In an article titled ‘The end of ubuntu’ recently published in this journal, Bernard Matolino and Wenceslaus Kwindingwi argue that contemporary conditions in (South) Africa are such that there is no justification for appealing to an ethic associated with talk of ‘ubuntu’. They argue that political elites who invoke ubuntu do so in ways that serve nefarious functions, such as unreasonably narrowing discourse about how best to live, while the moral ideals of ubuntu are appropriate only for a bygone, pre-modern (...) age. Since there is nothing ethically promising about ubuntu for today’s society, and since elite appeals to it serve undesirable purposes there, the authors conclude that ubuntu in academic and political circles ‘has reached its end’. In this article, I respond to Matolino and Kwindingwi, contending that, in fact, we should view scholarly enquiry into, and the political application of, ubuntu as projects that are only now properly getting started. There has been the recurrent suspicion that community, harmony, cohesion, and similar relational goods as understood in the African ethical tradition threaten to occlude difference. Often, it has been Western defenders of liberty who have raised the concern that these characteristically sub-Saharan values fail to account adequately for individuality, although some contemporary African thinkers have expressed the same concern. In this chapter, I provide a certain understanding of the sub-Saharan value of communal relationship and demonstrate that it entails a substantial (...) allowance for difference. I aim to show that African thinkers need not appeal to, say, characteristically Euro-American values of authenticity or autonomy to make sense of why individuals should not be pressured to conform to a group’s norms regarding sex and gender. In this article I compare and, especially, contrast Aristotle’s conception of virtue with one typical of sub-Saharan philosophers. I point out that the latter is strictly other-regarding, and specifically communitarian, and contend that the former, while including such elements, also includes some self-regarding or individualist virtues, such as temperance and knowledge. I also argue that Aristotle’s conception of human excellence is more attractive than the sub-Saharan view as a complete account of how to live, but that the African conception is (...) a strong contender for a limited group of the most important virtues related to morality qua rightness. A comprehensive account of justice grounded on salient Afro-communitarian values, the article attempts to unify views about the distribution of economic resources, the protection of human rights and the provision of social recognition as ultimately being about proper ways to value loving relationships.

The belief that human rights are culturally relative has been reinforced by recent attempts to develop more plausible conceptions of human rights whose philosophical foundations are closely aligned with culture-specific ideas about human nature and/or dignity. This paper contests specifically the position that a conception of human rights is culturally relative by way of contesting the claim that there is an African case in point. That is, it contests the claim that there is a unique theory of rights. It analyses (...) three examples of what often passes as African conception of human rights arguing that they have little or nothing to do with human rights, are simply inadequate or are not African in the sense at issue in a cultural relativism. Along the way, it distinguishes between two meanings of the term African contending that to the extent that the practice of prizing the ‘community’ higher than any other value is definitive of African, the idea of African human rights remains suspect. A communitarian perspective, which is characteristic of African normative thought, accords some kind of primacy to society or a group, whereas human rights are by definition duties that others have to treat individuals in certain ways, even when not doing so would be better for others. Is there any place for human rights in an Afro-communitarian political and legal philosophy, and, if so, what is it? I seek to answer these questions, in part by critically exploring one of the most (...) influential theoretical works on human rights in a sub-Saharan setting, namely, Claude Ake’s ‘The African Context of Human Rights’. Ake famously maintains that a typically Western approach to rights is inappropriate in the sub-Saharan region, in two major respects. First, Ake contends that although a human rights legal framework might be suitable for an ‘individualistic’ society, it is not for one of the sort common among traditional black peoples, for whom group rights are alone apt. Second, Ake maintains that, insofar as rights are relevant, rights to socio-economic goods are of much more importance in an African context than rights to civil liberties, due process and the like. Using Ake’s article as a foil, I draw on values salient in sub-Saharan moral worldviews to construct a unified philosophy of rights that not only provides reason to doubt his two claims, but also offers a promising way to reconcile a communitarian framework with a robust prizing of human rights alongside ones that are more collectively oriented. In short, I aim to provide a principled foundation for the core elements of the African Charter of Human and Peoples’ Rights. (shrink)

