This article addresses the question of the coherence of enactivism as a research perspective by making a case study of enactivism in mathematics education research. Main theoretical directions in mathematics education are reviewed and the history of adoption of concepts from enactivism is described. It is concluded that enactivism offers a ‘grand theory’ that can be brought to bear on most of the phenomena of interest in mathematics education research, and so it provides a sufficient theoretical framework. It has particular (...) strength in describing interactions between cognitive systems, including human beings, human conversations and larger human social systems. Some apparent incoherencies of enactivism in mathematics education and in other fields come from the adoption of parts of enactivism that are then grafted onto incompatible theories. However, another significant source of incoherence is the inadequacy of Maturana’s definition of a social system and the lack of a generally agreed upon alternative. (shrink)

This philosophical anthropology tries to explore the basic categories of man’s being in the worlds using a special quantum meta-ontology that is introduced in the book. Quantum understanding of space and time, consciousness, or empirical/nonempirical reality elicits new questions relating to philosophical concerns such as subjectivity, free will, mind, perception, experience, dialectic, or agency. The authors have developed an inspiring theoretical framework transcending the boundaries of particular disciplines, e.g. quantum philosophy, metaphysics of consciousness, philosophy of mind, phenomenology of space and (...) time, and ontological relativity. Codes of conduct have become the perhaps most often used tool to manage corporate social responsibility (CSR). Researchers have primarily analysed such documents at company-wide or trans-company levels, whereas there is a dearth of studies into the use of codes for particular corporate functions. Hence, this article will examine one particular group of sub-company level codes, namely codes of conduct that stipulate CSR criteria for suppliers. Examining such ethical sourcing policies adopted by the FTSE100 corporations, the article draws out what (...) environmental, social and economic issues large corporations perceive to be important in the management of their supply chains. At an aggregate level, the coverage of CSR issues is rather extensive, yet at the level of the individual corporation a degree of selectivity in the issues that are addressed becomes noticeable. The code content analysis furthermore confirms the business case and public pressure to be the most important drivers of CSR. Finally, the study highlights the role of isomorphic processes in the adoption of CSR tools. (shrink)

The thesis is defended that the theories of causation, time and space, and levels of reality are mutually interrelated in such a way that the difficulties internal to theories of causation and to theories of space and time can be understood better, and perhaps dealt with, in the categorial context furnished by the theory of the levels of reality. The structural condition for this development to be possible is that the first two theories be opportunely generalized.

In this essay, I intend to focus on De Certeau’s ideas of use as consumption, as well as his theory of play, and then to place them both in conversation with Agamben’s conception of the ‘ assolutamente improfanabile’ – the absolute impossibility of profaning. I intend to apply De Certeau’s and Agamben’s ideas to an exploration of some recent trends in the high tech market regarding the creation of goods to which the notion of ‘AI’ may be particularly salient. I (...) hope to show, in contrast to Agamben’s overall deeply disillusioned analyses of late capitalism, that in such a market populated by various forms of ‘AI’ there are indeed new resources for resistance and nodes of creativity, as high tech consumers play with, and thus reconceptualize, both products and their use in terms helpfully articulated by De Certeau. ABSTRACT The paper critically evaluates Rahel Jaeggi’s concept of form of life. Particularly, it deals with the question of why one should want to criticize forms of life or society in the first place. While Jaeggi mentions issues of rationality and success, the paper refers to issues of suffering. Therefore, it introduces firstly the concept of pervasive doctrine, which aims at complementing, not at substituting, Jaeggi’s concept of form of life. A pervasive doctrine is composed by (1) a coherent system (...) of believes, by (2) a coherent set of values inspired by these believes, as well by a set of (3) norms and of (4) social practices organized around (1) and (2). It is pervasive insofar as it aims at explaining and regulating every aspect of the life of individuals and communities. The paper establishes, secondly, a connection between pervasive doctrines and systemic suffering, i.e. a suffering whose roots lie in the very way society is structured and the power relations within it that have been distributed along its history. Analysing the effects of pervasive doctrines in provoking systemic suffering is offered as a complementary critical strategy to the critique of forms of life provided by Jaeggi. (shrink)

