  1. A genealogy of the modern state.Quentin Skinner - 2009 - In Skinner Quentin (ed.), Proceedings of the British Academy, Volume 162, 2008 Lectures. pp. 325.
This lecture presents the text of the speech about the genealogy of the modern state delivered by the author at the 2008 British Academy Lecture. It explains that to investigate the genealogy of the state is to discover that there has never been any agreed concept to which the word state has answered. The lecture suggests that any moral or political term that has become so deeply enmeshed in so many ideological disputes over such a long period of time is (...)

  • The French New Right: multiculturalism of the right and the recognition/exclusionism syndrome.Alberto Spektorowski - 2012 - Journal of Global Ethics 8 (1):41-61.
This article studies a seeming paradox ? the adoption of multi-culturalist strategies and arguments by the neo-fascist European New Right. Why would neo-fascists adopt such a theoretical framework, and why has multiculturalism failed in Europe? In this article, I argue that the European New Right employs a multiculturalism framework, which I define as a recognition/exclusionist one, in order to create a new discourse of ?legitimate exclusionism? of non-authentic European immigrants. In short, multiculturalism, by celebrating differences between ethnic and cultural groups, (...)

  • Who is Afraid of Radical Pluralism? Legal Order and Political Stability in the Postnational Space.Nico Krisch - 2011 - Ratio Juris 24 (4):386-412.
Constitutional pluralism has become a principal model for understanding the legal and political structure of the European Union. Yet its variants are highly diverse, ranging from moderate “institutional” forms, closer to constitutionalist thinking, to “radical” ones which renounce a common framework to connect the different layers of law at play. Neil MacCormick, whose work was key for the rise of constitutional pluralism, shifted his approach from radical to institutional pluralism over time. This paper reconstructs the reasons for this shift—mainly concerns (...)

In this article we address the question of individual identity and its place – or rather omission – in contemporary discussions about the cosmopolitan extension of liberalism as the dominant political theory. The article is divided into two parts. In the first part we show that if we consistently emphasise the complementarity of the “inner” and “outer” identity of a person, which is essential to liberalism from its very beginnings, then a fundamental flaw in the liberal cosmopolitan project becomes apparent. • Concretized Norm and Sanction qua Fact in the Vienna School's Stufenbaulehre.Martin Borowski - 2014 - Ratio Juris 27 (1):79-93.
At the bottom level of the hierarchical structure (Stufenbau) of the legal system, the transition from “ought” to “is” has not been given its due. I argue that an additional level, that of fully concretized norms, belongs in the hierarchy. This sheds light on precisely where and how the transition from “ought” to “is” takes place. Whereas the fully concretized norm marks the bottom level in the hierarchy of norms, the coercive act or sanction qua fact is not found in (...)

  • Theorizing Sovereignty and European Integration.Matej Avbelj - 2014 - Ratio Juris 27 (3):344-363.
This article examines the relationship between the concept of sovereignty and the process of European integration. It is argued that the nature of this relationship has been both mutually informative and transformative. As a particular understanding of sovereignty has influenced and determined the perception of European integration, i.e., its conceptualization, so the process of European integration has reflected back on sovereignty and entailed its rethinking. This poses a particular challenge for legal theorists: how to pin down the meaning of sovereignty (...)

This paper offers a diachronic reconstruction of MacCormick's theory of law and legal argumentation: In particular, two related points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick's gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. The second point concerns MacCormick's acceptance (...)

The paper assesses the questions if and, if yes, how the republican conception of free statehood can and should inform a compelling understanding of a legitimate post-Westphalian political order. To answer these questions, it, first, reconstructs the foundational arguments of republican internationalists in favour of free states and, second, assesses the points of contention republican cosmopolitans raise. Third, it develops an alternative approach, a republicanism of plural polities: Based on a relational and multi-dimensional understanding of citizenship, the paper questions the (...)

One of the theoretical developments associated with the law of the European Union has been the flourishing of legal and constitutional theories that extol the virtues of pluralism. Pluralism in constitutional theory is offered in particular as a novel argument for the denial of unity within a framework of constitutional government. This paper argues that pluralism fails to respect the value of integrity. It also shows that at least one pluralist theory seeks to overcome the incoherence of pluralism by implicitly (...)

This article focuses on theoretical reflections on sovereignty and constitutionalism in the context of the globalization and Europeanisation of the nation states, their politics, and legal systems. Starting from a critical assessment of the Kelsen-Schmitt polemic, the author claims that sovereignty needs to be analysed by the sociological method in order to disclose its current structural differentiation. The constitution of society may be imagined as the multitude of self-constituted and functionally differentiated social subsystems. The constitutional pluralism argument subsequently reconceptualizes sovereignty (...)

The article examines recent theories of legal and constitutional pluralism, especially their adoption of sociological perspectives and criticisms of the concept of sovereignty. The author argues that John Griffiths's original dichotomy of “weak” and “strong” pluralism has to be reassessed because “weak” jurisprudential theories contain useful sociological analyses of the internal differentiation and operations of specific legal orders, their overlapping, parallel validity and collisions in global society. Using the sociological methodology of legal pluralism theories and critically elaborating on Teubner's societal (...)

The text analyzes the discourse on sovereignty in the Czech politics in the light of current processes of the transformation of sovereignty caused by the globalization and Europeanization. The author discusses the dispute between liberal-conservative critics of the European integration and cosmopolitan critics of the sovereign statehood and points to the limits of both positions. It is argued that the conservatives who warn against the loss of sovereignty in the ongoing process of Europeanization and who call for the protection of (...)