The International Bill of Human Rights (IBHR) enjoys universal acclaim as the source of the best standards and definition of human rights. This paper argues that the IBHR is inspired by liberalism and harbours ambiguities that open the door to a neoliberal seizure of the rights agenda; and that this effectively destabilises the focus on the IBHR on socio-economic and community rights, and therefore its stated ideal of the equal value of all human rights. I argue that Kwame Gyekye's moderate (...) communitarian political philosophy affords a viable philosophical basis for justification of a more balanced conception of human rights than the theoretical basis of the IBHR does. I focus on D A Masolo’s discussion of morality as characteristically understood by African philosophers. My goals are both historical and substantive, meaning that I use reflection on Masolo’s book as an occasion to shed light not only on the nature of recent debates about African ethics, but also on African ethics itself. With regard to history, I argue that Masolo’s discussion of sub-Saharan morality suggests at least two major ways that the field has construed it, depending on which value (...) is taken to be basic and which ones are deemed derivative. According to one perspective, the ultimate aim of a moral agent should be to improve people’s quality of life, which she can reliably do by supporting community in certain ways, while the other view is that community should instead be valued for its own sake, with the enhancement of welfare being morally relevant only insofar as it is part of that. I claim that Masolo does not indicate a clear awareness of how these two perspectives differ and is not explicit about how they relate to one another. After pointing out that Masolo is not alone in these respects, I draw what is meant to be a definitive, clear distinction between the two major ethical philosophies. Then, I provide what I deem to be conclusive reason to prefer the community- based conception of sub-Saharan ethics to the welfare-based one. (shrink)

This article attempts to defend Kwame Gyekye’s moderate communitarianism (MC) from the trenchant criticism that it is as defective as radical communitarianism (RC) since they both fail to take rights seriously. As part of my response, I raise two critical questions. Firstly, I question the supposition in the literature that there is such a thing as radical communitarianism. I point out that talk of radical communitarianism is tantamount to attacking a “straw-man.” Secondly, I question the efficacy of the criticism that (...) MC does not take rights seriously, given that there is no account of what it means to take rights seriously in the African tradition. This criticism, insofar as it does not specify a criterion of what it means to take rights seriously, remains defective. The central contribution of this article is to call our attention to the fact that the intellectual culture of rights will surely be affected by Afro-communitarianism, which emphasises our duties to all. With her new book, The Conceptual Foundations of Transitional Justice, Colleen Murphy has advanced novel, comprehensive and sophisticated philosophical accounts of both what severely conflict-ridden societies should be aiming for and how they should pursue it. Ultimately grounded on a prizing of rational agency, Murphy maintains that these societies, roughly, ought to strive for a stable and legitimate democratic polity committed to not repeating gross historical injustice and do so in ways that do right by victims. In this article, I (...) argue, contra Murphy, that achieving democratic rights to political participation should not be considered an essential aim of transitional justice, and that, in contrast, doing right by victims should be considered an essential aim of it, not merely an appropriate means to achieving other aims. In addition, I highlight an issue downplayed in Murphy’s book, namely, the need to make trade-offs amongst the aims of transitional justice, which becomes particularly pressing upon accepting that doing right by victims is one of them. While there is a budding literature on media ethics in the light of characteristic sub-Saharan moral values, there is virtually nothing on wartime reporting more specifically. Furthermore, the literature insofar as it has a bearing on wartime reporting suggests that embedded journalism and patriotic journalism are ethically justified during war. In this essay, I sketch a prima facie attractive African moral theory, grounded on a certain interpretation of the value of communal relationship, and bring out what it entails for the (...) ways journalists should report on war. My aims are the normative ones of showing how this Afro-communal ethic can provide a unitary foundation for a wide array of plausible conclusions about reporting on war, and, in particular, can avoid objectionable implications such as support for embedded and patriotic journalism. In Debating Brain Drain, Gillian Brock and Michael Blake both draw on a liberal moral- political foundation to address the issue, but they come to different conclusions about it. Despite the common ground of free and equal persons having a dignity that grounds human rights, Brock concludes that many medical professionals who leave a developing country soon after having received training there are wrong to do so and that the state may place some limits on their ability to exit, whereas (...) Blake infers that there is neither any wrongdoing on their part, nor rightful restrictions placed on them. In this article, rather than sort out which has the better interpretation of what liberalism entails, I consider the medical brain drain in light of an alternative normative framework, one informed by ideals of communion salient in the sub-Saharan moral tradition. I argue that a principle of prizing communal relationships more naturally entails Brock's conclusions than does her appeal to liberalism. (shrink)