This article focuses on theoretical reflections on sovereignty and constitutionalism in the context of the globalization and Europeanisation of the nation states, their politics, and legal systems. Starting from a critical assessment of the Kelsen-Schmitt polemic, the author claims that sovereignty needs to be analysed by the sociological method in order to disclose its current structural differentiation. The constitution of society may be imagined as the multitude of self-constituted and functionally differentiated social subsystems. The constitutional pluralism argument subsequently reconceptualizes sovereignty (...) as socially differentiated and divided between specific subsystems. The EU's differentiated constitutional domain and the paradox of divided sovereignty are used as examples of profound structural and semantic changes in contemporary national and transnational societies. While the sovereign nation-state institutions have become marginalized in political structures of European societies, the self-constitutionalization of the functionally differentiated EU legal system proceeds by internalizing the concept of divided sovereignty and using it semantically as its mode of self-reference. Autopoietic theory is increasingly seen as a candidate for a radical theory of law, both in relation to its theoretical credentials and its relevance in terms of new and emerging forms of law. An aspect of the theory that has remained less developed, however, is its material side, and more concretely the theory’s accommodation of bodies, space, objects and their claim to legal agency. The present article reads Luhmann’s theory of autopoietic systems in a radical and material manner, linking it (...) on the one hand to current post-structural theorisations of law and society, and on the other hand extending its ambit to accommodate the influx of material considerations that have been working their way through various other disciplines. The latter comprises both a materialisation of the theory itself and ways of conceptualising the legal system as material through and through. This I do by further developing what I have called Critical Autopoiesis, namely an acentric, topological, post-ecological and posthuman understanding of Luhmann’s theory, that draws on Deleuzian thought, feminist theory, geography, non-representational theory, and new material and object-oriented ontologies. These are combined with some well-rehearsed autopoietic concepts, such as distinction, environment and boundaries; Luhmann’s earlier work on materiality continuum; more recent work on bodies and space; as well as his work on form and medium in relation to art. The article concludes with five suggestions for an understanding of what critical autopoietic materiality might mean for law. (shrink)

ABSTRACT:The transition from modern to postmodern society leads to changing expectations about the purpose and responsibility of leadership. Habermas’s social theory provides a useful analytical tool for understanding current societal transition processes and exploring their implications for the responsibility of business vis-à-vis society. We argue that integrative responsible leadership, in particular, can contribute to the reconciliation of business with societal goals. Integrative responsible leadership understood in a Habermasian way is not only a strategic endeavor but also a communicative endeavor. An (...) essential part of integrative responsible leadership in light of the current societal transformation processes is the facilitation of discourses about a shared base of norms and values. This is exemplified alongside current societal developments like the European migration crisis or the emerging nationalist and fundamentalist movements in some countries. Transnational legal communication seeks to identify transnational legal regimes and attempts to establish channels and technics for comprehensible communication of the legal information to specified groups of recipients. It also strives to conclude about possible inconsistencies in law. The approach is based on the cooperation of scientists within the area of law and applied linguistics and the coordination of their efforts, in order to conduct research from various perspectives, share conclusions and develop more complete approaches as well as achieve and (...) mutually use more multilateral research results. It strives to reconcile legal research and linguistics research despite of their very different paradigms. The paper aims to explain the nature of legal communication and to establish its general research questions and objectives. The study is going to find an answer to the question what methods are to be used to communicate law comprehensively to its recipients and to draw conclusions on the consistency of legal regimes to be communicated. It accentuates that the solidarity necessary to achieve the objective of comprehensible and consistent law goes beyond the particular interests of individual sciences and is the foundation of the existence of the transnational legal communication community, non-depending on the place of living and the scope of practical knowledge. This article develops a notion of the ‘politics of time’ in order to analyse the effects that imaginations of future emergencies have in the fields of law and economy. Building on Niklas Luhmann’s theory of social time, it focuses on the multiplex temporalities in contemporary society, which are shown to interact differently with the ‘emergency imaginary’. We demonstrate that the apprehension of the future in terms of sudden, unpredictable and potentially catastrophic events reinforces current modes of producing financial futurity, while (...) it undermines the procedural rhythm and retroactive sentencing of liberal law. As a whole, the article supplements the analysis of the ‘politics of truth’ prevalent in the current debate about precaution and pre-emption with a theoretical perspective on social temporality. If the twentieth century was the age of the world picture taken as a photograph of the Whole Earth from outer space, today’s observations of the planet are produced by means of computer simulation. Pandemic models are of paramount sociological interest in this respect, since modelling contagion is closely intertwined with modelling the material connectivities of social life. By envisioning the global dynamics of disease transmission, pandemic simulations enact the relationscapes of a transnational world. This article seeks to analyse such (...) an enactment: It asks how simulation methods can establish a particular relation to the social from within the social. To provide an answer to this question, and adopting Niklas Luhmann’s theory of world society, pandemic simulations are described as modes of global self-observation that can be specified factually, socially, spatially and temporally. They instantiate a ‘doubling of reality’ designed to apprehend the potential future threat of disease transmission along the pathways marked by global infrastructures. They constitute scopic regimes that virtually synthesize a global situation of universal communicability in order to turn the world into an object of political intervention. (shrink)

