J. S. Mill's distinction between higher and lower pleasures is often thought to conflict with his commitment to psychological and ethical hedonism: if the superiority of higher pleasures is quantitative, then the higher/lower distinction is superfluous and Mill contradicts himself; if the superiority of higher pleasures is not quantitative, then Mill's hedonism is compromised.

David lyons has recently argued that mill's ethics is an alternative to both act and rule utilitarianism. In the first part of this paper I argue that lyons makes mill out to be far too much of a rule utilitarian. The second part of the article then provides an account of mill's theory of moral rules based on an analysis of the four functions rules serve in his ethics. On this reading mill's theory is a hybrid of act and rule (...) utilitarianism: violation of a moral rule is a necessary but not a sufficient condition for wrongdoing. (shrink)

Formulations of Mill's principle of utility are examined, and it is shown that Mill did not recognize a moral obligation to maximize the good, as is often assumed. His was neither a maximizing act nor rule utilitarianism. It was a distinctive minimizing utilitarianism which morally obligates us only to abstain from inflicting harm, to prevent harm, to provide for others minimal essentials of well being (to which rights correspond), and to be occasionally charitable or benevolent.

A book chapter (about 7,000 words, plus references) on the interpretation of Mill’s criterion of right and wrong, with particular attention to act utilitarianism, rule utilitarianism, and sanction utilitarianism. Along the way, major topics include Mill’s thoughts on liberalism, supererogation, the connection between wrongness and punishment, and breaking rules when doing so will produce more happiness than complying with them will.

Despite the prevalence of the terms utilitarianism and utilitarian in the health care and health policy literature, anecdotal evidence suggests that authors are often not fully aware of the diversity of utilitarian theories, their principles, and implications. Further, it seems that authors often categorically reject utilitarianism under the assumption that it violates individual rights. The tendency of act utilitarianism to neglect individual rights is attenuated, however, by the diminishing marginal utility of wealth and the disutility of a protest by those (...) who are disadvantaged. In practice, act utilitarians tend to introduce moral rules and preserve traditional rules. At the same time, the tenability of rule utilitarianism is limited because it ultimately collapses into act utilitarianism or a deontological theory. Negative utilitarianism is a viable utilitarian variant only if we accept complete aversion to suffering, ie, if we disregard any forgone opportunities to increase pleasure. Finally, the adoption of preference utilitarianism requires us to accept the subjectivity of individual claims which may be perceived as unfair. (shrink)

