  • Institutionalising Responsibility: Implications for Jurisprudence.Nicola Lacey - 2013 - Jurisprudence 4 (1):1-19.
In this paper, the author suggest that the historical and institutional conditions of existence of the concepts which animate legal argumentation – like the historical and institutional conditions of existence of certain forms of law – are of interest not only in their own right, but also because they raise methodological issues for jurisprudence. These include questions about the relationship between concepts and the social phenomena which they purport to categorise; about the relationship between philosophical and other forms of legal (...)

The article offers a brief history of the Critical Legal Conference and the emergence of general jurisprudence as a main theoretical school in legal scholarship. • Morality, Law and the Fair Distribution of Freedom.Mario Ricciardi - 2013 - Criminal Law and Philosophy 7 (3):531-548.
Hart’s criticism of Devlin’s stance on the legal enforcement of morality has been highly influential in shaping a new liberal sensibility and in paving the way to many important legal reforms in the UK. After 50 years it is perhaps time to go back to Law, Liberty and Morality to see it in the perspective of the general evolution of Hart’s thought since the early 50s. This is a period of extraordinary creativity for the Oxford philosopher, in which he writes (...)

  • ¿Cabe el enfoque socio-jurídico en la teoría Del derecho?Manuel Calvo García - 2010 - Anales de la Cátedra Francisco Suárez 44:371-394.
The author maintains in this article that it is possible an approach between the positivistic legal theory, the one that follows the model of the analytical theory developed by Hart, and those others that apply a socio-legal method. Against what some defenders of both perspectives advocate, who view each others with some disdain, the author asserts the need to integrate legal theory with social sciences in the field of juridical ideas. This supposes opening spaces to develop a socio-legal theory of (...)

  • Sex in Context: Space, Place, and the Constitution of Images. [REVIEW]John Brigham - 2014 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 27 (1):47-63.
This paper examines the changing context for sexual images and the spaces that give law meaning. The details are evident in Congressional efforts to regulate sex on the Internet and the Supreme Court’s response as well as changing contexts for encountering forbidden images from the old stag films and peep shows to the local public library and sex sites on the web. The paper is part of a larger project on seeing law and the idea that Lady Justice is blind.