The standard account in whistleblowing research fixes the birth of the whistleblowing concept in the early 1970s. Surprisingly, there are no efforts to discuss why whistleblowing emerged as a distinct new action repertoire at this particular moment in time. Whistleblowing is a historical latecomer to an ethos of field transgression, which includes well-established forms of intervention such as watchdog journalism and political activism. Whistleblowing has strong affinities with these practices, but also holds its own unique place in ethics and democracy. (...) We can only appreciate these qualities in full if we trace the historical origins of the concept. The article argues that the concept of whistleblowing crystallized at the intersection of a set of trends that picked up speed in the 1960s–1970s: individualization, changing perceptions of loyalty, declines in authority trust, new participation patterns, and a growing awareness of the dangers and complexities in human production and organization. This is not simply an exercise in disciplinary history. Whistleblowing is on the rise in these years, just as digitalization creates a whole new range of opportunities for disclosure. It takes an increasingly steady hand to isolate the distinct ethical-democratic contribution of whistleblowers within this complex reality. To achieve this, we need to be able to place whistleblowing on a broader sociological and historical map. (shrink)

Denmark was once at the forefront of nuclear research, operating three experimental nuclear reactors at the research facility at Risø, close to Copenhagen. However, the 1985 resolution of the Danish Parliament excluded nuclear power from the national energy mix. In 2003, the Parliament passed a resolution on the decommissioning of the nuclear facility at Risø, including plans for establishing a permanent solution for radioactive waste management. To understand the ensuing socio-technical controversy, we employ the “hybrid forum” framework that emphasizes the (...) entangled political-epistemological role of the municipalities and protest groups. They mobilized political resistance while also performing “research in the wild.” In 2016, the protest groups became part of an institutionalized “hybrid forum” where they could negotiate directly with experts and government representatives. We conclude that municipalities and protest groups were instrumental in changing the Danish position on radioactive waste management from final repository to long-term storage at Risø. (shrink)

To foster an adequate understanding of relational sociology, it is necessary to consider the theoretical grounds upon which it is based. The first aspect to highlight is the realist assumption of social relations as the causal force from which society originates. It is upon this decisive dimension that the difference between non-contingent and contingent aspects of the social is founded. Overlooking this difference issues in an inadequate understanding both of the autonomy of, and of the interaction between, actors and social (...) structures. Moving from these considerations, in the second part of this essay I will consider a third foundational aspect of social relations: social relations as ‘determination’ of reciprocity, and conclude my investigation by tackling the crucial theme of the social time of change and its connection to social relations. This essay explores what it means to be human in an age of infomedia. Appropriating Niklas Luhmann's systems theory/media theory in dialogue with other resources, I propose a post-Luhmannian paradigm of (1) extended media/meaning that conceives the world as world multimedia systems processing variegated meanings, and (2) an embodied, contextualized soft posthumanist anthropology that conceives the human as emergent collective phenomena of distinct meaning making by body-mind-society-technology media couplings. I argue: (1) Homo sapiens is Homo medialis distinct with mediatic communication (...) that emerged to cope with contingencies. (2) Evolution is the mediatization/codification of the world that culminated with the outcome of Homo medialis uniquely equipped to process transcendent meanings and to mediatize the world via diverse media—Mediatized Co-Mediatizer or Codified Co-Codifier. (3) This anthropic universe is possibly the most “meaningful” (full of meaning possibilities) of all possible worlds. (4) Social fragmentation could be an optimization; science-and-religion is an infomedium optimizing religion's manifest and science’ latent observation of divine manifestations. (shrink)