In this chapter, I add to the new body of philosophical literature that addresses African approaches to just war by reflecting on some topics that have yet to be considered and by advancing different perspectives. My approach is two-fold. First, I spell out a foundational African ethic, according to which one must treat people’s capacity to relate communally with respect. Second, I derive principles from it to govern the use of force and violence, and compare and contrast their implications for (...) war with other recent African views and especially with some prominent accounts in contemporary Anglo-American philosophy. I argue that the approaches to military conflict prescribed by the Afro-communal ethic and its derivative principles differ, and in some prima facie plausible ways, from the views of thinkers that include Thomas Hurka, David Luban, Larry May, Jeff McMahan, and Michael Walzer. In particular, I conclude that the African perspectives ground some interesting and under-explored approaches to just causes for war that merit consideration, including the ideas that military conflict could in principle be justified in order to protect a people’s culture or to correct an aggressor’s vice. Is normative theory grounded in ontology and if so, how? Taking a debate between Kwame Gyekye and Thaddeus Metz as my point of departure, my aim in this article is to show that something normative does indeed follow from ontological views: The social ontological, I maintain, circumscribes the normative without, however, fully determining its content. My argument proceeds in two steps: First, I argue that our social ontological position constrains what kind of normative theory we may plausibly defend. A relational (...) ontology as defended by Gyekye entails a relational normative theory, whereas an atomist ontology calls for an individualist normative approach and a collectivist ontology for a strong communitarian one. Second, this link between the ontological and the normative has substantive implications for how to interpret the normative content of a theory; it entails interpreting normative values in light of the appropriate kind of normative thought. I illustrate the importance of this implication by showing that it suggests a decidedly relational reading of the core value of well-being in Gyekye’s moderate communitarianism, that resolves the alleged tension between communal and individual values in his account. Karl Popper is famous for favoring an open society, one in which the individual is treated as an end in himself and social arrangements are subjected to critical evaluation, which he defends largely by appeal to a Kantian ethic of respecting the dignity of rational beings. In this essay, I consider for the first time what the implications of a characteristically African ethic, instead prescribing respect for our capacity to relate communally, are for how the state should operate in an (...) open society. I argue that while an under-appreciated Afro-communal moral foundation does not prescribe a closed society, it supports an open society politics and law of a sort different from the one that Popper specifies. For Popper, the state in an open society should improve social arrangements albeit without seeking to promote a particular conception of the good life, should protect rights that merely serve the function of facilitating individual choice, and should employ majoritarian democracy to be able to avoid unwelcome rulers and policies. On all three counts, I show that a relational ethic typical of the African philosophical tradition, but having broad intuitive appeal, entails different, intuitively attractive approaches to politics and law. I critically examine the South African university student and worker protests of 2015/2016 in light of moral principles governing the use of force that are largely uncontested in both the contemporary Western and African philosophies of just war, violence and threats. Amongst these principles are: “discrimination”, according to which force should be directed not towards innocent bystanders but instead should target those particularly responsible for injustice; “likely success”, meaning that, instead of being counter-productive, the use of force must be reasonably (...) expected to advance a just cause; and “last resort”, which entails that only the least force necessary to rebut injustice should be employed. I invoke these and related principles to appraise a wide array of types of student/worker protests, noting which of them accorded with the principles and which did not. I also reply to defences that some South Africans have recently made of protesting with coercion and destruction. (shrink)

There has been a strong impetus to set the definitional parameters of study in African political philosophy and theory. Many scholars advance the idea of a discipline intended to provide lessons that stem from “original” African moral, ideological, and political traditions. Often, these traditions and their ideas are presented as holding categorical moral substance in so far as they are seen to be specific to a culturally essentialist understanding of “Africa.” In turn, an influential part of the literature estimates the (...) normative value of the intellectual ideas and arguments afforded by a varied historical, socio‐cultural and economic African geography by the degree to which, in being tethered to a seemingly homogenous, “culturally African” influence, these ideas can be opposed to a “Western” equivalent. In this article, I argue that the effects on the discipline of attending to, and being defined by, this cultural essentialism are at best unclear, at worst detrimental. I aim to contribute to the side of those who advocate a universalist perspective to the study of African political philosophy and thought, and who argue for jettisoning an unhelpful dichotomy between “West” and “African,” in favour of a methodological, conceptual and historical specificity that allows the discipline to be truly useful to itself and to others. Digitality is increasingly central to individuals’ existence, which has political implications. The article maps the political implications of digitalisation, focusing on African political thought. The latter is marked by Afro-communitarianism ideas, which foster solidarity, relationality, and communalism as foundational values of the polity. However, African communitarianism has granted little attention to contemporary phenomena such as digitalisation. Also, political theory discussions on digitality have looked mainly at (neo)liberal contexts. How the digital age is reshaping the tenets of communitarian political theories represents (...) an underdiscussed issue. This article outlines a research agenda on digitality and African political thought. New digitality-enabled relational modes change human and political interactions. The issue at stake is how these new modes challenge or strengthen the Afro-communitarian political outlook. This article recognises digital-humanism, political community, relations of power as central matters of inquiry. The analysis relies on bibliographic sources from African philosophy and comparative political theory. (shrink)

I address four major objections that have been advanced against the system of multiparty majority democracy that I proposed as an alternative to Wiredu’s non-party consensual democracy. First, that the system is not durable since it is structured around ill-defined ethnic groups; second, that since it envisions each ethnic group as a semi-autonomous entity, the system undermines the integrative process of nation-building; third, that, as a type of federalism, the system has no precedents on African soil, and consequently, that it (...) is likely to face the problem of imperfect fit; and fourth, that some African ethnic groups are too small to stand as semi-autonomous entities. I then underscore four advantages of my system over Wiredu’s: It honours the right of freedom of association; addresses the problem of the marginalisation of minority ethnic groups; reaps the benefits of both non-party and multiparty democracy; and entrenches the ingredients of consensual democracy.
