Moses Finley's reflections on ancient and modern democracy, explicitly directed against the liberal mainstream of political science, but also - avant la lettre - against the belittling of Greek democracy that has become fashionable among post-Marxist radicals, can be taken as a starting point for further discussion of historical as well as theoretical questions. The points at issue have to do with the belated recognition of democracy as a part of the Greek tradition, but also with the divided and contested (...) modern tradition that grew out of this new perspective on the past. The French Revolution is crucial to both aspects of the problem. Although it can be shown that the well-known attempts of the revolutionaries to appropriate classical models did not - in the short run - radically alter the image of ancient Greece, the very experience of the revolution - both as an exceptionally dramatic historical event and as a key episode in a more long-term process - was bound to change modern perceptions of the classical world. The new understanding of Greek democracy, made possible by the revolution but not inspired by it, was first articulated by the radical wing of 19th-century liberalism; but it could, in due course, serve to develop a critique of liberalism. Demokratien geraten zunehmend unter Druck. Dabei wird die Bedeutung von Demokratie selbst zum Gegenstand der Auseinandersetzung. Diese Auseinandersetzungen nimmt der vorliegende Band zum Anlass, die Bedeutung von Demokratie grundsätzlich zu untersuchen. Mit dem Begriff der Konstituenzien sind dabei jene wesentlichen Bedingungen gemeint, die Demokratie ausmachen. Die meisten dieser Bedingungen sind normativ. Was Demokratie ist, wird auch und gerade dadurch bestimmt, was Demokratie sein sollte. Damit geht es um jene Normen, deren Verwirklichung politische Praktiken zu demokratischen Praktiken macht. Sind diese Normen (...) nur eingeschränkt verwirklicht, mindert sich der demokratische Gehalt von Politik. Inwieweit ist dann nun aber eigentlich der Fall? Und was können wir dagegen tun? Antworten auf diese Fragen geben einschlägige Vertreterinnen und Vertreter aus Philosophie, Politik- und Rechtswissenschaft. (shrink)

¿Cómo pensar el sorteo con eficacia? Mi propuesta es construir una teoría general del sorteo, abordándolo de forma comparativa, para averiguar cuáles son las constantes teóricas entre la gran diversidad empírica de sus usos particulares. En primer lugar, comparo el sorteo a los otros tres modos de selección: elección, nombramiento o cooptación y certificación. En segundo lugar, analizo los marcos deliberativos, es decir, “quién decide qué y cómo”. Tercero, distingo cuatro principios democráticos del sorteo: igualdad, imparcialidad, representatividad y legitimidad. Mi (...) primera hipótesis es que el sorteo amplía considerablemente la igualdad, imparcialidad y representatividad. La segunda de mis hipótesis radica en que el sorteo es el único método de selección con una forma específica de humildad-legitimidad, mientras que los tres restantes modos de selección producen una superioridad-legitimidad que declara superior al representante por encima del representado a través del proceso de selección. This article explores the tension between an understanding of Europe as purveyor of a certain kind of cultural, spiritual or religious identity and the more or less bureaucratic project of European construction undertaken in its name. The central axis of this tension is the theoretical relationship between identity and legitimacy. The classical modern problem of nation-state building involves integrating the legitimating force of collective identity into the institutions of the state. How does the project of European construction respond to an (...) analogous challenge? This article develops this theoretical question by turning to two canonical positions concerning the relation between institutional legitimacy and its cultural, spiritual or religious under-pinnings - Montesquieu and Weber. It then returns to the founding documents of the EU in order to interrogate the legitimacy of the EU in light of the concept of European identity. (shrink)