With an aim to develop a public theology for an age of information media (or media theology), this article proposes a new God-concept: God is a communicative system sui generis that autopoietically processes meaning/information in the supratemporal realm via perfect divine media ad intra (Word/Spirit). For this task, Niklas Luhmann's systems theory is critically appropriated in dialogue with theology. First, my working postmetaphysical/epistemological stance is articulated as realistic operational constructivism and functionalism. Second, a series of arguments are advanced to substantiate (...) the thesis: (1) God is an observing system sui generis ; (2) self-referential communication is divine operation; (3) unsurpassable complexity is divine mystery; (4) supratemporal autopoiesis of meaning is divine processing; (5) agape is the symbolic medium of divine communication. Third, this communicative model of God is developed into a trinitarian theology, with a claim that this model offers a viable alternative beyond the standard (psychic, social, process) models. Finally, some implications of this model are explored for constructive theology (conceiving creation as divine mediatization) and for science-and-religion in terms of derivative models: (1) God as a living system sui generis and (2) God as a meaning system sui generis. This article discusses New Confucian views on individuality and related philosophical problems. Special emphasis is given to the position of Tu Wei-Ming, a foremost living New Confucian thinker. It is pointed out that many New Confucian philosophers share a vision of a Confucian 'ideal' individuality or selfhood based on social integration - as opposed to a Western type of individuality sometimes portrayed as an individuality by isolation. These patterns of individuality are further examined on the basis of Niklas Luhmann's historical (...) analysis of the semantics of individuality and his categories of 'individuality by inclusion' and 'individuality by exclusion'. Finally, some parallels and differences between Confucian and the Luhmannian viewpoints are pointed out, and a suggestion on how a Luhmannian perspective might contribute to reformulations of New Confucian thought is attempted. This article outlines a critical systems theory approach to the study of populism by arguing that populism is an avenue of contestation which assumes a distinct role and function in the existing constitution of the political system. Most notably, it is characterised by the re-entry of a popular sovereignty dimension within regular political procedures. By taking up a critical systems theory perspective, it becomes possible to more precisely distinguish populism from other forms of politics, such as oppositional politics, social movement (...) politics or procedural constitutional politics. Further, populism’s oscillation between democratic and authoritarian dynamics can be elucidated as an inversion which operates from within its political form. Finally, it is argued that the critical systems theory approach provides a more nuanced understanding of populism’s inherent problems and, consequently, moves beyond a blunt defence or rejection of populism as such. Critical realism, especially as developed by Roy Bhaskar, embodies at its heart systemic and holistic concepts such as totality, emergence, open systems, stratification, autopoiesis and holistic causality. These concepts have their own long history of development in disciplines such as systems thinking and cybernetics, but there is an absence in Bhaskar’s writings, and that absence is a lack of any reference to the corresponding systems literature. The purpose of this paper is threefold: (i) to demonstrate the extent of this correspondence; (...) (ii) to show that critical realism can benefit from an exposure to these other discourses; and (iii) to show that systems thinking too can gain philosophically from critical realism. (shrink)

Designed to facilitate economic development, the corporate form now threatens human survival. This article presents an argument that organisations are yet to be ‘fit for purpose’ and that the corporate form needs to be re-designed to reach sustainability. It suggests that organisations need to recognise their agent status amongst a much wider and highly complex array of interconnected, dynamic economic, environmental and social systems. Human Factors theory is drawn on to propose that business systems could be made sustainable through re-design. (...) They could fit their environment more appropriately by improving: Efficiency, Adaptability and Social Cohesion. Leaders of organisations would also need to take a holistic approach to alter the organisation proactively to adapt to the systems within which it is embedded. (shrink)