A TRADITIONAL VIEW OF UTILITY AND RIGHTS According to a conventional view, no project could be more hopelessly misconceived than the enterprise of attempting a utilitarian derivation of fundamental rights. We are all familiar – too familiar, perhaps – with the arguments that support this conventional view, but let us review them anyway. We may begin by recalling that, whereas the defining value of utilitarianism – pleasure, happiness or welfare – contains no mention of the dignity or autonomy of human (...) beings, it is this value which utilitarianism in all its standard forms invokes as the criterion of right action. Worse, insofar as utilitarian policy must have as its goal the maximization of welfare conceived as an aggregate summed over the utilities of everyone affected, legal and political utilitarianism seems bound to have a collectivist bias, trading on the dangerous fiction of a social entity and ignoring the distinctness of separate selves with their several incommensurable claims. It seems that, if individuals can appear in the utilitarian calculus at all, it will only be as ciphers, abstract place-holders for units of welfare. For, as an aggregative value, utility must be indifferent to distribution, and insensitive to the preeminently distributive considerations marked by claims about rights. So, if whatever has utility can be broken down into units or elements which are subject to measurement or at least comparison by a common standard, then it will always be possible that a very great loss of welfare for one man or a few men can be justified if it produces a great many small increments of welfare for a vast multitude of men. This essay addresses the collapse/incoherence problem for normative frameworks that contain both fundamental values and rules for promoting those values. The problem is that in some cases, we would bring about more of the fundamental value by violating the framework’s rules than by following them. In such cases, if the framework requires us to follow the rules anyway, then it appears to be incoherent; but if it allows us to make exceptions to the rules, then the framework “collapses” into one (...) that doesn’t make use of rules in the first place. The chapter begins with an examination of happiness and truth as fundamental values in Mill’s work, which lead into parallel versions of the collapse/incoherence problem in ethics and epistemology. It then sets out the collapse problem for rule-consequentialist approaches in ethics, truth-directed accounts of justification in epistemology, and epistemological approaches to argument cogency. The interpretation of the utilitarianism of John Stuart Mill has been a matter of controversy at least since J.O. Urmson published his well known paper over twenty-five years ago. Urmson attributed to Mill a form of “rule-utilitarianism”, contrasting his reading with the “received view” on which Mill held a form of “act-utilitarianism”. Since then, the interpretive problem has typically been seen to be that of determining which of these two types of theory should be attributed to Mill, or, at least (...) of determining whether Mill was a “rule-utilitarian”. However, as the distinction is typically made, it is possible to have a utilitarian theory which is neither an act- nor a rule-utilitarian theory. 1n particular, as I will attemptto show, Mill's theory is of neither type but is an example of a sophisticated type of utilitarianism which we might call “iterated-utilitarianism”, for reasons which will become clear in what follows. The argument of this paper is part of a general defence of the claim that Bentham's moral theory embodies a utilitarian theory of distributive justice, which is developed in his Civil Law writings. Whereas it is a commonplace of recent revisionist scholarship to argue that J. S. Mill had a developed utilitarian theory of justice, few scholars regard Bentham as having a theory of justice, let alone one that rivals in sophistication that of Mill. Indeed, Gerald J. Postema in his (...) book Bentham and the Common Law Tradition, argues that Bentham had no substantial concern with the concept of justice, and that what analysis of the concept there is in Bentham's thought is unlike the utilitarian theory of justice to be found in chapter five of J. S. Mill's Utilitarianism Although Postema's interpretation is not the only one that will be addressed in this paper, it serves as an important starting point for any rival interpretation of Bentham's ethical theory for two reasons. Firstly, it is the most comprehensive and most penetrating discussion of Bentham's utilitarian theory, drawing as it does on a wide variety of published and unpublished materials written throughout Bentham's career. Secondly, it is interesting in this particular context because the contrast that Postema draws between Bentham's and Mill's theories of justice depends upon a particular reading of Mill's theory of justice and utility which is derived from recent scholarship and which is by no means uncontroversial. As part of the defence of the claim that Bentham had a sophisticated theory of distributive justice, it will be argued in this paper that the contrast drawn between Bentham and Mill does not stand up to careful scrutiny, for insofar as Mill's theory of justice can be consistently defended it is not significantly different from the utilitarian strategy that Bentham employed for incorporating considerations of distributive justice within his theory. This is not to claim that there are not significant differences between the theories of justice of Bentham and J. S. Mill, but it is to claim that whatever technical differences exist between their theories, both writers saw the need to incorporate the concept of justice within utilitarianism. Therefore, rather than showing that Mill is an interesting thinker to the extent that he abandons his early Benthamism, by demonstrating how close Mill's theory of utility and justice is to that of Bentham, it will be possible to argue that Bentham employed a sophisticated and subtle utilitarian theory that was responsive to the sort of problems which occupied Mill a generation later. John Stuart Mill's commitment to liberty and individual development is one of the most exoteric themes of his moral and political philosophy. But the linkages between this commitment to liberty and development and Mill's conception of utility and principles of the good are not as commonly recognized. As part of a more general transformation of his utilitarianism, Mill repudiated Bentham's principles of the good and instead adopted a more sophisticated form of hedonism. While Bentham admits only the total quantity of (...) pleasure as contributing to value, Mill expands the circle to admit quality or kind of pleasure as well into the value reckoning. I have elsewhere interpreted and defended Mill's qualitative hedonism, and in this paper I can offer only a brief overview of that account and must largely assume its plausibility. Bentham and Mill agree that only pleasurable experiences and the absence of painful experiences have value and so both are called hedonists. But they have very different views about what properties of pleasures makes them valuable, or in other words what are the good-making properties of pleasure. Bentham thinks that only intensity and duration, or quantity, are good-making properties of pleasures, and thus he includes only these properties in measuring value. As a consequence, in the context of value measurement he is not interested in the kinds of things in which people take pleasure. But Mill is a qualitative hedonist, and thinks that the quality or kind of pleasure is also a good-making characteristic and thus should be included in value measurement. It is commonplace to criticize utilitarianism on the ground that it does not take moral rights seriously; that it cannot account for the rights we have, and for their role in constraining our pursuit of the overall good. Wayne Sumner does not directly address this criticism in The Moral Foundation of Rights. Instead he attempts to show that consequentialism can defeat nihilism about rights: the view that there are no moral rights at all.

In the fourteenth paragraph of the fifth chapter of Utilitarianism, J. S. Mill writes that ‘We do not call anything wrong, unless we mean to imply that a person ought to be punished in some way or other for doing it; if not by law, by the opinion of his fellow-creatures; if not by opinion, by the reproaches of his own conscience.’ I criticize the attempts of three commentators who have recently presented act-utilitarian readings of Mill – Roger Crisp, David (...) Brink, and Piers Norris Turner – to accommodate this passage. (shrink)

This is a defense of John Stuart Mill’s proof of the principle of utility in the fourth chapter of his Utilitarianism. The proof is notorious as a fallacious attempt by a prominent philosopher, who ought not to have made the elementary mistakes he is supposed to have made. This book shows that he did not. The aim is not to glorify utilitarianism, in a full sweep, as the best normative ethical theory, or even to vindicate, on a more specific level, (...) Mill’s universalistic ethical hedonism as the best form of utilitarianism. The book is concerned only with Mill’s utilitarianism, and primarily with his proof of the principle of utility. The purpose is to show that Mill proceeds intelligibly and systematically in pursuing a well-defined project in the fourth chapter of Utilitarianism, and that he successfully defends what he sets out to establish in his proof of the principle of utility. That's what I reckon morality is all about — how to preach, not how to act. My aim is not to answer this question of how to preach. I want to defend the claim that it is the, or at least a, central problem of ethics: that it is in fact the problem of what moral principles to accept.My argument consists of an account of what is involved in accepting a moral principle. By a moral principle I mean a kind (...) of principle about how people should act. Moral principles are not the only principles you can have about how people should act. There are principles of prudence, or rational self-interest. There are aesthetic principles, such as might be expressed in a remark like “you shouldn't put a magenta cushion on a scarlet sofa”. There are principles of etiquette. And no doubt there are others. I develop my account of morality by asking what distinguishes moral principles from the rest. (shrink)
