In noise we hear the possibility of a signal, indeed different signals, and in the multiplicity of signals we hear noise. With variation and selection comes dynamic evolution, a contingent state, one that could be otherwise. The term ‘polemogenous’ (from the French, polémogène) means that which generates polemics. And polemics are creative. If everyone, every system, were to reason in the same way, there would be silence. Every remark would be redundant, having no informational value. Thus noise is not bad. Autopoiesis is normally considered to be the systems theory in law. In this paper complexity theory is presented as an alternative systems approach. In order to position complexity theory as a plausible alternative to autopoiesis I discuss the differing understanding of boundary within each theory, and use this as a vehicle to critique autopoiesis. The current inclination, at the European level, to fund education in the form of projects radicalises the modern orientation towards the present as the attempt to bind a yet indeterminate future. This article proposes a close re-reading of Niklas Luhmann’s sociological oeuvre in order to problematise the place of the present in modern education. In an effort to sketch out the need for a new educational ecology, it then draws attention to how transnational projects articulate their educational meaning. |

The standard account in whistleblowing research fixes the birth of the whistleblowing concept in the early 1970s. Surprisingly, there are no efforts to discuss why whistleblowing emerged as a distinct new action repertoire at this particular moment in time. Whistleblowing is a historical latecomer to an ethos of field transgression, which includes well-established forms of intervention such as watchdog journalism and political activism. For Niklas Luhmann the body seems to almost disappear in modernity. Modern society, he argues, is a system comprised of a number of operatively closed and functionally distinct sub-systems such as economics, science, law, the mass media and so on. In my view, we need a sociological analysis to show how the crisis stemmed from a certain set-up of the so-called global society. Such a set-up is the product of a long historical development, which goes beyond the financial crisis? outbreak in 2008. The question I ask is the following: from a sociological standpoint, why did this crisis break out? And what remedies can be put in place?
