ABSTRACT:In this address I argue that different perspectives on the normative foundations of corporate responsibility reflect underlying disagreements about the ideal arrangement of tasks between market and state. I initially recommend that scholars look back to the “division of moral labor” inspired by John Rawls’ seminal work on distributive justice in order to rethink why, and to what extent, corporations take on responsibilities normally within the purview of government. I then examine how this notion is related to recent theoretical work (...) in the field of business ethics. I thereafter turn to provide a brief outline of an alternative view that sees corporations as having responsibilities in so far as markets are sites of delegated oversight over the production of social goods that might otherwise be administered by the state. As early as 1962, Jürgen Habermas was convinced that Karl Marx’s theoretical attempt to ‘turn Hegel the right side up’ had resulted in a one-sided embrace of revolution and a perilous rejection of legality and rights. Habermas would restate these remarks thirty years later in Between Facts and Norms, noting that the collapse of state socialism, with its characteristic disdain for legality and rights, culminated in the discrediting of revolutionary Marxism. This article revisits Habermas’s theoretical dichotomy between revolution and legality (...) in view of his ambivalent relationship to ‘Marx’s spectre’ and shows its significance for Habermas’s ongoing debate with Wolfgang Streeck concerning the tension between democracy and capitalism. Using textual evidence from Marx’s neglected journalistic writings before, during, and after the 1848 revolutions, the article offers a competing perspective of Marx’s views on legality and rights at a time when their respective fates were critically at stake. A careful reconsideration of Marx’s reflections and a confrontation with his spectre offers Habermas fruitful resources for responding to Streeck’s critique and for reviving the project of ‘radical reformism’ at a time when the liberal constitutional order finds itself under attack. ABSTRACT:Deliberative democratic theory, commonly used to explore questions of “political” corporate social responsibility, has become prominent in the literature. This theory has been challenged previously for being overly sanguine about firm profit imperatives, but left unexamined is whether corporate contexts are appropriate contexts for deliberative theory in the first place. We explore this question using the case of Starbucks’ “Race Together” campaign to show that significant challenges exist to corporate deliberation, even in cases featuring genuinely committed firms. We return to (...) the underlying social theory to show that this is not an isolated case: for-profit firms are predictably hostile contexts for deliberation, and significant normative and strategic problems can be expected should deliberative theory be imported uncritically to corporate contexts. We close with recent advances in deliberative democratic theory that might help update the PCSR project, and accommodate the application of deliberation to the corporate context, albeit with significant alterations. In this paper I examine Axel Honneth’s normative reconstruction of the market as a sphere of social freedom in his 2014 book, Freedom’s Right. Honneth’s position is complex: on the one hand, he acknowledges that modern capitalist societies do not realise social freedom; on the other hand, he insists that the promise of social freedom is implicit in the market sphere. In fact, the latter explains why modern subjects have seen capitalism as legitimate. I will reconstruct Honneth’s conception of social (...) freedom and investigate how it is realised in the sphere in which Honneth sees it most successfully at work, the sphere of interpersonal relations. I then move on to the sphere of the market economy and discuss two related problems of this view that stem from his interpretation of Hegel. Next, I consider Honneth’s method of “normative reconstruction” and his reconstructions of the sphere of consumption and, finally, the labour market. My conclusion will be that market institutions cannot realise social freedom, and that this insight should orient the philosophical direction of critical social theory. (shrink)

Que las democracias deliberativas sean las que ocupan hoy el centro de la reflexión democrática se debe tanto a su potencial interno como al desgaste de una realidad política alejada cada vez más de lo que pensábamos –esperábamos- de la democracia. En este contexto se enmarca el presente artículo cuya propuesta de un enfoque mesodeliberativo pretende aportar a la discusión sobre la articulación institucional de las teorías deliberativas dos aspectos íntimamente vinculados: el valor de la sociedad civil y la perspectiva (...) de la ética en el diseño institucional. Ambos aspectos no acaban de encontrar su lugar en las diferentes iniciativas deliberativas actuales y, sin embargo, son piezas fundamentales para el logro de una teoría democrática completa y crítica. Para defender esta propuesta daremos los siguientes pasos. En primer lugar, se justifica la necesidad de este nivel mesodeliberativo dentro del llamado enfoque sistémico de las democracias deliberativas. A continuación, ante la pregunta de qué instituciones y por qué, se introduce un concepto ampliado de sociedad civil siguiendo la propuesta de una democracia de doble vía, en discusión con la concepción habermasiana. En tercer lugar, se despliegan algunas de las aportaciones básicas del diseño institucional para el desarrollo de este nivel mesodeliberativo y el papel que cumple y puede cumplir en él la perspectiva ética. Por último, se esboza este papel a partir del principio kantiano de publicidad como eje central para el desarrollo de la perspectiva ética en el diseño institucional. (shrink)

While the critique of neoliberalism, as the form of contemporary capitalism, has been advanced from Marxian and Foucauldian perspectives, it has had limited attention from the perspective of Critical Theory. Largely unrecognized is the suitability of the theory of reification for this critique, specifically, Habermas’s version. This article reconsiders Habermas’s colonization thesis as the basis for a critical theory of neoliberalism, refining its theoretical framework to deepen its critical diagnosis. Against the dismissal of the system–lifeworld concept, a novel critique is (...) advanced to suggest its original elaboration fell confusedly between two versions of social systems theory. Drawing from late developments, the scheme is reinterpreted as distinguishing two forms of communication in capitalist society: delinguistified and linguistic. This opens the way to reframe and communicatively transform colonization as relinguistification; that is, the translation of monetary coding into ordinary language such that communicative action is distorted from within by reifying concepts.
