Thus far, the philosophical study of patenting has primarily focused on sociopolitical, legal, and ethical issues, such as the moral justifiability of patenting living organisms or the nature of (intellectual) property. In addition, however, the theory and practice of patenting entails many important problems that can be fruitfully studied from the perspective of the philosophy of science and technology. The principal aim of this article is to substantiate the latter claim. For this purpose, I first provide a concise review of (...) the main features of the theory and practice of the patenting of scientific and technological inventions. Second, I discuss several philosophical issues implied by these features and explore the possible contributions of the philosophy of science and technology to the clarification, or resolution, of these issues. The seven features discussed are: patents as commercial monopolies on scientific and technological inventions, the contrast between natural and non-natural subject matter, the distinction between inventions and discoveries, the reproducibility of inventions, the question of the sameness of two inventions, the distinction between the invented and the protected object, and the contrast between material objects versus concepts and theories. The article concludes with some observations on the problems and prospects of the philosophical study of the theory and practice of patenting scientific and technological inventions. (shrink)

I put forward a general account of technology, which includes both similarities and dissimilarities to Andrew Feenberg's instrumentalization theory. This account characterizes a technology as a "(type of) artefactual, functional system with a certain degree of stability and reproducibility". A discussion of how such technologies may be realized discloses five different levels at which alternative choices might be made. On (...) this basis, I argue that a critical philosophy of technology should analyse and assess the choices that have, and have not, been made in actual practice, and contribute to social experiments that aim at more democratic and more desirable alternatives. Synthetic biology is rather a new field of science and technology. Societal, regulatory, legal, ethical, safety and security aspects of this field have already been analysed in much detail and discussed very widely in recent years. There is, however, a dearth of empirical studies on the points of view of relevant stakeholders in countries where SB is still in the process of emergence. Slovenia is one of them, and accordingly, the article analyses the situation of SB in this small country, (...) focusing on the points of view of various stakeholder groups concerning three aspects of SB: the policy framework, the ethical-legal discourse and the issues of biosafety and biosecurity. It is argued that Slovenia has missed many opportunities to foster the domestic development of the field; in particular, considering that at an early stage, young Slovenian researchers participated very successfully in the International Genetically Engineered Machine competition. In this paper we begin with a reference to the work of Hernando de Soto The Mystery of Capital: Why Capitalism Triumphs in the West and Fails Everywhere Else, and his characterization of the Western institution of formal property. We note the linkages that he sees between the institution and successful capitalist enterprise. Therefore, given the appropriateness of his analysis, it would appear to be worthwhile for developing and less developed countries to adjust their systems of ownership to conform more (...) closely to the Western system of formal property. However, we go on to point out that property relationships within the Western system have become subject to redefinition through the expansion of Intellectual Property rights in ways that ultimately work to the disadvantage of the developing and less developed countries. We point out that this restructuring has been given global application through the implementation of the TRIPS agreement by the WTO. In the final section of the paper I suggest ways in which IP rights and relevant institutions can be reformed in order to avoid the disadvantages to the developing and less developed countries. Concerns have been voiced about the ethical implications of patenting practices in the field of biotechnology. Some of these have also been incorporated into regulation, such as the European Commission Directive 98/44 on the legal protection of biotechnological inventions. However, the incorporation of ethically based restrictions into patent legislation has not had the effect of satisfying all concerns. In this article, we will systematically compare the richness of ethical concerns surrounding biotech patenting, with the limited scope of ethical concerns actually (...) addressed in the patent system. As sources of our analyses we will use literature and document studies and a survey with important stakeholders and experts related to Norwegian patenting in the aquacultural biotechnology sector. We will structure the analyses with an ethical matrix, developed for this purpose. Showing the misalignment of the discussions within and outside the patent system, we suggest that an important reason for the ethical controversy still surrounding patenting is that ethical questions keep being framed in a narrow way within the system. Until a richer set of ethical considerations is addressed head-on within the patent system, the patent system will continue to evoke academic and interest group criticism, potentially contributing to a legitimacy crisis of the whole system. Starting from the sixties of the past century theory change has become a main concern of philosophy of science. Two of the best known formal accounts of theory change are the post-Popperian theories of verisimilitude (PPV for short) and the AGM theory of belief change (AGM for short). In this paper, we will investigate the conceptual relations between PPV and AGM and, in particular, we will ask whether the AGM rules for theory change are effective means for approaching the truth, (...) i.e., for achieving the cognitive aim of science pointed out by PPV. First, the key ideas of PPV and AGM and their application to a particular kind of propositional theories - the so called "conjunctive propositions" - will be illustrated. Afterwards, we will prove that, as far as conjunctive propositions are concerned, AGM belief change is an effective tool for approaching the truth. (shrink)
