This paper argues that the concept of paternalism is currently overextended to include a variety of actions that, while resembling paternalistic actions, are importantly different. I use the example of Japanese physicians’ non-disclosures of cancer diagnoses directly to patients, arguing that the concept of maternalism better captures these actions. To act paternalistically is to substitute one's own judgement for that of another person and decide in place of that person for his/her best interest. By contrast, to act maternalistically is to (...) decide for another person based on a reasonable understanding of that person's own preferences. The concept of maternalism allows for a more thorough assessment of the moral justification of these types of actions. I conclude that it is possible, at least in principle, to justify Japanese physicians’ non-disclosures, and that this justification must be based on an understanding of these actions as maternalistic. In what follows I will briefly address (1) Mahowald's work on Josiah Royce, (2) her advocacy for "cultural feminism" and its implications for American philosophy and work still to be done, (3) her promotion of a critical pragmatism and the need to provide a pragmatist critique not only of gender injustice but all forms of injustice, and (4) Mahowald's argument for the strategy of "standpoint theory," a strategy that offers great promise for future work in American philosophy.

En las últimas décadas, se viene abordando, en el marco de los Estudios de Género, la invisibilidad de las mujeres como grupo y de forma vinculada, el posterior reconocimiento de la diferencia femenina. Se ha estudiado el proceso de discapacitación que ha afectado a las mujeres de forma colectiva. A este respecto, resulta de interés la observación de las mencionadas circunstancias en el colectivo de las mujeres con discapacidad, grupo que ha sido sujeto central de análisis en los Estudios de (...) Género. Con este objeto, se realiza un recorrido por las diferentes aportaciones al tema desde las teorías de género y a partir del análisis que combina género y discapacidad. Se menciona además el sentido y la importancia de las publicaciones que al respecto se han editado; se aproxima su línea de trabajo con la muestra de algunos ejemplos. La presente contribución pretende acercar la reflexión alrededor de la construcción de la diferencia en las mujeres con discapacidad, como grupo "minorizado" en la sociedad. (shrink)
