The paper discusses the basic objections to the concept of „esoteric morality“ as a form of paternalism and elitism. The idea of „esoteric morality“, which originated with the Victorian utilitarian Henry Sidgwick, still has its supporters and opponents. While opponents point out that „esoteric morality“ violates the conceptual tie between morality and publicity, its proponents view it as a necessary part or implication of consequentialism.

In this essay I argue that the same considerations that justify the strong commitment to anti-paternalism that has been affirmed in bioethics over the past half century, also calls for anti-paternalistic public health policies. First, I frame the puzzle—why are citizens morally entitled to make unhealthy and medically inadvisable decisions as patients but not as consumers? I then briefly sketch the reasons why bioethicists typically reject paternalism. Next, I argue that those same reasons tell against paternalism in public health ethics (...) as well. Patients do not waive their rights to make medically inadvisable decisions when they leave their physician’s care. James Wilson disagrees. After I sketch Wilson’s arguments for paternalism in public health policy, I then argue, contra Wilson, that public health paternalism is wrong for the same reason that medical paternalism is wrong, and that the prevalence of paternalism in public policy does not mean that paternalism is morally permissible. I discuss the state’s authority to enforce paternalistic policies and I sketch an anti-paternalist vision for health policymakers. To close, I consider several objections. (shrink)

A task of any moral theory is to account for both the rigidity and the flexibility of moral rules. Utilitarianism faces the problem of building rigidity into a framework that tends towards objectionable flexibility. Kantianism faces the problem of building flexibility into a framework that tends towards objectionable rigidity. I offer an argument on this front on behalf of Kantians. I show how Kantians can maintain that actions are right and wrong "in themselves," while still maintaining that such actions can (...) be corrupted under certain "nonideal" circumstances. (shrink)

Among the most surprising claims in The Methods of Ethics is Sidgwick’s assertion that his key ethical axioms are corroborated by Kant. This article analyses Sidgwick’s claim that his axioms of justice and benevolence closely correspond to particular features in Kant. I shall argue that his claim of agreement with Kant was a serious overstatement. In particular, the restrictions which Sidgwick places on his acceptance of Kant’s universal law formula of the categorical imperative (FUL) seem to call into question whether (...) the alleged convergence with the axiom of justice has a solid basis. Further, Sidgwick seemed unaware of a crucial aspect of Kant’s conception of the humanity formula that constitutes a substantial divide between their views on benevolence. The upshot is that the divide between Kantian and Sidgwickian ethics appears deeper than Sidgwick seemed to realize. This analysis is confirmed by Sidgwick’s famous worries regarding freedom and the existence of God in Kant’s work. (shrink)

This paper makes a case for treating the boundary between what counts as practical reasoning and what does not as essentially indeterminate. The idea that there is an “essential indeterminacy in what can be counted as a rational deliberative process” was put forward by Bernard Williams in his well‐known discussion of statements about an agent's reasons for action. But in contrast to the more familiar argument of that paper, the idea has received almost no attention. To understand and defend the (...) idea, I first offer a somewhat novel reconstruction of the more familiar argument against making statements about a person's reasons intended on an “external” interpretation. On my reading, the argument shows how making such statements runs afoul of ideals of honesty in our interpersonal dealings. I then argue for countenancing an essential indeterminacy in what counts as practical reasoning, in a manner that involves a re‐application of these same ideals of honesty, albeit at a higher level of abstraction. One advantage of understanding the entire discussion of reasons statements and reasoning along these lines is that it highlights the deeply anti‐rationalistic flavor of Williams' own interest in these topics. Unsurprisingly, Williams' treatment displays a deep affinity with the anti‐rationalistic ethics advanced by Hume. It also turns out to be at cross purposes with the far more rationalistic ethical vision that animates more recent attempts to advance a “Humean Theory of Reasons,” which is sometimes mistakenly seen as following in Williams' and Hume's footsteps. This dissertation is, first, an examination of the coherence and consistency of Michel Foucault’s work with respect to its development and an examination of his ethos, a product of conscious self-construction. Second, this work is an exploration of ethical techniques. The goal of the dissertation is to discover an ethos that takes into account the best contemporary critical attitudes and techniques of ethical selfconstruction. The first chapter begins with a discussion of the development of Foucault’s archaeological method. Discussion of some (...) problems with structuralism, his genealogical method, and finally his movement towards an ethical program follows. The method for the dissertation will be exploratory and critical. The second chapter develops a line of thinking about the development of freedom in Kant and Foucault. Power relations are a persistent context in which selfconstruction takes place. Resistance to power relations marks the beginning of freedom, which requires testing and moving beyond the limits of socially constructed selves. The Quakers display a model of structured resistance to enclosing authorities. John Woolman provides an example of ethical self-construction. The third chapter explores Foucault’s ethical project by examining ancient Greco-Roman and Christian technologies of the self, and relates those projects to ethical self-construction through writing. This exploration shows continuity in the product of writing from Ancient through modern writers. The fourth chapter develops a postmodern ethos through an examination of weak ontology. James Rachels’ ethical programme is a model for a postmodern technology of the self. The resulting technique offered provides a vulnerability to facticity while retaining the best ethical principles and critical reasoning. This is illustrated in Miroslav Volf’s The End of Memory. Foucault’s ethos is a clear precursor to modern technologies of the self that take the exploration of knowledge with humility into account. (shrink)
