This article addresses the ambivalent role of violence in liberation struggles by staging a mutually enriching dialogue between Hannah Arendt and Frantz Fanon. It challenges the binary distinction between justifiable resistance that allows for only short-term, instrumental use of violence, and unwarranted resistance where violence is intrinsically justified as a creative, organic life-force of the oppressed. Instead, it discusses the constitutive role of violence as a condition of possibility of politics – highlighting the impossibility of separating the bloody moments of (...) revolution from the constitution of the political community as a space of public freedom. The reconstructed debate on the relation between violence and freedom presents a fresh perspective on the justifiability and costs of violent resistance in circumstances of radical inequality and the extent to which liberation may remain an ongoing project to sustain the fragile achievement of freedom. ABSTRACTProviding an introduction to this special issue on the ancient notions of liberty and its modern perspectives, this essay contains, first, some reflections about the relation between the fields of ancient history and contemporary political theory. Building on the comments of the final roundtable with Kinch Hoekstra and Quentin Skinner, it then makes an attempt at extrapolating some theoretical understandings of liberty from a wide range of geographical and historical contexts covered in the contributions. Moving away from a strictly classical (...) Graeco-Roman focus, these include investigations from the second millennium BCE polities in the Levant to the Byzantine empire in the fifth-century CE. Nossa seleção de verbetes parte do interesse de cada pesquisador e os dispomos de maneira histórico-cronológica e, ao mesmo tempo, temática. O verbete de Melissa Lane, “Filosofia Política Antiga” vai da abrangência da política entre os gregos até a república e o império, às portas da cristianização. A “Filosofia Política Medieval”, de John Kilcullen e Jonathan Robinson, é o tópico que mais demanda espaço na nossa seleção em virtude das disputas intrínsecas ao período, da recepção de Aristóteles pelo medievo e (...) da tensão entre poder Papal e Civil. No verbete “Liberalismo”, de Gerald Gaus, Shane Courtland e David Schmidtz, vemos as fontes fundantes da Filosofia Política da modernidade. As ideias de liberdade negativa e positiva se coadunam com a Ética Liberal e sua influência sobre a abrangência do valor fundamental da liberdade individual diante das políticas públicas. O texto de Ian Carter, “Liberdade Positiva e Liberdade Negativa”, expõe o paradoxo da liberdade em suas concepções valorativas e neutra, muito úteis para compreender os problemas políticos que enfrentamos hoje. Por fim, Bas Van Der Vossen no texto “Libertarianismo” trata das noções tensas entre Estado e indivíduos. A concepção de “liberdade de si”, genuinamente negativa, ganha destaque justificatório. Jackie Scully, no verbete Bioética Feminista, exemplifica o valor da influência dessas correntes no âmago de todos os contemporâneos. Sua escrita homenageia postumamente Anne Donchin com um apanhado histórico da luta de inserção de políticas feministas na pesquisa acadêmica global. No verbete “Democracia”, os professores brasileiros Gustavo Dalaqua e Alberto Ribeiro Barros acrescentaram tópicos importantes ao tema geral, respectivamente: “Construtivismo Representativo vs. Representação Descritiva” e “Democracia Contestatória de Philip Pettit”. O texto de Thomas Christiano perpassa os principais argumentos de justificação política contra e a favor da democracia ocidental, com foco central nas concepções de liberdade e igualdade. Os verbetes dispostos nessa seleção de textos são tendenciosos na medida que expressam o interesse genuíno de cada pesquisador com os assuntos relevantes em suas pesquisas. Em virtude disso, a escolha “adota um lado” em detrimento de outros – mais especificamente: de outro que poderia ser mais “progressista”. Por si só, o livro já nasce reclamando um segundo volume, que será providenciado. Colocamos de lado qualquer exigência de “imparcialidade”, algo que não existe na Filosofia, muito menos na Filosofia Política. Sobressai, nesse aspecto, o caráter reflexivo que o assunto exige e a importância do assunto, sem o qual não teríamos a modernas concepções de representatividade, as teorias da justiça ou mesmo as ciências sociais. Um outro volume, portanto, se faz imperativo, por conta da abrangência da própria SEP e do respeito a seu projeto inicial, genuinamente um plano plural. (shrink)

Personal autonomy is often lauded as a key value in contemporary Western bioethics. Though the claim that there is an important relationship between autonomy and rationality is often treated as uncontroversial in this sphere, there is also considerable disagreement about how we should cash out the relationship. In particular, it is unclear whether a rationalist view of autonomy can be compatible with legal judgments that enshrine a patient's right to refuse medical treatment, regardless of whether the reasons underpinning the choice (...) are known and rational, or indeed whether they even exist. Jonathan Pugh brings recent philosophical work on the nature of rationality to bear on the question of how we should understand personal autonomy in contemporary bioethics. In doing so, he develops a new framework for thinking about the concept of autonomy, one that is grounded in an understanding of the different roles that rational beliefs and rational desires have to play in it. Pugh's account allows