In this paper I analyze constitution embodiment, a particular conception of embodiment. Proponents of constitution embodiment claim that the body is a condition of the constitution of entities. Constitution embodiment is popular with phenomenologically-inspired Embodied Cognition, including research projects such as Enactivism and Radical Embodied Cognitive Science. Unfortunately, PEC’s use of constitution embodiment is neither clear nor coherent; in particular, PEC uses the concept of constitution embodiment so that a major inconsistency is entailed. PEC conceives of the body in a (...) transcendental sense as a condition of the constitution of entities, and, in an ontic sense, as a scientifically describable entity. Yet, a condition of the constitution of entities cannot be itself an entity—rather, it is the very condition of the possibility of an entity. This inconsistency entails further problems, among them PEC’s misguided focus on the location of the embodied mind. In order to correct these mistakes, I develop a conception of constitution embodiment based on the work of Heidegger, Husserl and to a lesser degree Merleau-Ponty. This has two purposes. First, it provides the conceptual groundwork to secure the status of PEC as a consistent and coherent research project and to clarify PEC’s conception of the relationship between phenomenology and the sciences. In that spirit, my approach provides further guidelines for fruitful research alliances between PEC and other research programs such as Grounded Cognition and identifies current research alliances, such as those with Radical Enactivism, as undesirable. Second, my account provides an elaborate concept of constitution embodiment that can function as the basis for more sophisticated work in the future. (shrink)

PurposeIn this paper, patient information is approached from a Heideggerian perspective with the intention to gather an understanding about the personal nature of the information. The purpose of this paper is to analyse the ownership of patient information and then present Datenherrschaft as a suitable model for patient ownership of patient information.Design/methodology/approachThis paper is theoretical in approach. It is based on arguments derived from Heidegger’s work in the Being and Time.FindingsBased on this Heideggerian approcah, a proposal for using the special (...) definition of ownership of patient information – Datenherrschaft – given to a patient is suggested. From a Heideggerian perspective, it can be stated that the patient has the strongest rights towards patient information because this information is crucial for a patient to have an understanding about their Dasein.Research limitations/implicationsDatenherrschaft is used as an example of an ethically justified way of regulating the patient information ownership and should be analysed further. Especially the practical implications of implementing Datenherrschaft need more research.Originality/valuePatient information ownership is an issue that is neither unambiguously solved in many countries, nor has it, in our view, been ethically justified. The potential solution – Datenherrschaft – presented in this paper is clear and has strong philosophical justifications. (shrink)

In this article, I respond to important questions raised by Gallagher and Jacobson in the field of cognitive science about face-to-face interactions in Heidegger’s account of ‘intersubjectivity’ in Being and Time. They have criticized his account for a lack of attention to primary intersubjectivity, or immediate, face-to-face interactions; he favours, they argue, embodied interactions via objects. I argue that the same assumption underlies their argument as did earlier critiques of a lack of an account of the body in Heidegger ; (...) namely that because the body is not explicitly discussed in Being and Time, embodiment, rather than stressing the immediacy of experience, is insufficiently acknowledged in his emphasis on ‘being-in-the-world’. Through placing Gallagher and Jacobson’s accounts of intersubjectivity and the body alongside Heidegger’s accounts of Mitsein and Leib, this article shows Heidegger’s radical position on the body as immersed in a holistic environment, and its reverberations on his account of intersubjectivity. I argue that Dasein’s embodied engagement in the world is always one of immediacy and that the body of the other is perceived as ‘tied into’ its context, as well. In so doing, I offer an Heideggerian account of ecstatic involvement which moves away from the distinction between primary and secondary intersubjectivity toward an immediate engagement with objects and people always already ‘tied into’ a context; an account that, through the concept of Fürsorge, includes shifts of attention between objects and people that allow for the ethical distinctions Gallagher and Jacobson are looking for. The ill body is sometimes phenomenologically interpreted as a "broken tool" encountered in an uncanny way. I argue that this is not what is most uncanny about illness. Within the context of an account of Freud and Heidegger’s work, I argue that in health, we are generally alienated from the way our bodies will become inert, lifeless corpses. In the uncanniness of illness (and sometimes other situations), we may be reattuned to this horrific certainty and disabused of the comforting view (...) that our bodies are reparable tools. I revisit Zaner’s characterization of the uncanny and show how his notion of "chill and implicatedness" captures the dynamic sense of alienation that characterizes how we are bodily Being-toward death. At the beginning of Being and Time, Heidegger rejects Husserl’s classical phenomenology on three grounds: he claims that Husserlian phenomenology is impaired by indeterminate concepts, by naïve personalism, and by obscurities in its account of individuation. The paper studies the validity of this early critique by explicating Husserl’s discourse on human persons as bodily-spiritual beings and by clarifying his account of the principles by which such beings can be individuated. The paper offers three types of considerations. After a summary of (...) Heidegger’s early critique of Husserl, the second section of the paper distinguishes between two dimensions of Husserl’s discourse on human persons. It argues that Husserl does not put forward one analysis of the being of humans, but explicates two different accounts and then studies critically their mutual relations of dependency: on the one hand, the naturalistic account of human beings as layered beings and on the other hand the personalistic account of human beings as peculiar kinds of unified wholes in which the mental and the bodily are inextricably intertwined. The third section of the paper clarifies Husserl’s theory of individuation and its consequences for our discourse on human persons. Finally, the fourth section explicates the conceptual means by which Husserl develops his account of human beings as persons. The paper ends in drawing some conclusions for contemporary philosophical anthropology. (shrink)
