O artigo tem por objetivo aprofundar uma abordagem da noção de soberania, segundo análise de obras de Maquiavel estabelecida por Antonio Negri. O autor defende que a soberania para Maquiavel corresponde à sobredeterminação da ação do governante -seja no principado, seja na república- em face das limitações e oposições impostas pelos adversários e pela própria fortuna. Buscamos, assim, entender as características dessa acepção de soberania uma vez que o conceito é definido com exatidão por Jean Bodin, quase meio século após (...) a publicação dos textos maquiavelismos. Para observar essa abordagem, digamos, heterodoxa, da soberania será preciso nos concentraremos na sua tese da relação entre ontologia política e movimento. Para Negri, o movimento é o princípio definidor da política e na obra de Maquiavel se encontra uma concepção de ontologia política produzida e pensada da própria ação do governante no tempo e da qual o movimento é constitutivo e indiscernível. Observaremos como se desenvolve a análise do conflito no caso de cidades como Roma e Florença. Como conclusão pretendemos observar que limites a interpretação das Istorie Fiorentine apresenta à tese negriana da soberania democrática em Maquiavel. (shrink)

This article argues that Machiavelli’s chapters on the Decemvirate ( D 1.35, 1.40-45) advance an internal critique of the juridical discourse of sovereignty. I first contextualize these chapters in relation to several of Machiavelli’s potential sources, including Livy’s Ab urbe condita, Dionysius of Halicarnassus’s Roman Antiquities, and the antiquarian writings of Andrea Fiocchi and Giulio Pomponio Leto. I then analyze Machiavelli’s claim that the decemvirs held “absolute authority” ( autorità assoluta)—an authority that was unconstrained by either laws or countervailing magistrates. (...) I proceed to argue that Machiavelli’s account of the decemvirs’ election contains a web of allusions to the lex regia, the “royal law” by which the Roman people were thought to have conveyed their sovereign power to an emperor. By modeling the decemvirs’ election on the lex regia, Machiavelli reveals the political limitations of the doctrine of popular sovereignty; moreover, he illustrates that even free and fair elections can easily give rise to tyranny. This paper engages the debate within the ‘democratic turn’ in Machiavelli scholarship, where an ‘institutional’ approach has celebrated Machiavelli's theorisation of the institutions under which the people can rule while a ‘no-rule’ approach has traced Machiavelli's attention to the popular capacity to subvert all relations of rule. What do we make of Machiavelli's concurrent reception as a champion of popular rule and an antagonist to all rule? I argue that both institutionalising and subversive impulses appear simultaneously in Machiavelli's works, though (...) in a dynamic for which neither of the democratic approaches adequately accounts – namely, a rhetorical dimension of Machiavelli's works wherein political knowledge unfolds from a continuous multiplicity of perspectives and the ensuing implication that perspective is crafted and shaped through political action. Perspectival readings of Machiavelli's accounts of the Capuan debate and the Ciompi rebellion thus reveal that both democratic approaches have neglected to question certain ‘princely’ orientations toward political action inherited in their conceptualisations of Machiavellian democracy. In contrast, I suggest that Machiavelli's comedy La Mandragola offers an opportunity to reframe perspective as a uniquely democratic phenomenon. Reading the comedy alongside the democratic turn, I argue that it enacts, satirises and even casts doubts on Machiavelli's princely lessons, in turn proposing a popular capacity to cultivate perspective in a newly organised public space. While colonialism, in general, is a contested concept, as are the conditions that constitute its negation, political decolonisation seems to be a relatively settled argument. Where such decolonisation occurred, political independence, and its attendant democratic system and the undergirding of the rule of law, signify the self-evidentiality of such political decolonisation. This article rethinks this self-evidentiality of political independence as necessarily a decolonial political accomplishment in Ghana. This critical enterprise opens the documents that founded the newly independent state to alternative (...) reading to demonstrate how the colonial folded itself into the dictate of freedom. (shrink)

The question addressed by this article is whether a form of constituent power exists at the EU level. It is argued that European integration has not suppressed the idea of people as constituent power. Instead, the idea of ‘people’ has been constructed through the discourses of security and rights. Ever since the early stages of European integration, the security and rights discourses have consisted in the articulation of a meta-constitutional rationale, which is here called the ‘security of the European project’, (...) i.e. a form of political morality that is pursued by the EU as a polity over time and aims at its own survival. Security and rights discourses have contributed to constructing two ideas of ‘people-as-constituent-power’. The first idea is that of ‘mobile people’, i.e. people exercising EU free movement rights. The second idea is that of ‘peoples’ in the plural, conceived as States and citizens at the same time. Nevertheless, these discourses are characterised by a certain degree of ambiguity and have been unrolling as if the development of the EU polity was a mere technical, neutral matter. This state of affairs cannot continue: the European project has always been a political project, and, as integration reaches its more advanced stages, the time has come to disclose its political nature and address conflict openly. Years before his death, Romualdo Abulad made himself controversial, a controversy that was not so much on his positive contribution to philosophy as his apology for Duterte and his regime. In this paper, Abulad’s apology for Duterte will be discussed. The discussion will be framed from within Abulad’s concept of the post-Machiavelli. This concept was earlier developed by Abulad in a chapter of a book co-authored by Alfredo Co. I argue that his concept of the post-Machiavelli is based on a (...) privileging of The Prince and a reading that is subtly anti-Machiavellian. I further argue that the ethics of the post-Machiavelli, one that is guided by the philosophical compass of postmodernism, provided the ideological support for Duterte and his regime as it is both obscurantist and empty. The ethics of the post-Machiavelli obscures the politics of the regime by way of the ethics of the good. In doing so it legitimizes the political via the ethical. Here, the coupling or intersection of the political and the ethical provided an ideological support of the former by way of the abstract resources of the latter. However, I assert that ethics and politics ought to be decoupled. The ethics of the post-Machiavelli is likewise empty. Such an emptiness allows, at least in the level of theory, a liberal openness and accommodation to virtually any version of (a future) order, including that of fascism. (shrink)
