Artificial intelligence-based (AI) technologies such as machine learning (ML) systems are playing an increasingly relevant role in medicine and healthcare, bringing about novel ethical and epistemological issues that need to be timely addressed. Even though ethical questions connected to epistemic concerns have been at the center of the debate, it is going unnoticed how epistemic forms of injustice can be ML-induced, specifically in healthcare. I analyze the shortcomings of an ML system currently deployed in the USA to predict patients’ likelihood (...) of opioid addiction and misuse (PDMP algorithmic platforms). Drawing on this analysis, I aim to show that the wrong inflicted on epistemic agents involved in and affected by these systems’ decision-making processes can be captured through the lenses of Miranda Fricker’s account of hermeneutical injustice. I further argue that ML-induced hermeneutical injustice is particularly harmful due to what I define as an automated hermeneutical appropriation from the side of the ML system. The latter occurs if the ML system establishes meanings and shared hermeneutical resources without allowing for human oversight, impairing understanding and communication practices among stakeholders involved in medical decision-making. Furthermore and very much crucially, an automated hermeneutical appropriation can be recognized if physicians are strongly limited in their possibilities to safeguard patients from ML-induced hermeneutical injustice. Overall, my paper should expand the analysis of ethical issues raised by ML systems that are to be considered epistemic in nature, thus contributing to bridging the gap between these two dimensions in the ongoing debate. William Lynch has provided an informed and probing critique of my embrace of the post-truth condition, which he understands correctly as an extension of the normative project of social epistemology. This article roughly tracks the order of Lynch’s paper, beginning with the vexed role of the ‘normative’ in Science and Technology Studies, which originally triggered my version of social epistemology 35 years ago and has been guided by the field’s ‘symmetry principle’. Here the pejorative use of ‘populism’ to mean democracy (...) is highlighted as a failure of symmetry. Finally, after rejecting Lynch’s appeal to a hybrid Marxian–Darwinism, Carl Schmitt and Thomas Hobbes are contrasted en route to what I have called ‘quantum epistemology’. (shrink)

People can be treated unjustly with respect to the level of credibility others accord to their testimony. This is the core idea of the philosophical idea of epistemic justice. It should be of utmost interest to criminal law which extensively deals with normative issues of evidence and testimony. It may reconstruct some of the long-standing criticisms of criminal law regarding credibility assessments and the treatment of witnesses, especially in sexual assault cases. However, philosophical discussions often overlook the intricate complexities of (...) real procedural law and its underlying considerations. In its present form, the philosophical notion of epistemic injustice provides limited insights into legal discourse; it necessitates translation and adaptation. This study contributes to this endeavor by examining the contentious issue of testimony from witnesses who have undergone trauma-focused psychotherapy. Since the 1980s, courts worldwide were troubled with cases of false accusations based on false memories generated by suggestive therapeutic interventions. As a result, such post-therapy testimonies are discounted in one way or another in many jurisdictions. However, courts are still confronted with such testimonies, and the modi vivendi legal systems have established to deal with them continue to give rise to concerns about unjust treatment of witnesses. The question is thus whether legal rules or established practices of evaluating testimony based on memories which resurfaced after psychotherapy are epistemically and legally just. The paper presents seven ways in which courts may assess such testimonies and examines them in light of epistemic and procedural justice. Some of them prima facie constitute a form of epistemic injustice because they discount testimonies to an unwarranted degree. But these injustices might be justified by overriding principles favoring defendants. Nonetheless, the idea of epistemic justice, more broadly understood, inspires two principles that may serve as a foundation for a future conception of epistemic justice adapted to the law. (shrink)

In her account of scientific objectivity, feminist philosopher of science Helen Longino shows how scientific objectivity is not so much of individual practice, but rather a social commitment practiced by a scientific community, provided by the necessary accommodations for critical discourse. However, is this conception of scientific objectivity truly capable of living up to the social realities of critical discourse and deliberation within a scientific community? Drawing from Dutilh Novaes’ social epistemological account of argumentation, this paper highlights the challenges Longino’s (...) scientific objectivity faces on a prescriptive and descriptive level, specifically in overcoming the various epistemic injustices Longino’s proposed structural accommodations for objectivity are still sensitive to. Dutilh Novaes’ social epistemological model of argumentation illustrates how the realities of critical debate too often don’t consist of true epistemic or knowledge exchange, even though such exchanges are essential to achieve Longino’s primary goal when redefining scientific objectivity: to wield out and address idiosyncratic background assumptions and individual bigotry that possibly influence a researcher’s scientific conduct.