This article argues that the failure of certain theories of reflexive identity transformation to consider more fully issues connected to gender identity leads to an overemphasis on the expressive possibilities thrown up by processes of detraditionalization. By ignoring certain deeply embedded aspects, some theories of reflexive change reproduce the `disembodied and disembedded' subject of masculinist thought. The issues of disembodiment and disembeddedness are explored through a study of the work of Pierre Bourdieu on `habitus' and the `field'. The idea of (...) habitus yields a more dynamic theory of embodiment central to a feminist understanding of gender identity as a durable but not immutable norm. The idea of the `field' provides a more differentiated analysis of the social context in which the reflexive transformation of gender identity unfolds. This in turn offers a way of thinking of possible transformations within gender identity as uneven and non-synchronous phenomena. (shrink)

This paper argues that ignorance, rather than being a result or representation of false beliefs or misinformation, is a compensatory epistemic adaptation of complex rhetoric systems. A rhetoric system is here defined as a set of interconnected rhetorical elements that cohere into a self-organized system that is thoroughly “about” its contexts—meaning that its own boundaries and relations are both constrained and enabled by the contexts in which it exists. Ignorance, as described here, is epistemic management that preserves the boundaries and (...) relations of a rhetoric system, and is a way of dealing with information that runs counter to one’s beliefs. Ignorance is also productive, in that it produces new knowledge that works to make rhetoric systems more resistant to potential destabilization. To elaborate these points, the paper examines discourse about the phenomenon of global climate change, which illustrates how individuals productively counter information as a way of preserving beliefs. As the paper argues, ignorance is neither a cognitive nor epistemological failure, but rather is a result of the dynamic and continuous process of enforcing epistemic and rhetorical boundaries. Towards the end of the 1960s—a period of intense creative, technological and political changes—the Argentinian art critic and entrepreneur Jorge Glusberg founded the CAyC in Buenos Aires. CAyC was an interdisciplinary experimental project that explored the relationship between art, technology and society. It sought to articulate a network of discussions and productions by a new style of Latin American artist, deeply influenced by science, technology and society. Glusberg defined such practice as Systems Art, which appeared in three ways, namely as (...) a system of collective representation; a system of meaning that defied formal categories; and a system of relationships and processes for social inquiry. In doing so, the artist became a researcher who reflected on their social context and the latter’s processes of production. This paper will discuss CAyC’s pioneering work and its global influence through three main initiatives: its exhibitions Art and Cybernetics, Systems Art in Latin America and the International Open Encounters on Video. These events were driven by the revolutionary artistic and experimental promotion of the distinctive ways in which Latin American artists were using technology to respond to local issues at a time when computer systems and cybernetic models for management and organizational practices were being introduced across the region. Across the globe, education has recently been through a major semantic shift, where new notions such as ‘learning’, ‘competences’, ‘projects’ came to replace or complement an older, more established, educational vocabulary. The political approach to education has also evolved, as many authors have underlined, from established national forms of governing to global, transnational forms of governance. These evolutions, often abbreviated to shifts ‘from teaching to learning’ and ‘from governing to governance’ have resonated globally and attracted the attention of researchers. Most (...) sociological accounts of such evolutions attribute them to the development and primacy of a preponderant logic, generally politics/power, culture or the economy. Niklas Luhmann’s systems theory, on which we draw in this article, suggests to start from a different, opposite, premise: not the predominance but instead the lack of any predominant logic characterizes modernity. The functional differentiation of modern society into a multiplicity of—specific yet universal—systems should therefore be the pivotal point that helps make sense of these transformations. We argue that the very coexistence of such systems, their simultaneous and therefore uncoordinated existences, increases the complexity of the social world tremendously and leaves them with an uncertain future. The so-called turns to governance and to learning, we argue, should be understood, respectively, as political and educational attempts to deal with this loss of direction. (shrink)

