Stasis is a process of classical rhetoric that identifies the core issue in a trial or a similar debate. Hermagoras of Temnos included the first comprehensive analysis of stasis in his second-century BCE treatise on rhetoric, now lost. Modern scholars tend to echo George Kennedy, who maintains that Hermagoras’ inspiration for the hierarchical structure of stasis is indeterminate. This article, however, employs scholarship in legal semiotics, including the work of Miklós Könczöl and Bernard S. Jackson, to argue that Hermagoras based (...) stasiastic structure on Aristotle’s first-figure syllogism. Ideally, knowledge of that structure can enhance modern applications of stasis. (shrink)

In this paper, a survey is presented of the main approaches to the structure of argumentation. The paper starts with a historical overview of the distinctions between various types of argument structure. Next, the main definitions given in the various approaches are discussed as well as the methods that are proposed to deal with doubtful cases.

Virtue theories have become influential in ethics and epistemology. This paper argues for a similar approach to argumentation. Several potential obstacles to virtue theories in general, and to this new application in particular, are considered and rejected. A first attempt is made at a survey of argumentational virtues, and finally it is argued that the dialectical nature of argumentation makes it particularly suited for virtue theoretic analysis.

Some authors have begun to appeal directly to studies of argumentation in their analyses of mathematical practice. These include researchers from an impressively diverse range of disciplines: not only philosophy of mathematics and argumentation theory, but also psychology, education, and computer science. This introduction provides some background to their work.

This paper analyses the discourse surrounding a high-profile sexual assault case in South Korea. While most research on language and sexual violence has focused on the media portrayal or online resistance movement, not much has focused on the language and the law. Using Critical Discourse Analysis and rhetoric, this present paper seeks to show the importance of value of paying closer attention to legal decision-making process, showing how this can make a significant contribution to the literature. The analysis reveals two (...) distinctive discourses at work. One is that victims must embody and display certain characteristics as a ‘pure and destroyed’ individual in order to avoid being dismissed or appearing untrustworthy. The second is that the perpetrators represent themselves as victims seeking to makes it the goal of the court to protect the perpetrators’ rights, rather than those of the victims. (shrink)

This article reacts against the undesirable ideological separation between dialectical and rhetorical approaches to argumentative discourse. It argues that a sound evaluation of argumentation requires an analysis that reveals all aspects of the discourse pertinent to critical testing. To explain the rationale of the various moves made in the discourse and the strategic patterns behind them, not only the interlocutors' dialectical goals must be taken into account, but also their rhetorical goals. Through the example of a paradigmatic deliberative speech from classical oratory, the paper addresses two fundamental questions of teaching rhetorical reasoning. First, the paper shows that a speech from ancient Greek and Roman political or judicial oratory could provide effective means to teach a variety of argumentation skills, the recognition of fallacies and an awareness of biases in the target audience. Second, the paper uses the speech to consider an elusive problem of rhetorical or critical reasoning instruction, namely how students (...) may use historical models to adapt their knowledge of a case to real-life situations, where a large number of uncertain variables demands a constant awareness of the conditions affecting the audience`s decision and may require a swift change in the argumentative strategy. The paper will argue that the application of a new model of strategic reasoning called heuristic rhetoric to Cicero`s speech could illustrate a workable solution to both problems. (shrink)

The article reviews the uses of the term ‘oikonomia’ in Greek-speaking antiquity and illustrates how the term was used in all spheres of human existence and in various arts and sciences, usually denoting the prudent dispensation of the field resources. In this era the arts and sciences also received their own economies, and the term oikonomia, designating in most cases the prudent management of resources, appears in political theory, military strategy, law, finance, medicine, literary criticism, architecture, music, history and rhetoric. (...) Among all the spheres, arts and sciences that were economized, the story of oikonomia in the field of rhetoric is at the center of this article’s attention. As shown, the concept of oikonomia took an intermediate form between the realm of thought – that is, the domain of philosophy – and the realm of public speech – the domain of politics. (shrink)

Edward R. Murrow's reputation began and grew with World War II. This analysis, focused on his radio reporting, concerns two reports filed after he accompanied a bombing mission over Germany. The two reports provide a unique analytic opportunity because their foundation is in a singular experience.
