This paper advances a framework to conceptualize societal care-giving arrangements abstractly. It is abstract in that it brackets the meaning of our particular relationships. This framework, which I call “the arrow of care map”, is a descriptive tracking model that is a necessary component of a theory of justice, but it is not a normative prescription in itself. The basic idea of the map is then multiply specifiable to track various ascriptive identity categories as well as different categories of care (...) labor. In this way, the idea of the arrow of care map serves as a conceptual frame within which to begin to understand every human society’s care-giving arrangement. I characterize it as a component of “ideal theory” insofar as it seeks to clarify our values, without the immediate aim of formulating principles to govern a just society. The resultant partial theory of justice is one that responds to non-ideal theory’s critiques of the ideological nature of liberal contractarianism’s idealizations and abstractions while moving towards new visions of a just society. This paper focuses on how experiences of trauma can lead to generalized fear of people, objects and places that are similar or contextually or conceptually related to those that produced the initial fear, causing epistemic, affective, and practical harms to those who are unduly feared and those who are intimates of the victim of trauma. We argue that cases of fear generalization that bring harm to other people constitute examples of injustice closely akin to testimonial injustice, specifically, mnemonic injustice. Mnemonic (...) injustice is a label that has been introduced to capture how injustice can occur via the operation of human memory systems when stereotypes shape what is remembered. Here we argue that injustices can also occur via memory systems when trauma leads to a generalized fear. We also argue that this calls for a reformulation of the notion of mnemonic injustice. This article addresses the debate on fuzzy cases concerning the so called ‘mild’ and sporadic instances of physical violence against children by caregivers. The end of violence toward children is a current goal in the international scenario. However, myths on the use of violence and the scope of parental rights still survive. Thus, I examine the main theoretical, ethical and political challenges regarding conceptual clear-cut boun- daries and the burden of proof when justifying violence. Finally, I defend the role of (...) a preventive approach on children’s wellbeing and family intervention as a fruitful way to surpass polarized debates on permi- ssibility and criminalization. Beschäftigt man sich systematisch mit der Konzeption von Gerechtigkeit für Kinder bzw. während der Kindheit, ist es hilfreich, drei verschiedene Fragen zu klären, die normalerweise in Hinblick auf Erwachsene diskutiert werden, doch auch für eine genauere Analyse der Ansprüche von Kindern relevant sind. Welche Güter sind für die Gerechtigkeitstheorie relevant? Nach welchen Prinzipien sollen diese Güter verteilt werden? Wer ist dafür verantwortlich, dass die angestrebte Güterverteilung verwirklicht wird? In dieser Einleitung umreißen wir kurz den gegenwärtigen Diskussionsstand, der in diesen drei (...) großen gerechtigkeitsrelevanten Themenfeldern hinsichtlich von Kindern besteht. Zunächst analysieren wir Ressourcen und Fähigkeiten als angemessene Metrik der Gerechtigkeit für Kinder. Hinsichtlich der Verteilungsprinzipien lassen sich vor allem egalitäre und suffizienztheoretische Herangehensweisen unterscheiden. Schließlich werden in Bezug auf die Frage nach den relevanten „Akteuren der Gerechtigkeit“ für Kinder hauptsächlich die Familie bzw. die Eltern und der Staat diskutiert. (shrink)

Children are affected by poverty more often than adults, and growing up in poverty has severe and long-lasting negative consequences for a child’s well-being. How-ever, children are also in a very weak position, both to escape poverty on their own and to publicly and politically enforce their claims to a better life. Accordingly, children living in poverty are victims of two intersecting forms of powerlessness: they are children and they are poor. In this article, we analyze this particular type of (...) powerlessness from a children’s rights perspective and argue that, in order to effectively restore justice to children in pov-erty, the State has to implement a comprehensive children’s rights regime. We argue that the State is obliged to consider children’s best interests in all its policies – even those that are not directly related to children – in order to compensate for the lack of political agency during childhood. This demand reflects the particular social and political status of children, namely: that they are dependent on others for their well-being, that childhood is a phase of particular vulnerability and that (young) children lack certain competencies that are needed to enforce their claims. Justice for children meets specific obstacles when it comes to its realization due not only to the nature of rights and the peculiarities of children as subjects of rights. The conflict of interests between short-term and long-term aims, and the different interpretations a state can do on the question concerning how to materialize social rights policies and how to interpret its commitments on social justice play also a role. Starting by the question on why the affluent states do not seem (...) to be motivated enough to fully assume those duties of justice toward children —derived form recognizing children’s rights—, this article aims to explore and shed light on what psychology of motivation and moral psychology, and positive approaches could offer in relation to political and ethical challenges toward childhood. Hence this article advocates for the modification and enrichment of the philosophical discourse on children’s rights with what psychology has proved to have a more efficient impact in agents’ action and motivation. In doing so, practical philosophy could improve its role helping understand and eventually surpassing some akratic tendencies in the public sphere with respect to children’s rights. (shrink)

In diesem Aufsatz vertrete ich die These, dass die Betreuungsverbote und einschränkungen für Kleinkinder, die im Zuge der Corona-Pandemie in Deutschland galten und immer noch gelten, in bestimmten Fällen zu signifikanten Verlusten des Wohlergehens von Kleinkindern führen. Dabei beziehe ich mich auf Kleinkinder, die in Strukturen leben, in denen die außerhäusliche Betreuung einen gewichtigen Beitrag zur Kinderbetreuung leistet. Ich werde dafür argumentieren, dass für diese Kinder der Wegfall der Kinderbetreuung bedeuten kann, dass gewichtige aktuelle immaterielle Wohlergehensinteressen nur noch teilweise oder (...) gar nicht mehr befriedigt werden. Um diese Interessen und das Ausmaß ihrer Nichtbefriedigung zu beschreiben, greife ich auf das Konzept der Kindheitsgüter zurück und werde mich dabei auf drei gewichtige immaterielle Wohlergehensinteressen konzentrieren: das Interesse des Kindes an pädagogisch wertvollen Betreuungsstrukturen, das Bedürfnis des Kindes nach Austausch und Spiel mit Gleichaltrigen und das Interesse des Kindes, frei von Sorgen und Ängsten zu sein. Die anschließende kinderethische Auswertung dreier aktueller Studien zur Situation der Kinder und Familien unter den Bedingungen der Corona-Pandemie zeigt, dass besonders die Umstände während des Lockdowns im Frühjahr 2020, aber auch die fortbestehenden Einschränkungen bei der Kinderbetreuung sowie die veränderte Arbeitssituation der Eltern erheblich dazu beitragen, dass das Wohlergehen von Kleinkindern in dieser Hinsicht beeinträchtigt wird. Am Ende des Aufsatzes werde ich mich der Frage widmen, was bei der Ausgestaltung zukünftiger Maßnahmen zur Bekämpfung der Corona-Pandemie aus kinderethischer Perspektive berücksichtigt werden sollte, um das Wohlergehen der Kleinkinder so gut wie möglich zu schützen.