Since the foundation of the Santa Fe Institute, the new science of complex adaptive systems has seen extraordinary development, breaking with previous, more epistemological, trends in complexity theory. This article makes a critique of CAS as a model of the current global complexity. Its basic model, the cellular automaton, which focuses on the interactive dynamics among components, ignores the nature of any complex system as constructed by the observer/actor and is unable to explain the sociohistorical construction of the agents/subjects and (...) the social structure in which they are located, thus being unable to accurately represent the overall social complexity. Recently, philosophers and social scientists have turned their attention to the epistemological shifts provoked in established sciences by their incorporation of big data techniques. There has been less focus on the forms of epistemology proper to the investigation of algorithms themselves, understood as scientific objects in their own right. This article, based upon 12 months of ethnographic fieldwork with Russian data scientists, addresses this lack through an investigation of the specific forms of epistemic attention paid to algorithms by data scientists. (...) On the one hand, algorithms are unlike other mathematical objects in that they are not subject to disputation through deductive proof. On the other hand, unlike concrete things in the world such as particles or organisms, algorithms cannot be installed as the objects of experimental systems directly. They can only be evaluated in their functioning as components of extended computational assemblages; on their own, they are inert. As a consequence, the epistemological coding proper to this evaluation does not turn on truth and falsehood but rather on the efficiency of a given algorithmic assemblage. This article suggests that understanding the forms of algorithmic rationality employed in such inquiry is crucial for charting the place of data science within the contemporary academy and knowledge economy more generally. The paper investigates phenomenology’s possibilities to describe, reflect and critically analyse political and legal orders. It presents a “toolbox” of methodological reflections, tools and topics, by relating to the classics of the tradition and to the emerging movement of “critical phenomenology,” as well as by touching upon current issues such as experiences of rightlessness, experiences in the digital lifeworld, and experiences of the public sphere. It is argued that phenomenology provides us with a dynamic methodological framework that emphasizes correlational, co-constitutional, (...) and interrelational structures, and thus pays attention to modes of givenness, the making and unmaking of “world,” and, thereby, the inter/subjective, affective, and bodily constitution of meaning. In the case of political and legal orders, questions of power, exclusion, and normativity are central issues. By looking at “best practice” models such as Hannah Arendt’s analyses, the paper points out an analytical tool and flexible framework of “spaces of meaning” that phenomenologists can use and modify as they go along. In the current debates on political and legal issues, the author sees the main task of phenomenology to reclaim experience as world-building and world-opening, also in a normative sense, and to demonstrate how structures and orders are lived while they condition and form spaces of meaning. If we want to understand, criticize, act, or change something, this subjective and intersubjective perspective will remain indispensable. (shrink)

In this paper, I argue that recent sociological theory has become increasingly bifurcated into two mutually incompatible styles of theorizing that I label formalist and behavioral-realist. Formalism favors mathematization and proposes an instrumentalist ontology of abstract processes while behavioral-realist theory takes at its basis the "real" physical individual endowed with concrete biological, cognitive and neurophysiological capacities and constraints and attempts to derive the proper conceptualization of social behavior from that basis. Formalism tends to lead toward a conceptually independent sociology that (...) in principle requires only minimal reference to the empirical and ontological storehouse of other disciplines, while behavioral-realist theory leads to an interdisciplinary sociology that can be located within a hierarchy of behavioral sciences, leading to questions regarding the relationship between sociology and other disciplines as well as issues of transdisciplinary unification and possible interdisciplinary reduction. I explore the consequences of this split for the project of explanatory sociological theory within the context of how it has manifested itself in sociological network theory and social psychology. I close with a critique and assessment of formalist tendencies in sociological theorizing. (shrink)

Sociologists often imagine society as spaces, yet how social spaces are related remains ambiguous in most theories. In developing his field theory, Bourdieu used extensively the concept of homology to describe the structural similarities across fields, but he had not taken seriously the spaces between fields or how fields are related to each other. Adopting the Simmelian approach of formal sociology, this article outlines six basic social forms by which social spaces are related. It argues that relations between social spaces (...) can be understood along two dimensions: heterogeneity and social distance. In terms of heterogeneity, social spaces can be kindred, symbiotic or oppositional. In terms of social distance, they can be linked, nested or overlapping. These social forms of interspatial relations are constituted by the boundary work of a variety of actors, including guardians, brokers and space travellers. The article provides a general vocabulary for thinking about how social spaces are related and how they interact across boundaries. (shrink)

Plessner not only formulates a theory of positionality here but also a principle of how to construct this theory with respect to empirical research, a principle he calls the “deduction of the categories of life”. This is described in the literature as “reflexive deduction”. With reference to Plessner’s methodology of theory construction I unfold a new understanding of his theory of the shared world. At present, there are two understandings of the shared world. The traditional understanding of the shared world (...) is primarily concerned with relativizing particular individual selves, whose boundedness to their own standpoint is devalued by the we-form. I call this SWU-1. SWU-1 is not developed in accordance with the principle of reflexive deduction. The second understanding of the shared world, on the other hand, is developed, in accordance with that principle, as a reflexive turning upon the factual state of existing in relationships of touch. This leads to a different understanding of the shared world, which I call SWU-2, or the social undecidedness relation. Such an understanding of the shared world forces us to also reconsider our understanding of the inner and outer worlds. (shrink)