for a deeper understanding of d the relationship between our freedom to act and our capacity to decide autonomously. His rationalist perspective is contrasted with other prominent accounts of autonomy in bioethics, and the revisionary implications it has for practical questions in biomedicine are also outlined. Enhancing agency—or in a more colloquial term, promoting empowerment—is typically viewed as an unquestioned good. International organisations promote the empowerment of girls and other vulnerable groups around the world. Domestically, democracies rely for their legitimacy on the idea that citizens have agency; hence, civic educators aim to strengthen student ‘voice’ and their inclination to participate. This is all for good reason, as justice does depend in part on the agency of individuals and oppressed groups. But a focus on individual or (...) even collective agency has a dark side. For if people feel that they can change the world, then they also often feel that they should. This sense of responsibility to use one's agency at all times can encourage an instrumental relationship to others and make it difficult to learn receptively, particularly from people with whom we disagree, and especially in moments of crisis. Among the civilization challenges, recognizing the human freedom and drawing its constraints have continuously been contestable. Hence, the recognition, definition, pledge and delineation of the boundaries of freedom have a special position in the declaration of rights. In the meantime, considering the historical intersection of jurisprudential foundations with the modernist thoughts, defining the concept of freedom and delineating its boundaries will be crucial. This definition provides a groundwork for elucidating and interpreting other Articles via identifying their positions in creating solutions (...) to the problems of public administration. The current study is an effort to recognize the concept of freedom and its boundaries in the constitutional system of the Islamic Republic of Iran via employing a descriptive-analytical method. Our findings indicate that the perception of freedom in the Constitution of the Islamic Republic of Iran is convoluted and interpretable. Because of the existing ambiguities in balancing among the historical concerns, the boundaries of freedom can be redefined based on the temporal and historical circumstances by the pressure of social forces. One of the simplest methods used by Cicero for depicting a personality or characteristic of an individual within his correspondence was to use a nickname. When describing groups, the natural progression was to use collective nouns that helped to define some essential quality of this collective. The enormity of Caesar's assassination provided an opportunity to use a plethora of terms for the conspirators, most conspicuously seen in Cicero's treatment of Cassius and Brutus following the death of Caesar. The act itself (...) had a polarizing effect. On one side were the invective terms for assassins, murderers and parricides. On the other side were the favourable terms, such as liberators, heroes and tyrannicides. Cicero also included in his correspondence Greek words, as well as their transliterations into Latin. Each word would seem to have its own subtle characteristics, focussing on different aspects and interpretations of the conspirators and their act of tyrannicide or political murder. The collective nouns themselves and the context in which they are used not only will provide the first indication of how Cicero felt about the conspirators but may also give an insight into Cicero's perception of the general feeling about the political situation in Rome at this time. This essay considers the theoretical disagreement between Isaiah Berlin and Hannah Arendt on the meaning and value of freedom. Berlin thinks that negative liberty as non-interference is commendable because it is attuned to the implication of value pluralism that man is a choice-making creature and cannot be otherwise. By contrast, the political freedom to act is in Arendt’s view a more fulfilling ideal because it is only in political action that man’s potentiality is actualised, his unique identity manifested and his (...) being-in-the-world-with-others reaffirmed. What lies beneath the two thinkers’ dispute over the most satisfactory meaning of freedom, I argue, is a deeper disagreement over human nature itself. The implication of this analysis for the contemporary debate between pluralist liberals and their agonistic critics is briefly discussed in conclusion. (shrink)

Although the idea of freedom has been well studied as an ideal in political philosophy, relatively little scholarship has focused on the human experience of freedom. Drawing on ethnographic research between 2012 and 2013, I examine how freedom was achieved by people who practice freeganism and freecycling in Hong Kong. I show that the freedom that these people pursue, either individually or collectively, is not a freedom without constraints but a freedom that must be attained through the exercise of deliberation, (...) restraint, and self-discipline. While freegans seek liberation by withdrawing from the world and practicing self-cultivation (chushi asceticism), freecyclers do so by engaging with worldly affairs in order to create social changes (rushi asceticism). In both cases, by reimagining freedom as ethical practices rather than a right that comes naturally with birth, freegans and freecyclers in Hong Kong are able to experience moments of freedom despite inevitable structural constraints.
