En la posición de algunos libertarianos, los derechos sociales son inexistentes como "derechos". Quiero ubicar primero los planteamientos principales de algunos libertarianos y posteriormente mostrar las posiciones de Locke. Esto nos permitiría rastrear las condiciones de posibilidad de fundamentación de los derechos económicos y sociales desde los orígenes del pensamiento liberal. Sostengo que existe una contradicción entre los principios teóricos planteados por Locke y las propuestas radicales de los libertarianos y muestro el modo como desde Locke se sustenta la necesidad (...) de la redistribución económica en aras de una mayor igualdad política. In some libertarian's opinion, social rights are inexistent as 'rights'. In this paper, I will first identify some of the main libertarian's approaches to then show Locke's positions. This will allow tracing the conditions for the potential foundations of the economic and social rights back to the beginnings of the liberal thought. I argue that there is a contradiction between Locke's theoretical principles and the libertarian's radical approaches. Finally, I show how the need for an economic redistribution looking toward a greater political equality can be supported based on Locke. (shrink)

This paper draws attention to the tendency of a range of technologies to reduce pedagogical interactions to a series of datafied transactions of information. This is problematic because such transactions are always by definition reducible to finite possibilities. As the ability to gather and analyse data becomes increasingly fine-grained, the threat that these datafied approaches over-determine the pedagogical space increases. Drawing on the work of Hegel, as interpreted by twentieth century French radical philosopher Alexandre Kojève, this paper develops a model (...) of relational pedagogy which highlights three points of incompatibility with a datafied learning environment reduced to finite measures. Firstly: Kojève’s accont of authority in Hegel posits two aspects to the mimetic relation between teacher and student: recognition and realisation, which belong to the ipseity or about-self-ness of the subject, and are incompatible with a general definition of data. Secondly, the Hegelian approach to human historical time, in particular the assertion that time and desire are begun in the future, not the past, renders it incompatible with mathematical time as used in data processing. Finally, from these it is possible to derive a distinctive notion of the work of pedagogy, grounded in Kojève’s realist reading of Hegel, irreducible to information processing. In consequence of this threefold irreducibility, the paper draws attention to a need for relations of human pedagogical work to be inherent in the design of educational technologies and highlights the dangers of presuming a machine intelligence model in the design of learning environments. Responding to Rawls’ pleas in Political Liberalism against appeals to comprehensive doctrines, be they religious or metaphysical, I argue that such constraints are inherently illiberal—and unworkable. Rawls deems political proposals inherently coercive and judges everyone in a democracy a participant in governance—thus, in effect, complicit in state coercion. He seeks to limit the sweep of his exclusionary rule to core questions of rights. But in an individualistic and litigious society like ours it proves hard to draw a firm boundary around (...) issues that raise core (constitutional) questions. The standards Rawls proposes seem oppressive in effect, their likeliest yield, a kind of doublethink, encouraging many citizens to cloak their deepest normative concerns in neutered language. I worry about the means by which Rawls’ ‘overlapping consensus’ might be attained, and about the exclusion (as metaphysical) of policy proposals in behalf of broadly conceived human goods. I find it suppositious in Rawls to presume the innocence of seemingly secular arguments while placing in the stocks the religious appeals critical to many, along with old and new metaphysical arguments that may seek to bridge the gap between religious and secular appeals. Over the last two decades, complexity theory, which is designed to deal with systems of multiple interdependent variables, has been increasingly applied to analyse and shed light on various aspects of education. So far, however, complexity theory has rarely been used, if at all, to examine questions related to educational justice. This article offers a theoretical examination of some possible links between complexity theory and distributive justice in education. It asks how accepting the premise that education is a complex dynamic (...) system should shape the way distributive justice in education is conceptualized and approached. It is argued that complexity theory challenges many assumptions on which the dominant approach for dealing with distributive justice in education rests. The article focuses on three subjects that stem from complexity theory but have implications for dealing with distributive justice in education: system diversity, reductionism, and change. Each of these subjects is examined separately, and some possible contributions of complexity theory to illuminating these subjects in relation to distributive justice in education are discussed. The article ends with a brief illustration of where a complexity-based approach to educational justice leads that focuses on school choice and contrasts it with Brighouse's views on this issue. This article contributes to recent work on justice in resilience-based projects for climate adaptation. At present, the model commonly used for guiding normative reflection in this domain is the tripartite model of justice, whereby justice is seen as comprising distributive, procedural and recognitional aspects. After discussing some conceptual problems and practical shortcomings of this model, we propose an alternative model with six forms of justice or kinds of justice demands: distributive, procedural, intergenerational, restorative and retributive justice, and justice in system (...) outcomes. We also illustrate some advantages of this model with respect to representative accounts of the tripartite model. (shrink)

Humanitarian migration creates, on the one hand, huge benefits for those who are protected from war, persecution and other forms of violence, but, on the other hand, involves also net monetary and social costs for the population in host countries providing protection at the same time. This is the core of the ethical and political problem associated with the governance of humanitarian migration. Against this background, this paper discusses whether the provision of protection can be founded on rational ethical principles. (...) By drawing on a utilitarian approach a simple criterion is derived: Humanitarian migration is welfare improving, as long as the benefits of the marginal humanitarian migrant exceed the marginal costs of providing shelter per refugee. Based on this principle, practical solutions for the admission of humanitarian migrants and the international and European coordination of asylum policies are discussed. (shrink)

Departing from theories of distributive justice and their relation with the distribution of health care within society, especially egalitarianism and libertarianism, this paper aims at demonstrating that the approach taken by the European Court of Justice regarding the application of the Internal Market principles (or the market freedoms) to the field of health care services has introduced new values which are more concerned with a libertarian view of health care. Moreover, the paper also addresses the question of how these new (...) values introduced by the Court may affect common principles of European health systems, such as equity and accessibility. Today, resilience is used in many societal contexts for understanding how things respond to risks and for improving their performance in this regard, having also become a prominent approach for adapting to climate change. Yet, despite the broad appeal of resilience and resilience-based approaches within and outside academia, there are persisting puzzles about how to interpret resilience, its relation to competing concepts and approaches, or its desirability. Some proponents of resilience advise caution with the normative use of the term, noting (...) that resilience is a purely descriptive and ambivalent quality, which can be good in some circumstances but not in others. Critics have also noted that resilience approaches can be technocratic and that they tend to conceal the needs and vulnerabilities of the poor. -/- These examples demonstrate the need for reflecting on the status and significance of a term that is so widely used in academia and across the science-policy divide, but whose meaning and value are so fiercely disputed. Given that resilience is already informing many large-scale and significant societal efforts, they also raise the need to ask under which conditions such efforts could be just. -/- This work uses philosophical perspectives from ethics, metaethics and justice theory for revisiting recent debates on the meaning and normative status of this concept, with special emphasis on understanding the normative guidance that diverse interpretations of resilience can offer and disclosing the implications that this may have for achieving justice in and through resilience-based interventions. This paper will focus on the problem of environmental refugees related to environmental decay and resource loss. Robert Nozick’s distributive justice theory will be used as a theoretical framework to analyze the problem of environmental refugees. The restrictive nature of Nozick’s theory of distribution is rather practical since it meets with many of the current mores regarding wealth accumulation, desert, and aspirations for inheritance. Given our current reluctance to redistribute to prevent the effects of environmental decay, and to pay to (...) prepare for disasters generally, the prospect of a redistributive solution to environmental refugees that permanently alters patterns of ownership is rather unlikely. Nevertheless, given the rather unfortunate possibility of increasing numbers of environmental refugees in the future, a practical means to provide for their well-being needs to be considered. (shrink)
