Part 2 of Volume 3 addresses in detail the conflicts between humor and cruelty, i.e., how cruelty can be unleashed against humor and, conversely, humor can be utilized against cruelty. Potent enmities to mirth and jollity are retrieved from a variety of socio-historical contexts, ranging from Europe’s medieval monasteries to the 2015 Charlie Hebdo massacre. Special attention is paid to the cruel humor and humorous cruelty arising thereof, insofar as such phenomena can reveal critical aspects of today’s neoliberal socio-economic order. (...) In parallel, settings where humor has been used as an instrument to cope with suffered cruelty, whether natural or human in origin, are also retrieved and discussed. These also vary greatly and encompass domains such as hospital wards, 20th-century Jewish ghettoes, and contemporary funeral homes. A set of concluding reflections is then offered on the psychological, theological, ethical, and metaphysical roots of humor—and its cruel rejection. (shrink)

The present book addresses the background, rationale, general structure, and particular aims and arguments characterizing our third and last volume about "humor" and "cruelty". A guiding foray is provided into the vast expert literature that can be retrieved in the Western humanities and social sciences on these two terms. Pivotal thinkers and crucial notions are duly identified, highlighted, and examined. Apposite subsidiary references are also included, especially with regard to psychodynamics and clinical psychology, existentialism, feminism, liberalism, Marxism, and representative recent (...) studies in the philosophy of humor and its cognates. The stage is thus set for the exploration and assessment of the conflicts between humor and cruelty unfolding in Part 2 of Volume 3. Being the philosophical terminus of our entire research project, Volume 3 counterbalances, complements, and, occasionally, complexifies the numerous forms of mutual cooperation between humor and cruelty that the preceding Volume 2 had unearthed and discussed. The truth-justification is an enduring explanation for valuing free speech. This paper seeks to advance an account of “assertion”, found in speech act theory, that can identify speech which contributes to truth-discovery in a nuanced way. I apply the dialectic theory of assertion which emphasises the language game of giving and asking for reasons to believe things as assertional social practice. In doing so, I consider what “moves” in this game make sense from a truth-discovery perspective, drawing together contemporary and (...) foundational work on assertion in linguistics to fit the normative context of law. Speech act theory is often invoked in current free speech literature to identify regulable speech, but less typically to identify speech that warrants legal protection. I contextualise my theory within this existing legal work and show how the model I advocate for applies across many formulations of the truth-justification to offer comprehensive explanatory and justificatory power. I also explore the potential appeal of alternative theories of assertion and explain why they are a poor fit in comparison to the dialectical account. (shrink)

I argue that there are strong consequentialist grounds for thinking that hate speech should be legally protected. The protection of hate speech allows those who are hateful to make their beliefs public, thereby exposing prejudices that might otherwise be suppressed to evaluation by other members of society. This greater transparency about prejudices has two social benefits. First, it facilitates social trust by making it easier to discover who holds beliefs that should exclude them from positions of authority, responsibility, and influence. (...) Second, it facilitates efforts to combat hatred by revealing which prejudiced members of society must be persuaded or discredited by those seeking to promote tolerance. (shrink)

As understood today, political correctness aims at preventing social discrimination by curtailing offensive speech and behaviour towards underprivileged groups of individuals. The core proponents of political correctness often draw on post-modernism and critical theory and are notorious for their scepticism about objective truth and scientific rationality. Conversely, the critics of post-modern political correctness uphold Enlightenment liberal principles of scientific reasoning, rational truth-seeking and open discourse against claims of relativism and oppression. Yet, both the post-modern proponents and their Enlightenment liberal critics (...) make up two sides of the same phenomenon of political correctness. Both sides intend to protect a liberal value system from illiberal truth-claims, which is the function of politically correct regulation. While post-modern advocates attempt to promote liberating tolerance, Enlightenment liberals place liberal values above the open-ended search for truth. Despite appearances to the contrary, this socio-academic debate is not about two sides favouring and opposing political correctness. In fact, it is a debate about the type of politically correct regulation that can better guard liberal values. (shrink)
