Ghostwriting is viewed by some as a necessary element for crafting an effective public image. Defenders of ghostwriting see no ethical dilemma in the practice because the audience knows the speechgiver is not necessarily the speechwriter. Alernatively, those regarding ghostwriting as unethical view the practice as deceitful. This group argues that the audience does not recognize the employment of a speechwriter and thus a speechgiver relies on the words of another to fortify personal ethos. This article examines several positions regarding (...) the ethics of ghostwriting and discusses an empirical study testing three major positions found in ghostwriting literature. Findings from the study indicate that respondents do recognize the use of speechwriters by certain individuals in certain circumstances. (shrink)

This paper deals with what has been called "ars inveniendi" (’art of finding‘) in antiquity, medieval and early modern times. A survey of different techniques of finding tenable and relevant arguments is presented (among them, the Topical tradition, Status theory, Debate theory, Encyclopedic systems, Creativity techniques). Their advantages and disadvantages are critically compared. It is suggested that a mixture of strategies of finding arguments should be used. Finally, a few remarks showing the relationship beween the strategies of finding arguments and (...) creativity in general are given. (shrink)

While the formal treatment of arguments in the late medieval modi arguendi owes much to dialectic, this does not remove the substance and function of the argumentative modes discussed from the realm of rhetoric. These works, designed to teach law students skills in legal argumentation, remain importantly focused on persuasive features of argumentation which have traditionally been strongly associated with a rhetorical approach, particularly in efforts to differentiate from it dialectic as a more strictly scientific and logical form of reasoning. (...) This also sheds some light on the relative roles logic and rhetoric play in the legal discourse of our own time. In their approach to persuasive legal discourse, the modi arguendi stand between the argumentative rhetorics of Antiquity and the rhetoricized dialectics of the Renaissance, and by linking the minute technicalities of professionalized law with broad general considerations of justice, utility, nature, and emotion, they mediate between the modem trend towards atomized field-specific rhetorics and the classical idea of a unified civic rhetoric. Ce projet de recherche est le fruit d'un travail qui mûrit depuis trois ans et qui prend forme, petit à petit. Je l'ai présenté au comité de la section 32 du CNRS en 2010, 2011, 2012 et en 2013. Je souhaite ici en soumettre des aspects au regard critique de l'internaute éclairé qui rend visite à Rhuthmos. Le concept de rythme était l'objet de ma thèse consacrée au numerus oratoire et musical.
