsistent formal logics. These are what we can call informal ‘legitimate logical inadequacies’. These paradoxical logical structures also occur in deeply pluralist contexts, where more than one, conflicting general framework for sense is relevant. Fogelin’s Wittgensteinian view of deep disagreement as allowing no rational resolution has been criticized from both argumentation theoretic and epistemological perspectives. These criticisms typically do not recognize how his point applies to the very argumentative resources on which they rely. Additionally, more extremely than Fogelin himself argues, the conditions of deep disagreement make each position literally unintelligible to the other, again disallowing rational resolution. This article outlines criteria for the evaluation of the argumentum ad hominem (argument against the person, or personal attack in argument) that is traditionally a part of the curriculum in informal logic. The argument is shown to be a kind of criticism which works by shifting the burden of proof in dialogue through citing a pragmatic inconsistency in an arguer's position. Several specific cases of ad hominem argumentation which pose interesting problems in analyzing this type of criticism are studied. |

In this paper it is shown is that although poisoning the well has generally been treated as a species of ad hominem fallacy, when you try to analyze the fallacy using ad hominem schemes, even by supplementing with related schemes like argument from position to know, the analysis ultimately fails. In this paper, the role played in learning to argue by an essential and yet under-researched epistemic and argumentative norm is discussed, namely, the consistency requirement. Henry Johnstone's philosophical development was guided by a persistent need to reform the concept of validity -either by reinterpreting it or by finding a substitute for it. This paper examines the views of Fogelin, Woods, Johnstone, etc., concerning deep disa-greements, force-five standoffs, philosophical controversies, etc. My approach is to reconstruct their views and critiques of them as meta-arguments, and to elaborate the meta-argumentative aspects of radical disa-greements. It turns out that deep disagreements are resolvable to a greater degree than usually thought, but only by using special principles and practices, such as meta-argumentation, ad hominem argumentation, Ramsey’s principle, etc. |

Although Hume’s critique of the design argument is a powerful non-inductive meta-argument, the main line of critical reasoning is not analogical but rather a complex meta-argument. I characterize the deductivist ideal of justification and, following to a great extent Toulmin’s work The Uses of Argument, I try to explain why this ideal is erroneous. Then I offer an alternative model of justification capable of making our claims to knowledge about substantial matters sound and reasonable.