Theories of face-to-face interaction employ a concept of spatial presence and view communication via digital technologies as an inferior version of interaction, often with pathological implications. Current studies of mediatized communication challenge this notion with empirical evidence of “telepresence”, suggesting that users of such technologies experience their interactions as immediate. We argue that the phenomenological concepts of the lived body and mediated immediacy (Helmuth Plessner) combined with the concept of embodied space (Hermann Schmitz) can help overcome the pathologizing of digital (...) communication in social theory and enable descriptions which are truer to the experience of using said technology. From this perspective it appears as an ethnocentric premise to restrict interaction to human actors being present in local space. This restricted understanding of interaction does not allow for an appropriate empirical analysis of the emerging structures of digital communication. (shrink)

Latour is widely considered a critic and renewer of research in the social sciences. The ecologically minded Left has also acclaimed him as a theorist interested in bringing nature back both into sociological theory and into society and politics. To enable a more detailed discussion of Latour’s claims, I will here outline his theory and the ways in which it is related to classical theory, such as Durkheim, and the methodology of the interpretive paradigm, such as Schütz. My thesis is (...) that Latour’s empirical studies may be read as unfolding the methodological consequences of the interpretive paradigm, and that his early work is a brilliant proof of Durkheim’s theory of the morphology of social facts. Latour has now elaborated the insights he gained from concrete laboratory studies toward a general theory of the social, of society, and of politics. These generalizations have made his theory at least partly problematic. The political implication of Latour’s theory of society is a generalization of the call for equality to encompass everything; in other words, Latour criticizes the exclusion of nonhuman entities from political representation. This paper connects to Jon Bing’s great vision of an integrated national legal information system. The intention of this paper is to variegate Bing’s vision of an integrated information system by shifting the focus to the lay users, thus to those, who are subject to the law. The modified vision is an integrated information system that supports intelligible access to law for the citizens. This presupposes however an unambiguous and transparent legal system. Accordingly, it is also stressed that intelligent legal (...) knowledge engineering has high potential to increase precision and rationality in law, and hence safeguard the predictability of law and legal certainty. The central hypothesis is that putting the person who is subject to the law at the centre provides more rational reason to aim for the greatest possible precision of law by exploiting the means and technologies of our time than to uphold strategic vagueness. On this basis, the paper proposes the development of a basic set of controllable and justiciable basic legal drafting standards on EU and on national level, and promotes a transparency by design approach for legal knowledge engineering in order to enhance precision, integrity, comprehensibility and accessibility of law. Similarly to Jon Bing’s vision, this modified vision of an integrated legal information systems is, most probably, also likely to remain unfulfilled. During the sixties, a most curious symbiosis took hold between Heinz von Foerster then the Director of a top-notch and lavishly funded US laboratory [Biological Computer Laboratory, 1958–1975] and the Chilean neuroscientist Humberto R. Maturana professor at the Universidad de Chile. The chance encounter between them triggered a long-lasting friendship and a fundamental change in our understanding of Systems Science. In particular the contributions of Biology of Cognition and Autopoiesis are important to understand this change and the years 1968–1973 are (...) particularly relevant. In this period, Maturana published, as a Technical Report of BCL, the foundational document The Neurophysiology of Cognition. Later, in 1973, the book De Maquinas y Seres Vivos put forward the notion of Autopoietic Systems. Also, between 1971 and 1973, the Allende government tried to cybernitize the Chilean economy with the SYNCO project. In that project, Maturana and von Foerster played a role by teaching Cybernetics to the engineers and administrators of this technological dream. During this same time, Cybernetics was important in Chile and Professors Maturana and von Foerster although not directly involved in the day-to-day running of SYNCO were important in that unique effort. When a military coup deposed Allende and sent Chile into a tailspin of right-wing retribution, von Foerster, a foreigner who loved Chile and its people, did his outmost to assure the safety of many people involved in this unique Latin American Cybernetics dream.
