The essay begins from Alan Gewirth's influential account of human rights, and specifically with his argument that the human right to political participation can only be fulfilled by competitive, liberal democracy. I show that his argument rests on empirical, rather than conceptual grounds, which opens the possibility that in China, alternative forms of participation may be legitimate or even superior. An examination of the theory and contemporary practice of 'democratic centralism' shows that while it does not now adequately support the (...) right to political participation, a reformed version could. I focus in particular on the roles that could be played by consultative institutions, looking both to recent Chinese proposals and to analogues currently existing in Japan. I conclude that a reformed democratic centralism may well be the objective toward which Chinese people should strive. (shrink)

The release of the Final Report of the Lyons Inquiry into Local Government in England, entitled Place-shaping: A shared ambition for the future of local government (Lyons Inquiry into Local Government) was a significant milestone in the debate on local government reform. Place-shaping is a sophisticated piece of rhetoric and policy making and can be seen to have relevance far beyond its own jurisdiction. Indigenous Peoples, Consent and Benefit Sharing is the first in-depth account of the Hoodia bioprospecting case and use of San traditional knowledge, placing it in the global context of indigenous peoples’ rights, consent and benefit-sharing. Although David Mitrany’s international thought is not usually associated with the concept of the international anarchy, I argue that his analysis actually compares two forms of anarchical order. The first form is the order associated with the relations between states, while the second is his functional alternative to this order. The functional approach is anarchical in the sense that it remains an order without an orderer. In first analysing the dynamics and failings of the inter-state order, and then suggesting pragmatic (...) process-orientated solutions to those failings, I argue that Mitrany follows a similar approach to his classical realist contemporaries. This gives rise to the contradictory scenario whereby such political actors at the central and sub-central levels remain the apostles of centralization on one hand and exponents of democracy as a model of national government on the other hand. Nigeria is the most populous African country. And this marginalization of the local government in the (...) democratic process is prevalent in Nigeria. Invariably, the pervasive effect of this condition, as it negatively affects the availability of dividends of democracy to the African citizen, is worrisome. In the meantime, the continent of Europe is perceived in the study as having possibly taken local government understanding to a model level of local self-governance, through its European Charter of Local Self-Government. Europe is thus, seen in this study as a region in the lead in situating the local government paradigm, within its proper democratic context. The theoretical framework of deliberative democracy is adopted in the study to engage African states to embrace local self-governance as a critical component of democratization. ]]>. (shrink)
